a covered sports medicine professional who has in effect medical professional liability insurance coverage and provides in a secondary ,state covered medical services that are within the scope of practice of such professional in the primary ,state to an athlete or an athletic team 7or a staff member of such an athlete or athletic team7 pursuant to an agreement described in subsection 7b77#d7 with respect to such athlete or athletic team-- 7#a7 such medical professional liability insurance coverage shall cover 7subject to any related premium adjustments7 such professional with respect to such covered medical services provided by the professional in the secondary ,state to such an individual or team as if such services were provided by such professional in the primary ,state to such an individual or team2 and 7#b7 to the extent such professional is licensed under the requirements of the primary ,state to provide such services to such an individual or team1 the professional shall be treated as satisfying any licensure requirements of the secondary ,state to provide such services to such an individual or team4 7b7 ,definitions ,in this ,act1 the following definitions apply3 7#a7 ,athlete ,the term athlete means-- 7,a7 an individual participating in a sporting event or activity for which the individual may be paid2 7,b7 an individual participating in a sporting event or activity sponsored or sanctioned by a national governing body2 or 7,c7 an individual for whom a high school or institution of higher education provides a covered sports medicine professional4 7#b7 ,athletic team ,the term athletic team means a sports team-- 7,a7 composed of individuals who are paid to participate on the team2 7,b7 composed of individuals who are participating in a sporting event or activity sponsored or sanctioned by a national governing body2 or 7,c7 for which a high school or an institution of higher education provides a covered sports medicine professional4 7#c7 ,covered medical services ,the term covered medical services means general medical care1 emergency medical care1 athletic training1 or physical therapy services4 ,such term does not include care provided by a covered sports medicine professional-- 7,a7 at a health care facility2 or 7,b7 while a health care provider licensed to practice in the secondary ,state is transporting the injured individual to a health care facility4 7#d7 ,covered sports medicine professional ,the term covered sports medicine professional means a physician1 athletic trainer1 or other health care professional who-- 7,a7 is licensed to practice in the primary ,state2 7,b7 provides covered medical services1 pursuant to a written agreement with an athlete1 an athletic team1 a national governing body1 a high school1 or an institution of higher education2 and 7,c7 prior to providing the covered medical services described in subparagraph 7,b71 has disclosed the nature and extent of such services to the entity that provides the professional with liability insurance in the primary ,state4 7#e7 ,health care facility ,the term health care facility means a facility in which medical care1 diagnosis1 or treatment is provided on an inpatient or outpatient basis4 ,such term does not include facilities at an arena1 stadium1 or practice facility1 or temporary facilities existing for events where athletes or athletic teams may compete4 7#f7 ,institution of higher education ,the term institution of higher education has the meaning given such term in section #aja of the ,higher ,education ,act of #aife 7#bj ,u4,s4,c4 #ajja74 7#g7 ,national governing body ,the term national governing body has the meaning given such term in section #bbjeja of title #cf1 ,united ,states ,code4 7#h7 ,primary ,state ,the term primary ,state means1 with respect to a covered sports medicine professional1 the ,state in which-- 7,a7 the covered sports medicine professional is licensed to practice2 and 7,b7 the majority of the covered sports medicine professional's practice is underwritten for medical professional liability insurance coverage4 7#i7 ,secondary ,state ,the term secondary ,state means1 with respect to a covered sports medicine professional1 any ,state that is not the primary ,state4 7#aj7 ,state ,the term ,state means each of the several ,states1 the ,district of ,columbia1 and each commonwealth1
