provisions as fall within the           
jurisdiction of the committee concerned 
,a ,,bill  ,to provide for the use of   
funds in the ,harbor ,maintenance ,trust
 ,fund for the purposes for which the   
funds were collected and to ensure that 
funds credited to the ,harbor           
,maintenance ,trust ,fund are used to   
support navigation4  #a4 ,short title   
,this ,act may be cited as the          
,investing ,in ,america3 ,unlocking the 
,harbor ,maintenance ,trust ,fund ,act4 
#b4 ,use of ,harbor ,maintenance ,trust 

,fund to support navigation  7a7        
,availability of amounts ,section #baj  
of the ,water ,resources ,development   
,act of #aihf 7#cc ,u4,s4,c4 #bbch7 is  
amended--  7#a7 in the section heading  
by striking ,authorization of           
appropriations and inserting ,funding   
for navigation2 and  7#b7 in subsection 
7a7 by striking ,there are authorized to
 be appropriated and all that follows   
before paragraph 7#a7 and inserting     
,amounts made available from the ,harbor
 ,maintenance ,trust ,fund in accordance
 with section #ieje7;d7 of the ,internal
 ,revenue ,code of #aihf shall be used  
to pay--4  7b7 ,amendment to trust fund 
code ,section #ieje7;c7 of the ,internal
 ,revenue ,code of #aihf is amended--   
7#a7 in the matter preceding paragraph  
7#a7 by striking 1 as provided by       
appropriation ,acts1 and inserting 1 in 
accordance with subsection 7d712 and    
7#b7 by adding at the end the following3
  7d7 ,availability of amounts          
,beginning on ,october #a1 #bjag1 there 

shall be available from the ,harbor     
,maintenance ,trust ,fund for making    
expenditures under subsection 7c7--     
7#a7 without further appropriation1 an  
amount equivalent to the taxes received 
in the ,treasury under section #ddfa for
 the previous fiscal year1 as determined
 by the ,secretary of the ,treasury2 and
  7#b7 such additional amounts as       
provided by appropriations ,acts4  4    
7c7 ,estimate of harbor maintenance     
needs ,section #aecg7b7 of ,,map-#ba    
7#cc ,u4,s4,c4 #bbch;a7#b77 is amended  
by striking amount of appropriations and
 inserting expenditures4  #c4 ,budgetary
 treatment of ,harbor ,maintenance      
,trust ,fund ,notwithstanding any other 
provision of law1 the receipts and      
disbursements of the ,harbor            
,maintenance ,trust ,fund--  7#a7 shall 
not be counted as new budget authority1 
outlays1 receipts1 or deficit or surplus
 for purposes of-- 7,a7 the budget of   
the ,united ,states ,government as      
submitted by the ,president2  7,b7 the  

congressional budget 7including         
allocations of budget authority and     
outlays provided therein72  7,c7 the    
,balanced ,budget and ,emergency        
,deficit ,control ,act of #aihe2 or     
7,d7 the ,statutory ,pay-,as-,you-,go   
,act of #bjaj2  7#b7 shall be exempt    
from any general budget limitation      
imposed by statute on expenditures and  
net lending 7budget outlays7 of the     
,united ,states ,government2 and  7#c7  
shall be available only for the purposes
 specified in section #ieje of the      
,internal ,revenue ,code of #aihf4  #d4 
,annual report to ,congress ,section    
#ccj of the ,water ,resources           
,development ,act of #aiib 7#bf         
,u4,s4,c4 #ieje note2 #ajf ,stat4 #dhea7
 is amended--  7#a7 in subsection 7a7-- 
7,a7 by striking and annually           
thereafter1 and inserting and annually  
thereafter concurrent with the          
submission of the ,president's annual   
budget request to ,congress12 and  7,b7 
by striking ,public ,works and          

,transportation and inserting           
,transportation and ,infrastructure2 and
  7#b7 in subsection 7b77#a7 by adding  
at the end the following3  7,d7 ,a      
description of the expected expenditures
 from the trust fund to meet the needs  
of navigation for the fiscal year of the
 budget request4  4  #e4 ,harbor        
,maintenance ,trust ,fund defined ,in   
this ,act1 the term ,harbor ,maintenance
 ,trust ,fund means the ,harbor         
,maintenance ,trust ,fund established by
 section #ieje of the ,internal ,revenue
 ,code of #aihf4  #f4 ,applicability    
,this ,act 7including the amendments    
made by this ,act7 shall apply to fiscal
 years beginning after ,september #cj1
