certain products deemed to have a       
biologics license pursuant to section

,competition and ,innovation ,act of    
#bjji4  #a4 ,short title ,this ,act may 
be cited as the ,protecting ,access to  
,biosimilars ,act of #bjai4  #b4        
,treatment of biological products deemed
 licensed ,section #cea7k77#g7 of the   
,public ,health ,service ,act 7#db      
,u4,s4,c4 #bfb7k77#g77 is amended by    
adding at the end the following3  7,d7  
,deemed licenses  7i7 ,no additional    

exclusivity through deeming ,an approved
 application that is deemed to be a     
license for a biological product under  
this section pursuant to section        
#gjjb7;e77#d7 of the ,biologics ,price  
,competition and ,innovation ,act of    
#bjji shall not be treated as having    
been first licensed under subsection 7a7
 for purposes of subparagraphs 7,a7 and 
7,b74  7ii7 ,applicability of           
antievergreening provisions             
,subparagraph 7,c7 shall apply to any   
reference product1 without regard to    
whether-- 7,i7 such product was first   
licensed under subsection 7a72 or       
7,,ii7 the approved application for such
 product was deemed to be a license for 
a biological product as described in    
clause 7i74  4
