the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acdd7 is deemed to have been approved by the ,secretary as a final oil and gas leasing program under that section1 and is deemed to be in full compliance with and in accordance with all requirements of the ,outer ,continental ,shelf ,lands ,act1 with the modifications to the ,program described in this section4 7b7 ,additional included areas 7#a7 ,in general ,the ,program includes the following additional areas3 7,a7 ,all areas in the ,chukchi ,sea4 7,b7 ,all areas in the ,beaufort ,sea4 7,c7 ,all areas in ,bristol ,bay4 7,d7 ,all areas in previously leased areas off the coast of ,virginia4 7,e7 ,all other outer ,continental ,shelf planning areas that-- 7i7 are estimated to contain more than #e1jjj1jjj1jjj barrels of oil2 and 7ii7 are estimated to contain more than #ej1jjj1jjj1jjj1jjj cubic feet of gas4 7#b7 ,determination of other areas ,to determine the planning areas described in paragraph 7#a71 the ,secretary shall use the document titled ,assessment of ,undiscovered ,technically ,recoverable ,oil and ,gas ,resources of the ,nation's ,outer ,continental ,shelf1 #bjaa produced by the ,bureau of ,ocean ,energy ,management4 7c7 ,presidential exclusion prohibited ,the ,president may not exclude from oil and gas leasing any area included in the final oil and gas leasing program deemed approved under this section4 7d7 ,final environmental impact statement ,the ,secretary is deemed to have issued a final environmental impact statement for the final oil and gas leasing program deemed approved under this section in accordance with all requirements under section #ajb7b77;,c7 of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dccb7b77;,c774 #ajb4 ,lease sales 7a7 ,outer ,continental ,shelf 7#a7 ,in general ,except as provided in paragraph 7#b71 not later than #cj days after the date of enactment of this ,act and every #bgj days thereafter1 the ,secretary of the ,interior 7referred to in this section as the ,secretary7 shall conduct a lease sale under the oil and gas leasing program approved under section #aja in each ,outer ,continental ,shelf planning area for which the ,secretary determines that there is a commercial interest in purchasing ,federal oil and gas leases for production on the outer ,continental ,shelf4 7#b7 ,subsequent determinations and sales ,if the ,secretary determines that there is not a commercial interest in purchasing ,federal oil and gas leases for production on the outer ,continental ,shelf in a planning area under this subsection1 not later than #b years after the date of enactment of the determination and every #b years thereafter1 the ,secretary shall-- 7,a7 determine whether there is a commercial interest in purchasing ,federal oil and gas leases for production on the outer ,continental ,shelf in the planning area2 and 7,b7 if the ,secretary determines that there is a commercial interest described in subparagraph 7,a71 conduct a lease sale in the planning area4 7b7 ,renewable energy and mariculture ,the ,secretary may conduct commercial lease sales of resources of the outer ,continental ,shelf 7as that term is defined in the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acca et seq477-- 7#a7 to produce renewable energy 7as defined in section #bjc7;b7 of the ,energy ,policy ,act of #bjje 7#db ,u4,s4,c4 #aeheb7;b7772 or 7#b7 to cultivate marine organisms in the natural habitat of the organisms4 #ajc4 ,seaward boundaries of ,states 7a7 ,seaward boundaries ,section #d of the ,submerged ,lands ,act 7#dc ,u4,s4,c4 #acab7 is amended by striking three geographical miles each place it appears and inserting #i nautical miles4 7b7 ,conforming amendments ,section #b of the ,submerged ,lands ,act 7#dc ,u4,s4,c4 #acja7 is amended-- 7#a7 in subsection 7a77#b71 by striking three geographical miles and inserting #i nautical miles2 and 7#b7 in subsection 7b7-- 7,a7 by striking three geographical miles and inserting #i nautical miles2 and 7,b7 by striking three marine leagues and inserting #i nautical miles4 7c7 ,effect of amendments 7#a7 ,in general ,subject to paragraphs 7#b7 through 7#d71 the amendments made by this section shall not affect ,federal oil and gas