cosmetics containing plastic microbeads 
7a7 ,in general ,section #cja of the    
,federal ,food1 ,drug1 and ,cosmetic    
,act 7#ba ,u4,s4,c4 #cca7 is amended by 
adding at the end the following3  7ddd7 
7#a7 ,the manufacture or the            
introduction or delivery for            
introduction into interstate commerce of
 a rinse-off cosmetic that contains     

intentionally-added plastic microbeads4 
7#b7 ,in this paragraph--  7,a7 the term
 plastic microbead means any solid      
plastic particle that is less than five 
millimeters in size and is intended to  
be used to exfoliate or cleanse the     
human body or any part thereof2 and     
7,b7 the term rinse-off cosmetic        
includes toothpaste4  4  7b7            
,applicability  7#a7 ,in general ,the   
amendment made by subsection 7a7        
applies-- 7,a7 with respect to          
manufacturing1 beginning on ,july #a1   
#bjag1 and with respect to introduction 
or delivery for introduction into       
interstate commerce1 beginning on ,july 
#a1 #bjah2 and  7,b7 notwithstanding    
subparagraph 7,a71 in the case of a     
rinse-off cosmetic that is a            
nonprescription drug1 with respect to   
manufacturing1 beginning on ,july #a1   
#bjah1 and with respect to the          
introduction or delivery for            
introduction into interstate commerce1  
beginning on ,july #a1 #bjai4  7#b7     

,nonprescription drug ,for purposes of  
this subsection1 the term               
nonprescription drug means a drug not   
subject to section #ejc7;b77#a7 of the  
,federal ,food1 ,drug1 and ,cosmetic    
,act 7#ba ,u4,s4,c4 #cec7;b77#a774  7c7 
,preemption of ,state laws ,no ,state or
 political subdivision of a ,state may  
directly or indirectly establish under  
any authority or continue in effect     
restrictions with respect to the        
manufacture or introduction or delivery 
for introduction into interstate        
commerce of rinse-off cosmetics         
containing plastic microbeads 7as       
defined in section #cja7;ddd7 of the    
,federal ,food1 ,drug1 and ,cosmetic    
,act1 as added by subsection 7a77 that  
are not identical to the restrictions   
under such section #cja7;ddd7 that have 
begun to apply under subsection 7b74    
7d7 ,rule of construction ,nothing in   
this ,act 7or the amendments made by    
this ,act7 shall be construed to apply  
with respect to drugs that are not also 

cosmetics 7as such terms are defined in 
section #bja of the ,federal ,food1     
,drug1 and ,cosmetic ,act 7#ba ,u4,s4,c4
