provide students with disabilities and  
their families with access to critical  
information needed to select the right  
college and succeed once enrolled4  #a4 
,short title  ,this ,act may be cited as
 the ,respond1 ,innovate1 ,succeed1 and 
,empower ,act of #bjaf or the ,,rise    
,act of #bjaf4  #b4 ,perfecting         
amendment to the definition of          
disability ,section #ajc7f7 of the      
,higher ,education ,act of #aife 7#bj   
,u4,s4,c4 #ajjc7f77 is amended by       
striking section #c7b7 and inserting    
section #c4  #c4 ,supporting students   
with disabilities to succeed once       

enrolled in college ,section #dhg7;a7 of
 the ,higher ,education ,act of #aife   
7#bj ,u4,s4,c4 #ajid7;a77 is amended by 
adding at the end the following3  7#cj7 
,the institution will carry out the     
following3 7,a7 ,adopt policies that1 at
 a minimum1 make the following          
documentation submitted by an individual
 sufficient to establish that such      
individual is an individual with a      
disability3  7i7 ,documentation that the
 individual has had an individualized   
education program 7,,iep7 in accordance 
with section #fad7;d7 of the            
,individuals with ,disabilities         
,education ,act1 including an ,,iep that
 may not be current or up-to-date on the
 date of the determination4 ,the        
institution may ask for additional      
documentation from an individual who had
 an ,,iep who was found ineligible for  
services or exited from eligibility     
under such ,act during elementary       
school4  7ii7 ,documentation that the   
individual has had a plan prepared under

 section #ejd of the ,rehabilitation    
,act of #aigc 7#bi ,u4,s4,c4 #gid74     
7iii7 ,a plan or record of service for  
the individual from a private school1 a 
local educational agency1 a ,state      
educational agency1 or an institution of
 higher education provided in accordance
 with the ,americans with ,disabilities 
,act of #aiij 7#db ,u4,s4,c4 #abaja et  
seq474  7iv7 ,a record or evaluation    
from a relevant licensed professional   
finding that the individual has a       
disability4  7v7 ,a plan or record of   
disability from another institution of  
higher education4  7vi7 ,documentation  
of a disability due to service in the   
uniformed services1 as defined in       
section #dhd;,c7a74  7,b7 ,adopt        
policies that are transparent and       
explicit regarding information about the
 process by which the institution       
determines eligibility for              
accommodations4  7,c7 ,disseminate such 
information to students1 parents1 and   
faculty in an accessible format1        

including during any student orientation
 and making such information readily    
available on a public website of the    
institution4  4  #d4 ,authorization of  
funds for the national center for       
information and technical support for   
postsecondary students with disabilities
 ,section #ggg7;a7 of the ,higher       
,education ,act of #aife 7#bj ,u4,s4,c4 
#aadjq7a77 is amended-- 7#a7 in         
paragraph 7#a71 by striking ,from       
amounts appropriated under section #ggh1
 and inserting ,from amounts            
appropriated under paragraph 7#e712 and 
7#b7 by adding at the end the following3
  7#e7 ,authorization of appropriations 
,there is authorized to be appropriated 
to carry out this subsection            
#aj1jjj1jjj4  4  #e4 ,inclusion of      
information on students with            
disabilities ,section #dhg7;a7 of the   
,higher ,education ,act of #aife 7#bj   
,u4,s4,c4 #ajid7;a771 as amended by     
section #c1 is further amended by adding
 at the end the following3  7#ca7 ,the  

institution will submit1 for inclusion  
in the ,integrated ,postsecondary       
,education ,data ,system 7,,ipeds7 or   
any other ,federal postsecondary        
institution data collection effort1 key 
data related to undergraduate students  
enrolled at the institution who are     
formally registered as students with    
disabilities with the institution's     
office of disability services 7or the   
equivalent office71 including graduation
 rates for students with disabilities   
and the number and percentage of        
students with disabilities accessing or 
receiving accommodations at the         
institution4 ,an institution shall not  
be required to submit the information   
described in the preceding sentence if  
the number of such students is equal to 
or less than #aj1 so as not to reveal   
personally identifiable information     
about an individual student4  4  #f4    
,rule of construction ,none of the      
amendments made by this ,act shall be   
construed to affect the meaning of the  

terms reasonable accommodation or record
 of impairment under the ,americans with
 ,disabilities ,act of #aiij 7#db       
,u4,s4,c4 #abaja et seq47 or the rights 
or remedies provided under such ,act4