mineral rights and should not affect the ,states' current authority within existing ,state boundaries4 7#b7 ,existing leases ,the amendments made by this section shall not affect any ,federal oil and gas lease in effect on the date of enactment of this ,act4 7#c7 ,taxation 7,a7 ,in general ,a ,state may exercise all of the sovereign powers of taxation of the ,state within the entire extent of the seaward boundaries of the ,state 7as extended by the amendments made by this section74 7,b7 ,limitation ,nothing in this paragraph affects the authority of a ,state to tax any ,federal oil and gas lease in effect on the date of enactment of this ,act4 #ajd4 ,military operations ,the ,secretary shall consult with the ,secretary of ,defense regarding military operations needs in the ,outer ,continental ,shelf4 ,the ,secretary shall work with the ,secretary of ,defense to resolve any conflicts that might arise between such operations and leasing under this section4 ,if the ,secretaries are unable to resolve all such conflicts1 any unresolved issues shall be referred by the ,secretaries to the ,president in a timely fashion for immediate resolution4 #aje4 ,coordination with ,adjacent ,states ,section #ai of the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acde7 is amended-- 7#a7 in subsection 7a7 in the first sentence by inserting 1 for any tract located within the ,adjacent ,state's ,adjacent ,zone1 after government2 and 7#b7 by adding the following3 7f7 7#a7 ,prior to issuing a permit or approval for the construction of a pipeline to transport crude oil1 natural gas or associated liquids production withdrawn from oil and gas leases on the outer ,continental ,shelf1 a ,federal agency must seek the concurrence of the ,adjacent ,state if the pipeline is to transit the ,adjacent ,state's ,adjacent ,zone between the outer ,continental ,shelf and landfall4 ,no ,state may prohibit construction of such a pipeline within its ,adjacent ,zone or its ,state waters4 ,however1 an ,adjacent ,state may require routing of such a pipeline to one of two alternate landfall locations in the ,adjacent ,state1 designated by the ,adjacent ,state1 located within #fj miles on either side of a proposed landfall location4 7#b7 ,in this subsection3 7,a7 ,the term ,adjacent ,state means1 with respect to any program1 plan1 lease sale1 leased tract or other activity1 proposed1 conducted1 or approved pursuant to the provisions of this ,act1 any ,state the laws of which are declared1 pursuant to section #d7;a77#b71 to be the law of the ,united ,states for the portion of the outer ,continental ,shelf on which such program1 plan1 lease sale1 leased tract1 or activity appertains or is1 or is proposed to be1 conducted4 ,for purposes of this subparagraph1 the term ,state includes the ,commonwealth of ,puerto ,rico1 the ,commonwealth of the ,northern ,mariana ,islands1 the ,virgin ,islands1 ,american ,samoa1 ,guam1 and the other territories of the ,united ,states4 7,b7 ,the term ,adjacent ,zone means1 with respect to any program1 plan1 lease sale1 leased tract1 or other activity1 proposed1 conducted1 or approved pursuant to the provisions of this ,act1 the portion of the outer ,continental ,shelf for which the laws of a particular ,adjacent ,state are declared1 pursuant to section #d7;a77#b71 to be the law of the ,united ,states4 4 #ajf4 ,gulf of ,mexico oil and gas 7a7 ,repeal ,section #ajd of division ,c of the ,tax ,relief and ,health ,care ,act of #bjjf 7,public ,law #aji-dcb2 #abj ,stat4 #cjjc7 is repealed4 7b7 ,leasing plan for the ,eastern ,gulf of ,mexico ,pursuant to sections #aja and #ajb of this ,act1 the ,secretary of the ,interior shall issue a final leasing plan for the ,eastern ,gulf of ,mexico within #ahj days after the date of enactment of this ,act for all areas where there exists commercial interest in purchasing ,federal oil and gas leases for production4 #ajg4 ,sharing of revenues 7a7 ,in general ,section #h7;g7 of the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #accg7;g77 is amended-- 7#a7 in paragraph 7#b7 by striking ,notwithstanding and inserting ,except as provided in paragraph 7#f71 and notwithstanding2 7#b7 by redesignating paragraphs 7#f7 