purposes4 #a4 ,short title ,this ,act may be cited as the ,mni ,wiconi ,project ,act ,amendments of #bjac4 #b4 ,other agency assistance ,the ,mni ,wiconi ,project ,act of #aihh 7,public ,law #ajj-eaf2 #ajb ,stat4 #beff2 #ajh ,stat4 #dedc7 is amended by inserting after section #c;,b the following3 #c;,c4 ,plans for ,completing the ,oglala ,sioux ,rural ,water ,supply ,system1 ,rosebud ,sioux ,rural ,water ,system1 and ,lower ,brule ,sioux ,rural ,water ,system 7a7 ,plans for completion 7#a7 ,in general ,in consultation with the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 and the ,lower ,brule ,sioux ,tribe1 as applicable1 and the ,federal agency heads listed in subsection 7b77#a71 the ,secretary shall develop plans to complete the ,oglala ,sioux ,rural ,water ,supply ,system1 the ,rosebud ,sioux ,rural ,water ,system1 and the ,lower ,brule ,sioux ,rural ,water ,system4 7#b7 ,contents ,the plan for each water supply system described in paragraph 7#a7 shall require-- 7,a7 the completion of remaining components of the applicable system in accordance with the ,final ,engineering ,report dated ,may #aiic2 7,b7 the improvement1 repair1 and replacement of existing water systems2 and 7,c7 the transfer of those existing water systems to the ,united ,states1 to be held in trust for the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 or the ,lower ,brule ,sioux ,tribe1 as applicable1 and made part of the applicable rural water system4 7#c7 ,submission to ,congress ,not later than #b years after the date of enactment of this section1 the ,secretary shall submit to the ,committee on ,energy and ,natural ,resources of the ,senate and the ,committee on ,natural ,resources of the ,house of ,representatives-- 7,a7 a copy of each plan developed under this subsection1 including a schedule for full implementation of the plan that shall not exceed a period of #ae years after the date of enactment of this section2 7,b7 a report that includes-- 7i7 a description of the roles and responsibilities of each of the heads of the ,federal agencies listed in subsection 7b77#a7 7including the ,commissioner of the ,bureau of ,reclamation7 relating to the completion of the water supply systems1 including with respect to the improvement1 repair1 and replacement of the existing water systems before and after transfer2 7ii7 the program authorities of each ,federal agency listed in subsection 7b77#a7 and a description of how the heads of the ,federal agencies will work together to complete and implement the plans2 and 7iii7 the amount of funding and any other need the ,secretary determines to be necessary to complete and implement the plans2 and 7,c7 as applicable1 a description of the roles and responsibilities of the heads of other ,federal agencies that have existing authorities to provide assistance to the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 or the ,lower ,brule ,sioux ,tribe4 7b7 ,interagency agreements 7#a7 ,in general ,notwithstanding any other provision of law1 the ,secretary shall enter into agreements with the ,administrator of the ,environmental ,protection ,agency1 the ,secretary of ,agriculture1 the ,secretary of ,health and ,human ,services1 and the ,secretary of ,housing and ,urban ,development-- 7,a7 to fulfill the trust responsibility of the ,united ,states2 and 7,b7 to complete the ,oglala ,sioux ,rural ,water ,supply ,system1 the ,rosebud ,sioux ,rural ,water ,system1 and the ,lower ,brule ,sioux ,rural ,water ,system in accordance with the ,final ,engineering ,report dated ,may #aiic1 including the transfer of existing water systems1 as set forth in the plans for completion developed under subsection 7a74 7#b7 ,cooperation 7,a7 ,in general ,the heads of the ,federal agencies described in paragraph 7#a7 shall assist the ,secretary in completing the ,oglala ,sioux ,rural ,water ,supply ,system1 the ,rosebud ,sioux ,rural ,water ,system1 and the ,lower ,brule ,sioux ,rural ,water ,system pursuant to sections #c7;a71 #c;,a7a71 and #c;,b7a71 respectively1 including by-- 7i7 improving1 repairing1 and replacing existing water systems as set forth in the plans developed under subsection 7a72 and 7ii7 constructing new rural water facilities1 service lines1 and other necessary features4 7,b7 ,administrator of the ,environmental ,protection ,agency ,the ,administrator of the ,environmental ,protection ,agency shall assist the ,secretary in meeting the environmental and safe drinking water needs of the ,pine ,ridge ,indian ,reservation1 the ,rosebud ,indian ,reservation1 and the ,lower ,brule ,indian ,reservation1 including through compliance with the ,safe ,drinking ,water ,act 7#db ,u4,s4,c4 #cjj;f et seq474 7,c7 ,secretary of ,health and ,human ,services ,the ,secretary of ,health and ,human ,services shall assist the ,secretary in meeting the water supply and public