title #di1 ,united ,states ,code1 to    
provide funding for public              
transportation services offered by      
high-performing public and private      
systems1 and for other purposes4  #a4   
,short title ,this ,act may be cited as 
the ,leveraging ,performance-,based     
,transportation ,services ,act of #bjag4
  #b4 ,funding for capital projects of  
leveraged systems  7a7 ,national        
,transit ,database ,section #ecce of    
title #di1 ,united ,states ,code1 is    
amended by adding at the end the        
following3  7d7 ,direct reporting by    
leveraged systems  7#a7 ,in general ,an 
owner or operator of a leveraged system 
may submit directly to the ,national    
,transit ,database data regarding the   

public transportation service provided  
by the system4  7#b7 ,notice to         
designated recipient ,on the date of a  
submission under paragraph 7#a71 the    
owner or operator of a leveraged system 
shall provide to the appropriate        
designated recipient under section      
#ecjg1 #ecaa1 or #ecci and metropolitan 
planning organization a copy of the     
submission4  7#c7 ,leveraged system     
defined ,in this subsection1 the term   
leveraged system means a provider of    
public transportation services1 whether 
public or private1 including commuter   
bus services and including services     
provided by a private provider of public
 transportation by vanpool 7as defined  
in section #ecbc7;i77#b77;,c771 that the
 ,secretary determines--  7,a7 is able  
to recover1 through fare revenue or     
payments made directly by the provider1 
all operating costs associated with the 
services2  7,b7 meets the requirements  
of the ,federal ,transit ,administration
 with respect to the provision of the   

services2 and  7,c7 does not1 through   
the provision of the services1          
negatively impact other publicly        
subsidized or privately provided public 
transportation services4  4  7b7        
,leveraging transit services ,section   
#ecae of title #di1 ,united ,states     
,code1 is amended-- 7#a7 by             
redesignating subsection 7d7 as         
subsection 7e72 and  7#b7 by inserting  
after subsection 7c7 the following3  7d7
 ,leveraging transit services  7#a7     
,passthrough  7,a7 ,apportionments ,the 
data submitted by the owner or operator 
of a leveraged system to the ,national  
,transit ,database under section        
#ecce7;d7 shall be used by the          
,secretary in calculating apportionments
 for capital payments under each of     
sections #ecjg1 #ecaa1 and #ecci4  7,b7 
,agreements ,a designated recipient that
 receives additional amounts in         
apportionments for a fiscal year as a   
result of data submitted to the         
,national ,transit ,database by the     

owner or operator of a leveraged system 
under section #ecce7;d7 shall enter into
 an agreement with the owner or operator
 that includes assurances that not less 
than #ij percent of the additional      
amounts will be transferred to the owner
 or operator if the owner or operator   
demonstrates that the transferred       
amounts will be used for capital        
expenditures to expand public           
transportation services meeting the     
requirements of paragraph 7#b7 in the   
geographic area represented by the      
designated recipient4  7#b7 ,services ,a
 public transportation service meets the
 requirements of this paragraph unless--
 7,a7 the service--  7i7 overlaps or    
directly competes with a service        
provided by the designated recipient    
concerned2 and  7ii7 has a direct effect
 on such service1 including a projected 
ridership reduction of more than #c     
percent along a corridor served by the  
designated recipient2 or  7,b7 the      
service is provided by a service        

provider that has less than #aj vehicles
 serving the recipient's designated     
area4  7#c7 ,local consent  7,a7        
,opportunity to object ,during the      
#cj-;day period beginning on the date   
the owner or operator of a leveraged    
system submits data to the ,national    
,transit ,database under section        
#ecce7;d71 the metropolitan planning    
organization representing the geographic
 area in which the owner or operator    
proposes to provide expanded public     
transportation services using amounts   
made available under this subsection may
 submit to the ,secretary a letter      
that--  7i7 objects to such use of funds
 based on a determination by the        
metropolitan planning organization that 
the expanded public transportation      
services do not meet the requirements of
 paragraph 7#b72 or  7ii7 objects to the
 use of the data in calculating         
apportionments based on a determination 
by the metropolitan planning            
organization that the owner or operator 

has not met the requirements of section 
#ecce7;d74  7,b7 ,effect of objection   
,in carrying out this subsection1 the   
,secretary shall take into account any  
letter received from a metropolitan     
planning organization under this        
paragraph4  7#d7 ,statutory construction
 ,nothing in this subsection may be     
construed-- 7,a7 to allow a designated  
recipient to dictate the service        
provided by the owner or operator of a  
leveraged system2 or  7,b7 to authorize 
the use of funds in a manner that is    
inconsistent with this chapter4  7#e7   
,leveraged system defined ,in this      
subsection1 the term leveraged system   
has the meaning given that term in      
section #ecce7;d74  4