and 7#g7 as paragraphs 7#h7 and 7#i72 and 7#c7 by inserting after paragraph 7#e7 the following3 7#f7 ,bonus bids and royalties under qualified leases 7,a7 ,new leases ,of amounts received by the ,united ,states as bonus bids1 royalties1 rentals1 and other sums collected under any new qualified lease on submerged lands made available for leasing under this ,act by the enactment of the ,infrastructure ,jobs and ,energy ,independence ,act-- 7i7 #cj percent shall be paid to the ,states that are producing ,states with respect to those submerged lands that are located within the seaward boundaries of such a ,state established under section #d7;a77#b77;,a72 7ii7 #aj percent shall be deposited in the general fund of the ,treasury used solely for paying off the national debt2 and 7iii7 #fj percent shall be deposited in the ,infrastructure ,renewal ,reserve established by paragraph 7#g74 7,b7 ,leased tract that lies partially within the seaward boundaries of a state ,in the case of a leased tract that lies partially within the seaward boundaries of a ,state1 the amounts of bonus bids and royalties from such tract that are subject to subparagraph 7,a77ii7 with respect to such ,state shall be a percentage of the total amounts of bonus bids and royalties from such tract that is equivalent to the total percentage of surface acreage of the tract that lies within such seaward boundaries4 7,c7 ,use of payments to states ,amounts paid to a ,state under subparagraph 7,a77ii7 shall be used by the ,state for one or more of the following3 7i7 ,education4 7ii7 ,transportation4 7iii7 ,coastal restoration1 environmental restoration1 and beach replenishment4 7iv7 ,energy infrastructure4 7v7 ,renewable energy development4 7vi7 ,energy efficiency and conservation4 7vii7 ,any other purpose determined by ,state law4 7,d7 ,definitions ,in this paragraph3 7i7 ,adjacent state ,the term ,adjacent ,state means1 with respect to any program1 plan1 lease sale1 leased tract or other activity1 proposed1 conducted1 or approved pursuant to the provisions of this ,act1 any ,state the laws of which are declared1 pursuant to section #d7;a77#b71 to be the law of the ,united ,states for the portion of the outer ,continental ,shelf on which such program1 plan1 lease sale1 leased tract1 or activity appertains or is1 or is proposed to be1 conducted4 7ii7 ,adjacent zone ,the term ,adjacent ,zone means1 with respect to any program1 plan1 lease sale1 leased tract1 or other activity1 proposed1 conducted1 or approved pursuant to the provisions of this ,act1 the portion of the outer ,continental ,shelf for which the laws of a particular ,adjacent ,state are declared1 pursuant to section #d7;a77#b71 to be the law of the ,united ,states4 7iii7 ,producing state ,the term producing ,state means an ,adjacent ,state having an ,adjacent ,zone containing leased tracts from which are derived bonus bids and royalties under a lease under this ,act4 7iv7 ,state ,the term ,state includes ,puerto ,rico and the other territories of the ,united ,states4 7v7 ,qualified lease ,the term qualified lease means a natural gas or oil lease made available under this ,act granted after the date of the enactment of the ,infrastructure ,jobs and ,energy ,independence ,act1 for an area that is available for leasing as a result of enactment of section #aja of that ,act4 7,e7 ,application ,this paragraph shall apply to bonus bids and royalties received by the ,united ,states under qualified leases after implementation of sections #aje and #ajf of the ,infrastructure ,jobs and ,energy ,independence ,act4 7,f7 ,existing revenues ,all revenues including revenues1 including bonus bids1 royalties1 rentals1 and other sums1 collected from leases issued under this ,act prior to the enactment ,infrastructure ,jobs and ,energy ,independence ,act1 shall not be affected by the provisions of that ,act4 7#g7 ,establishment of reserve accounts 7,a7 ,in general ,for budgetary purposes1 there is established as a separate account to receive deposits under paragraph 7#f77;,a7-- 7i7 the ,infrastructure ,renewal ,reserve1 which shall be applied to offset the costs of-- 7,i7 ,federal-aid highway and highway safety construction programs