certain notice requirements and         
penalties for releases of hazardous     
substances from animal waste at farms4

 as the ,fair ,agricultural ,reporting  
,method ,act or the ,,farm ,act4  #b4   

,exemptions from certain notice         
requirements and penalties ,section #ajc
 of the ,comprehensive ,environmental   
,response1 ,compensation1 and ,liability
 ,act of #aihj 7#db ,u4,s4,c4 #ifjc7 is 
amended by striking subsection 7e7 and  
inserting the following3  7e7           
,applicability to registered pesticide  
products and air emissions from animal  
waste at farms  7#a7 ,in general ,this  
section shall not apply to-- 7,a7 the   
application of a pesticide product      
registered under the ,federal           
,insecticide1 ,fungicide1 and           
,rodenticide ,act 7#g ,u4,s4,c4 #acf et 
seq47 or the handling and storage of    
such a pesticide product by an          
agricultural producer2 or  7,b7 air     
emissions from animal waste 7including  
decomposing animal waste7 at a farm4    
7#b7 ,definitions ,in this subsection3  
7,a7 ,animal waste  7i7 ,in general ,the
 term animal waste means feces1 urine1  
or other excrement1 digestive emission1 
urea1 or similar substances emitted by  

animals 7including any form of          
livestock1 poultry1 or fish74  7ii7     
,inclusions ,the term animal waste      
includes animal waste that is mixed or  
commingled with bedding1 compost1 feed1 
soil1 or any other material typically   
found with such waste4  7,b7 ,farm ,the 
term farm means a site or area          
7including associated structures7 that--
 7i7 is used for--  7,i7 the production 
of a crop2 or  7,,ii7 the raising or    
selling of animals 7including any form  
of livestock1 poultry1 or fish72 and    
7ii7 under normal conditions1 produces  
during a farm year any agricultural     
products with a total value equal to not
 less than #a1jjj4  4  #c4 ,application 
,nothing in this ,act or an amendment   
made by this ,act affects1 or supersedes
 or modifies the responsibility or      
authority of any ,federal official or   
employee to comply with or enforce1 any 
requirement under the ,comprehensive    
,environmental ,response1 ,compensation1
