,in general ,section #aijb7;a7 of the   
,social ,security ,act 7#db ,u4,s4,c4   
#acif;a7a77 is amended by inserting     
after paragraph 7#gg7 the following new 
paragraph3  7#gh7 provide that1 not     
later than #ahj days after the date of  
the enactment of this paragraph1 in the 
case of a ,state plan that provides     
medical assistance on a fee-for-service 
basis or through a primary care         
case-management system described in     
section #aiae7;b77#a7 7other than a     
primary care case management entity 7as 
defined by the ,secretary771 the ,state 
shall publish 7and update on at least an
 annual basis7 on the public ,website of
 the ,state agency administering the    
,state plan1 a directory of the         
providers 7including1 at a minimum1     
primary and specialty care physicians7  
described in subsection 7ll7 that       

includes--  7,a7 with respect to each   
such provider-- 7i7 the name of the     
provider2  7ii7 the specialty of the    
provider2  7iii7 the address of the     
provider2 and  7iv7 the telephone number
 of the provider2 and  7,b7 with respect
 to any such provider participating in  
such a primary care case-management     
system1 information regarding--  7i7    
whether the provider is accepting as new
 patients individuals who receive       
medical assistance under this title2 and
  7ii7 the provider's cultural and      
linguistic capabilities1 including the  
languages spoken by the provider or by  
the skilled medical interpreter         
providing interpretation services at the
 provider's office2  4  7b7 ,directory  
providers described ,section #aijb of   
the ,social ,security ,act 7#db         
,u4,s4,c4 #acif;a7 is amended by adding 
at the end the following new subsection3
  7ll7 ,directory providers described ,a
 provider described in this subsection  
is-- 7#a7 in the case of a provider of a

 provider type for which the ,state     
agency1 as a condition on receiving     
payment for items and services furnished
 by the provider to individuals eligible
 to receive medical assistance under the
 ,state plan1 requires the enrollment of
 the provider with the ,state agency1 a 
provider that--  7,a7 is enrolled with  
the agency as of the date on which the  
directory is published or updated 7as   
applicable7 under subsection 7a77#gh72  
and  7,b7 received payment under the    
,state plan in the #ab-month period     
preceding such date2 and  7#b7 in the   
case of a provider of a provider type   
for which the ,state agency does not    
require such enrollment1 a provider that
 received payment under the ,state plan 
in the #ab-month period preceding the   
date on which the directory is published
 or updated 7as applicable7 under       
subsection 7a77#gh74  4  7c7 ,rule of   
construction  7#a7 ,in general ,the     
amendment made by subsection 7a7 shall  
not be construed to apply in the case of

 a ,state in which all the individuals  
enrolled in the ,state plan under title 
,,xix of the ,social ,security ,act 7or 
under a waiver of such plan71 other than
 individuals described in paragraph     
7#b71 are enrolled with a medicaid      
managed care organization 7as defined in
 section #aijc7m77#a77;,a7 of such ,act 
7#db ,u4,s4,c4 #acif;b7m77#a77;,a7771   
including prepaid inpatient health plans
 and prepaid ambulatory health plans 7as
 defined by the ,secretary of ,health   
and ,human ,services74  7#b7            
,individuals described ,an individual   
described in this paragraph is an       
individual who is an ,indian 7as defined
 in section #d of the ,indian ,health   
,care ,improvement ,act 7#be ,u4,s4,c4  
#afjc77 or an ,alaska ,native4  7d7     
,exception for ,state legislation ,in   
the case of a ,state plan under title   
,,xix of the ,social ,security ,act 7#db
 ,u4,s4,c4 #acif et seq471 which the    
,secretary determines requires ,state   
legislation in order for the respective 

plan to meet one or more additional     
requirements imposed by amendments made 
by this section1 the respective plan    
shall not be regarded as failing to     
comply with the requirements of such    
title solely on the basis of its failure
 to meet such an additional requirement 
before the first day of the first       
calendar quarter beginning after the    
close of the first regular session of   
the ,state legislature that begins after
 the date of enactment of this section4 
,for purposes of the previous sentence1 
in the case of a ,state that has a      
#b-year legislative session1 each year  
of the session shall be considered to be
 a separate regular session of the      
,state legislature4  ,february #bc1