carried out by the ,secretary of ,transportation2 7,,ii7 public transportation programs carried out by the ,secretary of ,transportation2 7,,iii7 water resources development construction projects carried out by the ,secretary of the ,army 7acting through the ,chief of ,engineers72 and 7,,iv7 legislation enacted after the date of the enactment of the ,infrastructure ,jobs and ,energy ,independence ,act for purposes of investment in transportation infrastructure2 and 7ii7 the ,clean ,water ,reserve1 which shall be applied to offset the costs of programs under the ,federal ,water ,pollution ,control ,act1 the ,safe ,drinking ,water ,act1 and the ,safe ,drinking ,water ,act ,amendments of #aiif that provide assistance1 such as grants1 matching grants1 and no- and low-interest loans1 to ,states and municipalities1 including construction programs to rebuild and modernize clean water and sewage infrastructure4 7,b7 ,deposit of balance from ,,spr ,petroleum ,account ,in addition to deposits under paragraph 7#f77;,a71 the ,secretary shall transfer to the ,infrastructure ,renewal ,reserve the balance of funds in the ,,spr ,petroleum ,account on the date of enactment of this ,act in excess of #aj1jjj1jjj4 7,c7 ,procedure for adjustments 7i7 ,budget committee chairman ,after the reporting of a bill or joint resolution1 or the offering of an amendment thereto or the submission of a conference report thereon1 providing funding for the purposes set forth in clause 7i7 or 7ii7 of subparagraph 7,a7 in excess of the sum of amount of the deposits under paragraph 7#f77;,a7 for those purposes for fiscal year #bjaf and funds deposited under subparagraph 7,b7 of this paragraph1 the chairman of the ,committee on the ,budget of the applicable ,house of ,congress shall make the adjustments set forth in clause 7ii7 for the amount of new budget authority and outlays in that measure and the outlays flowing from that budget authority4 7ii7 ,matters to be adjusted ,the adjustments referred to in clause 7i7 are to be made to-- 7,i7 the discretionary spending limits1 if any1 set forth in the appropriate concurrent resolution on the budget2 7,,ii7 the allocations made pursuant to the appropriate concurrent resolution on the budget pursuant to section #cjb7;a7 of the ,congressional ,budget ,act of #aigd2 and 7,,iii7 the budget aggregates contained in the appropriate concurrent resolution on the budget as required by section #cja7;a7 of the ,congressional ,budget ,act of #aigd4 7iii7 ,amounts of adjustments ,the adjustments referred to in clauses 7i7 and 7ii7 shall not exceed the receipts estimated by the ,congressional ,budget ,office that are attributable to this ,act for the fiscal year in which the adjustments are made4 7#h7 ,maintenance of effort by ,states ,the ,secretary of the ,interior1 the ,secretary of ,health and ,human ,services1 the ,secretary of ,energy1 and any other ,federal official with authority to implement legislation referred to in paragraph 7#f77;,a7 shall ensure that financial assistance provided to a ,state under that legislation for any purpose with amounts made available under this subsection or in any legislation with respect to which paragraph 7#g7 applies supplement1 and do not replace1 the amounts expended by the ,state for that purpose before the date of the enactment of the ,infrastructure ,jobs and ,energy ,independence ,act4 7#i7 ,distributions for ,federal-aid highway or highway safety construction program ,to the extent practicable1 amounts made available for a ,federal-aid highway or highway safety construction program1 the costs of which are offset by application of the ,infrastructure ,renewal ,reserve1 shall be distributed using the apportionment formula that applies to that program4 4 7b7 ,establishment of ,state ,seaward ,boundaries ,section #d7;a77#b77;,a7 of the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #accc7;a77#b77;,a77 is amended in the first sentence by striking 1 and the ,president and all that follows through the end of the sentence and inserting the following3 4 ,such extended lines are deemed to be as indicated on the maps for each ,outer ,continental ,shelf region entitled ,alaska ,,ocs ,region ,state ,adjacent ,zone and ,,ocs ,planning ,areas1 ,pacific ,,ocs ,region ,state ,adjacent ,zones and ,,ocs ,planning ,areas1 ,gulf of ,mexico ,,ocs ,region ,state ,adjacent ,zones and ,,ocs ,planning ,areas1 and ,atlantic ,,ocs ,region ,state ,adjacent ,zones and ,,ocs ,planning ,areas1 all of which are dated ,september #bjje and on file in the ,office of the ,director1 ,minerals ,management ,service4 ,the preceding sentence shall not apply with respect to the treatment under section #aje of the ,gulf of ,mexico ,energy ,security ,act of #bjjf 7title ,i of division ,c of ,public ,law #aji-dcb7 of qualified outer ,continental ,shelf revenues deposited and disbursed under subsection 7a77#b7 of that section44 #ajh4 ,inventory of offshore energy resources 7a7 ,in general ,the ,secretary of the ,interior 7in this section referred to as the ,secretary7 shall promptly prepare an inventory of offshore energy resources of the ,united ,states1 including through conduct of geological and geophysical explorations by private industry in all of the ,united ,states outer ,continental ,shelf areas of the ,atlantic ,ocean and the ,pacific ,ocean under part #bea of title #cj1 ,code of ,federal ,regulations 7or successor regulations74 7b7 ,environmental studies ,not later than #ahj days after the date of enactment of this ,act1 the ,secretary shall complete any environmental studies necessary to gather information essential to an accurate inventory1 including geological and geophysical explorations under part #bea of title #cj1 ,code of ,federal ,regulations 7or successor regulations74 7c7 ,effect on oil and gas leasing ,no inventory that is conducted under this section or any other ,federal law 7including regulations7 shall restrict1 limit1 delay1 or otherwise adversely affect-- 7#a7 the development of any ,outer ,continental ,shelf leasing program under section #ah of the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acdd72 or 7#b7 any leasing1 exploration1 development1 or production of any ,federal offshore oil and gas leases4 7d7 ,funding 7#a7 ,in general ,the ,secretary of the ,treasury shall make a one-time transfer to the ,secretary1 without further appropriation and from royalties collected by the ,united ,states in conjunction with the production of oil and gas1 of such sums as are necessary for the ,secretary to carry out this section4 7#b7 ,limitation ,the amount transferred under paragraph 7#a7 shall not exceed #ej1jjj1jjj4 #aji4 ,prohibitions on surface occupancy and other appropriate environmental safeguards 7a7 ,regulations 7#a7 ,in general 7,a7 ,environmental safeguards ,the ,secretary of the ,interior shall promulgate regulations that establish appropriate environmental safeguards for the exploration and production of oil and natural gas on the outer ,continental ,shelf4 7,b7 ,safety protocols ,all operations1 including under any permit issued pursuant to an application for a permit to drill or an application for a permit to sidetrack1 that has been approved by the ,minerals ,management ,service or the ,bureau of ,ocean ,energy ,management1 ,regulation and ,enforcement1 for purposes of outer ,continental ,shelf energy exploration or development and production1 shall be carried out in accordance with the safety protocols contained in part #bej of title #cj1 ,code of ,federal ,regulations4 7#b7 ,requirements ,the regulations shall include provisions ensuring that-- 7,a7 no surface facility shall be installed for the purpose of production of oil or gas resources in any area that is within #aj miles from the shore of any coastal ,state1 in any area of the ,outer ,continental ,shelf that has not previously been made available for oil and gas leasing2 7,b7 only temporary surface facilities are installed for areas that are located-- 7i7 beyond #aj miles from the shore of any coastal ,state1 in any area of the ,outer ,continental ,shelf that has not previously been made available for oil and gas leasing2 and 7ii7 not more than #bj miles from the shore2 7,c7 the impact of offshore production facilities on coastal vistas is otherwise mitigated2 and 7,d7 onshore facilities that are able to draw upon the resources of the outer ,continental ,shelf