,california from the ,bureau of ,reclamation to the ,bureau of ,land ,management1 and for other purposes4 #a4 ,short title2 table of contents 7a7 ,short title ,this ,act may be cited as the ,lake ,berryessa ,recreation ,enhancement ,act of #bjaf4 7b7 ,table of contents ,the table of contents for this ,act is as follows3 ,sec4 #a4 ,short title2 table of contents4 ,sec4 #b4 ,findings2 purposes4 ,sec4 #c4 ,definitions4 ,sec4 #d4 ,establishment of ,lake ,berryessa ,recreation ,area4 ,sec4 #e4 ,management of ,recreation ,area4 ,sec4 #f4 ,concessions permits and agreements4 ,sec4 #g4 ,continued authorities of ,commissioner of ,reclamation4 ,sec4 #h4 ,existing authorizations4 #b4 ,findings2 purposes 7a7 ,findings ,congress finds that-- 7#a7 the ,monticello ,dam-- 7,a7 was authorized by the ,reclamation ,project ,act of #aici 7#ec ,stat4 #aahg72 7,b7 resulted in the formation of ,lake ,berryessa2 and 7,c7 is operated by the ,bureau of ,reclamation2 7#b7 ,lake ,berryessa-- 7,a7 covers approximately #bh1iae acres of surface water and land2 7,b7 has #afe miles of shoreline2 7,c7 has a #b1jjj-;acre wildlife area on the east side2 7,d7 is located less than #ajj miles from both ,sacramento and ,san ,francisco1 ,california2 and 7,e7 has become an important regional recreation destination2 and 7#c7 the recreational use at ,lake ,berryessa generates tourism that is important to local economies4 7b7 ,purposes ,the purposes of this ,act are-- 7#a7 to provide diverse1 high-quality recreational facilities and services on ,lake ,berryessa and the surrounding lands2 7#b7 to conserve the natural1 scenic1 scientific1 historic1 and other resource values contributing to the public use and enjoyment of that land and water2 7#c7 to promote cooperation between the ,federal ,government and private entities to manage that exceptional resource2 and 7#d7 to establish the ,lake ,berryessa ,recreation ,area and transfer administrative jurisdiction over certain ,federal land for management as public lands by the ,bureau of ,land ,management as part of that area4 #c4 ,definitions ,in this ,act3 7#a7 ,dam ,the term ,dam means-- 7,a7 the ,monticello ,dam2 and 7,b7 any facility relating to the ,monticello ,dam4 7#b7 ,recreation area ,the term ,recreation ,area means the ,lake ,berryessa ,recreation ,area designated by section #d7;a74 7#c7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#d7 ,state ,the term ,state means the ,state of ,california4 #d4 ,establishment of ,lake ,berryessa ,recreation ,area 7a7 ,establishment ,subject to valid existing rights1 the approximately acres of land administered by the ,bureau of ,reclamation that is underlying or adjacent to ,lake ,berryessa and is identified as on the map dated 1 including any improvements thereon1 are hereby established as the ,lake ,berryessa ,recreation ,area4 7b7 ,transfer of administrative jurisdiction ,administrative jurisdiction over the ,recreation ,area is transferred from the ,bureau of ,reclamation to the ,bureau of ,land ,management4 7c7 ,transfer of ownership of personal property ,the ,bureau of ,reclamation may transfer to the ,bureau of ,land ,management1 without compensation1 administrative jurisdiction over items of personal property used in the administration of the ,recreation ,area4 #e4 ,management of ,recreation ,area 7a7 ,in general ,subject to valid existing rights1 the ,secretary shall manage and administer the ,recreation ,area in accordance with this ,act1 sections #fja through #fjd of ,public ,law #ic-dic1 and the laws 7including regulations7 applicable to land under the administrative jurisdiction of the ,bureau of ,land ,management4 7b7 ,comprehensive management plan 7#a7 ,in general ,the ,secretary shall develop a management plan for the administration and management of the ,recreation ,area4 7#b7 ,development of management plan ,for purposes of this ,act1 the ,secretary may use or adopt1 in whole or part-- 7,a7 the recreational use plan adopted by the ,bureau of ,reclamation on ,june #b1 #bjjf1 or may develop a new management plan2 and 7,b7 any concessions planning or environmental documents prepared by or for the ,bureau of ,reclamation for the ,recreation ,area4 7#c7 ,,nepa ,the decision to use or adopt1 in whole or part1 any document referenced in paragraph 7#b7 shall not constitute a major ,federal action for the purposes of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 ,this decision is not subject to judicial review4 7#d7 ,applicability ,nothing in this ,act requires an immediate revision or amendment to any plan for the ,recreation ,area4 7#e7 ,recreational safety and security ,subject to paragraph 7#e71 the ,secretary of the ,interior may establish guidelines and restrictions on recreational uses to ensure the safety and security of recreational users in ,recreational ,area4 7c7 ,funding ,for the purposes of managing and administering the ,recreation ,area during a transition period not to exceed five years after the date of enactment