,mr4 ,cartwright1 ,ms4 ,velzquez1 ,ms4 ,meng1 ,mr4 ,smith of ,washington1 and ,mr4 ,van ,hollen7 submitted the following resolution2 which was referred to the ,committee on the ,judiciary ,,resolution ,expressing the sense of the ,house of ,representatives that the immigration policies of the ,united ,states should reduce automatic removal and detention1 restore due process for immigrants1 and repeal unnecessary barriers to legal immigration4 ,whereas ,april #bd1 #bjaf1 marks the #bj-year anniversary of the ,antiterrorism and ,effective ,death ,penalty ,act of #aiif1 and ,september #cj1 #bjaf1 marks the #bj-year anniversary of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif1 laws which dramatically expanded the criminalization of immigrants by expanding the range of convictions for which immigrants are automatically detained and removed2 ,whereas there is growing bipartisan acknowledgment of the devastating impact that the criminal justice system has on communities of color and that an immigration system that relies on the criminalization of immigrants compounds that injustice2 ,whereas these laws removed discretion from immigration judges and restricted their ability to consider whether to remove an immigrant or weigh the individual circumstances of a case1 and leaders from the ,national ,association of ,immigration ,judges support the restoration of this discretion2 ,whereas these laws prohibit judicial review of case decisions1 which undermine the constitutional protections of due process2 ,whereas leaders from law enforcement1 including the ,national ,association of ,district ,attorneys and the ,association of ,prosecuting ,attorneys1 acknowledge that these laws drastically expanded the definition of aggravated felonies to be overly broad and that the ,congress must narrow this definition2 ,whereas the overbroad definition of aggravated felony1 which includes petty offenses such as shoplifting1 writing a bad check1 or misdemeanor controlled substance offenses1 has led to the removal of lawful permanent residents who1 on average1 have lived legally in the ,united ,states for #ae years2 ,whereas ,human ,rights ,watch found that between #aiig and #bjjg1 of the #ijj1jjj immigrants removed on criminal grounds1 #gb percent were convicted of nonviolent offenses2 ,whereas these laws require mandatory detention and have led to the incarceration and long-term detention of thousands of immigrants in for-profit detention centers without access to representation2 ,whereas the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif created the #bhg7;g7 program1 which deputizes local law enforcement to enforce ,federal immigration law1 threatens the rights of ,united ,states citizens and immigrants alike1 and contributes to racial profiling in multiple jurisdictions2 ,whereas these laws created several fast-track removal processes that violate the due process rights of noncitizens1 asylum seekers1 and other vulnerable populations by expediting their removal without adequate opportunity to contest their case2 and ,whereas the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif created the three-year1 ten-year1 and permanent bars1 which prohibit immigrants who have a valid family sponsor from obtaining lawful permanent resident status1 and other barriers that restrict the ability of otherwise eligible individuals to obtain lawful immigration status3 ,now1 therefore1 be it ,that the ,house of ,representatives supports immigration legislation that-- 7#a7 acknowledges that immigrants and their families in the ,united ,states have inherent dignity and are deserving of human rights2 7#b7 restores proportionality and fairness to our immigration system by updating the definition of aggravated felony2 7#c7 restores discretion to immigration judges to waive grounds of inadmissibility and deportability1 which determine who is removed and who can obtain permanent status1 based on family and community equities1 humanitarian considerations1 other individualized circumstances1 or because it is in the public interest2 7#d7 restores judicial review of case decisions to protect due process2 7#e7 eliminates mandatory detention and prolonged detention for immigrants in all cases and preserves the ,secretary of ,homeland ,security's authority to exercise discretion in determining when to detain an individual2 7#f7 repeals the #bhg7;g7 program and any successor programs that similarly entangle local law enforcement with ,federal immigration authorities2 and 7#g7 repeals the three-year1 ten-year1 and permanent bars and other unnecessary barriers to legal immigration4