within #aj miles of shore are allowed4 7b7 ,conforming amendment ,section #aje of the ,department of the ,interior1 ,environment1 and ,related ,agencies ,appropriations ,act1 #bjjf 7,public ,law #aji-ed2 #aai ,stat4 #eba7 7as amended by section #ajc7;d7 of the ,gulf of ,mexico ,energy ,security ,act of #bjjf 7#dc ,u4,s4,c4 #acca note2 ,public ,law #aji-dcb77 is amended by inserting and any other area that the ,secretary of the ,interior may offer for leasing1 preleasing1 or any related activity under section #ajd of that ,act after #bjjf74 ,b ,expedited ,judicial ,review #aba4 ,definitions ,in this subtitle3 7#a7 ,authorizing leasing statute ,the term authorizing leasing statute means the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acca et seq471 the ,mineral ,leasing ,act 7#cj ,u4,s4,c4 #aha et seq471 the ,mineral ,leasing ,act for ,acquired ,lands 7#cj ,u4,s4,c4 #cea et seq471 and any other law of the ,united ,states directing or authorizing the leasing of ,federal lands for oil and gas production or transmission4 7#b7 ,covered oil and natural gas activity ,the term covered oil and natural gas activity means-- 7,a7 the leasing of any lands pursuant to an authorizing leasing statute for the exploration1 development1 production1 processing1 or transmission of oil1 natural gas1 or associated hydrocarbons1 including actions or decisions relating to the selection of which lands may or shall be made available for such leasing2 and 7,b7 any activity taken or proposed to be taken pursuant or in relation to such leases1 including their suspension1 and any environmental analyses relating to such activity4 #abb4 ,exclusive jurisdiction over causes and claims relating to covered oil and natural gas activities ,notwithstanding any other provision of law1 any ,federal action approving any covered oil and natural gas activity shall be subject to judicial review only-- 7#a7 in the ,united ,states ,court of ,appeals for the ,district of ,columbia ,circuit2 and 7#b7 after the person filing a petition seeking such judicial review has exhausted all available administrative remedies with respect to such ,federal action4 #abc4 ,time for filing petition2 standing 7a7 ,in general ,all petitions referred to in section #abb must be filed within #cj days after the latter of the challenged ,federal action or the exhaustion of all available administrative remedies with respect to such ,federal action4 ,a claim or challenge shall be barred unless it is filed within the time specified4 7b7 ,standing ,no person whose legal rights will not be directly and adversely affected by the challenged action1 and who is not within the zone of interest protected by each ,act under which the challenge is brought1 shall have standing to file any petition referred to in section #abb4 #abd4 ,timetable ,the ,united ,states ,court of ,appeals for the ,district of ,columbia ,circuit shall complete all judicial review1 including rendering a judgment1 before the end of the #abj-;day period beginning on the date on which a petition referred to in ,it is the intent of the ,congress that this ,act1 among other things1 result in a healthy and growing ,american industrial1 manufacturing1 transportation1 and service sector employing the vast talents of ,america's workforce to assist in the development of energy from domestic sources4 ,moreover1 the ,congress intends to monitor the deployment of personnel and material onshore and offshore to encourage the development of ,american technology and manufacturing to enable ,united ,states workers to benefit from this ,act by good jobs and careers1 as well as the establishment of important industrial facilities to support expanded access to ,american resources4 7b7 ,safeguard for extraordinary ability ,section #cj7;a7 of the ,outer ,continental ,shelf ,lands ,act 7#dc ,u4,s4,c4 #acef7;a77 is amended in the matter preceding paragraph 7#a7 by striking regulations which and inserting regulations that shall be supplemental and complimentary with and under no circumstances a substitution for the provisions of the ,constitution and laws of the ,united ,states extended to the subsoil and seabed of the outer ,continental ,shelf pursuant to