,act to clarify the ,food and ,drug     
,administration's jurisdiction over     
certain tobacco products1 and to protect
 jobs and small businesses involved in  
the sale1 manufacturing and distribution
 of traditional and premium cigars4  #a4
 ,short title ,this ,act may be cited as
 the ,traditional ,cigar ,manufacturing 
and ,small ,business ,jobs ,preservation
 ,act of #bjac4  #b4 ,limitation of     
authority with respect to premium cigars
  7a7 ,exception for traditional large  
and premium cigars ,section #ija7;c7 of 
the ,federal ,food1 ,drug1 and ,cosmetic

 ,act 7#ba ,u4,s4,c4 #chg;a7c77 is      
amended--  7#a7 in paragraph 7#b71 in   
the heading1 by inserting for certain   
tobacco leaf after authority2 and  7#b7 
by adding at the end the following3     
7#c7 ,limitation of authority for       
certain cigars  7,a7 ,in general ,the   
provisions of this chapter 7except for  
section #ijg7;d77#c77 shall not apply to
 traditional large and premium cigars4  
7,b7 ,rule of construction ,nothing in  
this chapter shall be construed to grant
 the ,secretary authority to promulgate 
regulations on any matter that involves 
traditional large and premium cigars4   
7,c7 ,traditional large and premium     
cigar defined ,for purposes of this     
paragraph1 the term traditional large   
and premium cigar--  7i7 means any roll 
of tobacco that is wrapped in #ajj      
percent leaf tobacco1 bunched with #ajj 
percent tobacco filler1 contains no     
filter1 tip or non-tobacco mouthpiece1  
weighs at least #f pounds per #a1jjj    
count1 and--  7,i7 has a #ajj percent   

leaf tobacco binder and is hand rolled2 
7,,ii7 has a #ajj percent leaf tobacco  
binder and is made using human hands to 
lay the leaf tobacco wrapper or binder  
onto only one machine that bunches1     
wraps1 and caps each individual cigar2  
or  7,,iii7 has a homogenized tobacco   
leaf binder and is made in the ,united  
,states using human hands to lay the    
#ajj percent leaf tobacco wrapper onto  
only one machine that bunches1 wraps1   
and caps each individual cigar2 and     
7ii7 does not include a cigarette 7as   
such term is defined by section #ijj7c77
 or a little cigar 7as such term is     
defined by section #ijj7aa774  4  7b7   
,conforming amendments ,section #iai7;b7
 of the ,federal ,food1 ,drug1 and      
,cosmetic ,act 7#ba ,u4,s4,c4 #chgs7b77 
is amended--  7#a7 in paragraph