of this ,act1 the ,secretary may transfer funds from the ,bureau of ,reclamation to the ,bureau of ,land ,management-,management of ,lands and ,resources account1 to remain available until expended1 for the administration the ,recreation ,area4 7d7 ,recreational uses ,nothing in this ,act or the comprehensive management plan for the ,recreation ,area shall prohibit historical or existing authorized recreational uses1 including motorized use1 from occurring in the ,recreation ,area4 #f4 ,concessions permits and agreements 7a7 ,in ,general ,the ,secretary is authorized to issue recreation concession permits1 including at the ,recreation ,area1 to allow a third party to provide facilities and services to visitors on lands and waters managed by the ,bureau of ,land ,management in support of outdoor recreational opportunities in accordance with an applicable land use plan4 ,any such permit shall not constitute a contract for the procurement of goods and services for the benefit of the government or otherwise4 7b7 ,compensation to the government ,each permit issued under this section shall provide for monetary compensation1 including franchise fees1 to the ,federal ,government for the rights and privileges provided4 7c7 ,regulations ,the ,secretary shall promulgate regulations to facilitate the implementation of this section4 7d7 ,revenues ,revenues collected under this section shall be deposited into an account in the ,treasury1 and shall remain available until expended for managing and enhancing the public lands at the specific area where the revenues are collected4 7e7 ,existing ,agreements at ,lake ,berryessa ,recreation ,area 7#a7 ,continuation of agreements ,facilities and services provided in the ,recreation ,area under existing recreation concessions and recreation lease agreements with the ,bureau of ,reclamation1 including agreements for campgrounds and marinas1 may continue pursuant to the terms and conditions of each agreement4 7#b7 ,extension of agreements ,the ,secretary may extend an existing recreation concessions and recreation lease agreement at the ,recreation ,area after expiration for a period not to exceed #c years to allow continuation of services during the transition4 7#c7 ,reduction in ,federal costs ,to reduce ,federal costs in administering this subsection1 the issuance of new agreements or concession permits for activities within the ,recreation ,area that have been considered and permitted by the ,bureau of ,reclamation under previous analysis1 that are similar to existing uses1 or that are not inconsistent with approved uses and will not substantially increase the use of an area1 shall not constitute a major ,federal action for the purposes of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 #g4 ,continued authorities of ,commissioner of ,reclamation 7a7 ,in general ,the ,commissioner of ,reclamation shall continue to administer and operate-- 7#a7 the ,dam2 and 7#b7 any power facility relating to the ,dam4 7b7 ,effects ,nothing in this ,act or any subsequent management plan shall-- 7#a7 impair the ability of the ,bureau of ,reclamation and its managing partners to operate1 maintain1 or manage ,monticello ,dam1 ,lake ,berryessa1 and other ,solano ,project facilities in accordance with authorized purposes2 7#b7 affect the use or allocation1 in existence on the date of the enactment of this ,act1 of any water1 water right1 or interest in water2 7#c7 affect any vested absolute or decreed conditional water right in existence on the date of the enactment of this ,act1 including any water right held by the ,united ,states2 7#d7 affect any interstate water compact in existence on the date of the enactment of this ,act2 7#e7 authorize or impose any new reserved ,federal water rights2 7#f7 relinquish or reduce any water rights reserved or appropriated by the ,united ,states in the ,state on or before the date of the enactment of this ,act2 or 7#g7 modify1 change1 or supersede any water contract or agreements approved or administered by the ,bureau of ,reclamation or ,solano ,county ,water ,agency or ,solano ,irrigation ,district4 #h4 ,existing authorizations 7a7 ,in general ,except as otherwise provided in this ,act1 nothing in this ,act affects any authorization in effect as of the date of the enactment of this ,act made by any department or agency of the ,federal ,government for the use of land or water located in the ,recreation ,area 7referred to in this section as an existing authorization74 7b7 ,assumption of existing authorization ,not later than #a year after the date of the enactment of this ,act1 the ,secretary shall assume the administration of any existing authorization1 with such revisions as necessary to align the authorization with existing law and policies of the ,bureau of ,land ,management4 7c7 ,renewal of existing authorization ,the renewal of any existing authorization shall be made in accordance with such terms and conditions as the ,secretary may prescribe4