section #d of this ,act1 except insofar as such laws would otherwise apply to individuals who have extraordinary ability in the sciences1 arts1 education1 or business1 which has been demonstrated by sustained national or international acclaim1 and that4 7c7 ,work standards ,all construction1 repair1 or alteration of public buildings and public works of the ,government and buildings or works financed or otherwise assisted in whole or in part under this ,act by a loan1 loan guarantee1 grant1 annual contribution1 credit enhancement1 or any other form of ,federal assistance authorized under this ,act shall be performed in accordance with the standards applicable to comparable activity under any other provision of law1 without regard to the form or type of ,federal assistance provided thereunder4 ,,ii ,modifying the ,strategic ,petroleum ,reserve and ,funding ,conservation and ,energy ,research and ,development #bja4 ,findings ,congress finds the following3 7#a7 ,the ,strategic ,petroleum ,reserve 7,,spr7 was created by ,congress in #aige1 to protect the ,nation from any future oil supply disruptions4 ,when the program was established1 ,united ,states refiners were capable of handling light crude and medium crude and the makeup of the ,,spr matched this capacity4 ,this is not the case today4 7#b7 ,a ,,gao analysis found that nearly half of the refineries considered vulnerable to supply disruptions are not compatible with the types of oil currently stored in the ,,spr and would be unable to maintain normal refining capacity if forced to rely on ,,spr oil as currently constituted1 thereby reducing the effectiveness of the ,,spr in the event of a supply disruption4 ,,gao concluded that the ,,spr should be comprised of at least #aj percent heavy crude4 7#c7 ,this ,act implements the ,,gao recommendation and dedicates funds received from the transactions to existing energy conservation1 research1 and assistance programs4 #bjb4 ,definitions ,in this title-- 7#a7 the term light grade petroleum means crude oil with an ,,api gravity of #ce degrees or higher2 7#b7 the term heavy grade petroleum means crude oil with an ,,api gravity of #bf degrees or lower2 and 7#c7 the term ,secretary means the ,secretary of ,energy4 #bjc4 ,objectives ,the objectives of this title are as follows3 7#a7 ,to modernize the composition of the ,strategic ,petroleum ,reserve to reflect the current processing capabilities of refineries in the ,united ,states4 7#b7 ,to provide increased funding to accelerate conservation1 energy research and development1 and assistance through existing programs4 #bjd4 ,modification of the ,strategic ,petroleum ,reserve ,notwithstanding section #afa of the ,energy ,policy and ,conservation ,act 7#db ,u4,s4,c4 #fbda71 the ,secretary shall publish a plan not later than #cj days after the date of enactment of this ,act to-- 7#a7 exchange as soon as possible light grade petroleum from the ,strategic ,petroleum ,reserve1 in an amount equal to #aj percent of the total number of barrels of crude oil in the ,reserve as of the date of enactment of this ,act1 for an equivalent volume of heavy grade petroleum plus any additional cash bonus bids received that reflect the difference in the market value between light grade petroleum and heavy grade petroleum and the timing of deliveries of the heavy grade petroleum2 7#b7 from the gross proceeds of the cash bonus bids1 deposit the amount necessary to pay for the direct administrative and operational costs of the exchange into the ,,spr ,petroleum ,account established under section #afg of the ,energy ,policy and ,conservation ,act 7#db ,u4,s4,c4 #fbdg72 and 7#c7 deposit #ij percent of the remaining net proceeds from the exchange into the ,infrastructure ,renewal ,reserve established in section #ajg4 ,,iii ,arctic ,national ,wildlife ,refuge #cja4 ,repeal of prohibition of leasing of ,arctic ,national ,wildlife ,refuge 7a7 ,repeal ,section #ajjc of the ,alaska ,national ,interest ,lands ,conservation ,act 7#af ,u4,s4,c4 #cadc7 is repealed4 7b7 ,conforming amendment ,the table of contents contained in section #a of that ,act 7#af ,u4,s4,c4 #caja note7 is amended by striking the item relating to section #ajjc4