health needs of the ,pine ,ridge ,indian ,reservation1 the ,rosebud ,indian ,reservation1 and the ,lower ,brule ,indian ,reservation1 including through compliance with the ,act of ,august #e1 #aied 7commonly known as the ,indian ,sanitation ,facilities ,act7 7#db ,u4,s4,c4 #bjja et seq474 7,d7 ,secretary of ,housing and ,urban ,development ,the ,secretary of ,housing and ,urban ,development shall assist the ,secretary by carrying out projects to connect houses that are eligible for funding from the ,department of ,housing and ,urban ,development on the reservations of the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 and the ,lower ,brule ,sioux ,tribe1 through plumbing1 water pipes1 appurtenances1 and interconnections to the ,oglala ,sioux ,rural ,water ,supply ,system1 the ,rosebud ,sioux ,rural ,water ,system1 and the ,lower ,brule ,sioux ,rural ,water ,system1 respectively1 to meet the water conservation standards of those water supply systems4 7#c7 ,livestock distribution systems 7,a7 ,in general ,the ,secretary and the ,secretary of ,agriculture shall1 through the use of authorities of the ,bureau of ,indian ,affairs and the ,department of ,agriculture1 respectively1 complete1 during a period not to exceed #ae years after the date of enactment of this section1 the livestock distribution system for the ,oglala ,sioux ,rural ,water ,supply ,system and the ,rosebud ,sioux ,rural ,water ,system1 consistent with the ,final ,engineering ,report dated ,may #aiic4 7,b7 ,administration ,for each water supply system described in subparagraph 7,a71 the ,secretary shall enter into agreements with the ,secretary of ,agriculture and the ,director of the ,bureau of ,indian ,affairs that set forth the specific responsibilities of each agency concerning the construction of the livestock distribution systems4 7#d7 ,lead agency ,the ,department of the ,interior1 acting through the ,bureau of ,reclamation1 shall act as the lead agency in carrying out this section4 7#e7 ,administration 7,a7 ,in general ,each agency head shall carry out the duties of the agency head under this subsection out of amounts made available to the agency head under annual appropriations and existing authorities4 7,b7 ,authorization of use of other ,federal agency funds ,amounts made available to agencies other than the ,bureau of ,reclamation may also be used to carry out this ,act4 7,c7 ,additional funding requests ,nothing in this subsection prohibits the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 or the ,lower ,brule ,sioux ,tribe from applying for1 seeking1 or obtaining amounts from the ,federal agencies referred to in paragraph 7#a7 for any other purpose4 7c7 ,upgrading standards for connecting homes ,the ,director of the ,bureau of ,indian ,affairs shall1 through the use of existing programs and annual appropriations1 assist the ,secretary in completing the ,oglala ,sioux ,rural ,water ,supply ,system1 the ,rosebud ,sioux ,rural ,water ,system1 and the ,lower ,brule ,sioux ,rural ,water ,system by constructing1 repairing1 and upgrading plumbing fixtures1 skirting1 and other necessary features1 such as septic tanks and drainfields1 to ensure that houses within the service areas are able to meet the standards for connecting to those water systems4 4 #c4 ,authorization of appropriations 7a7 ,planning1 design1 and construction ,section #aj7;a7 of the ,mni ,wiconi ,project ,act of #aihh 7,public ,law #ajj-eaf2 #ajb ,stat4 #bega2 #ajh ,stat4 #dede2 #aaf ,stat4 #cjcc2 #aba ,stat4 #aied7 is amended-- 7#a7 in the first sentence1 by striking and #eh1hjj1jjj 7based on ,october #a1 #aiig price levels7 and inserting 1 #eh1hjj1jjj 7based on ,october #a1 #aiig price levels71 and #ad1cjh1jjj 7based on ,october #a1 #bjaa price levels72 7#b7 in the second sentence1 by striking #bjac and inserting #bjaf2 and 7#c7 in the third sentence1 by striking and ,october #a1 #aiig 7with respect to the #eh1hjj1jjj7 and inserting 1 ,october #a1 #aiig 7with respect to the #eh1hjj1jjj71 and ,october #a1 #bjaa 7with respect to the #ad1cjh1jjj74 7b7 ,operation and ,maintenance of ,oglala ,sioux ,rural ,water ,supply ,system1 ,rosebud ,sioux ,rural ,water ,supply ,system1 and ,lower ,brule ,sioux ,water ,supply ,system ,section #aj7;b7 of the ,mni ,wiconi ,project ,act of #aihh 7,public ,law #ajj-eaf2 #ajb ,stat4 #bega2 #ajh ,stat4 #dede7 is amended-- 7#a7 in the first sentence1 by striking ,there are and inserting the following3 7#a7 ,operation and maintenance 7,a7 ,in general ,there are 2 7#b7 in the second sentence1 by striking ,the operation and inserting the following3 7,b7 ,west ,river and ,lyman-,jones ,rural ,water ,systems 7i7 ,in general ,the operation 2 7#c7 in the third sentence1 by striking ,such fee and inserting the following3 7ii7 ,fee basis ,the fee described in clause 7i7 2 7#d7 in the fourth sentence1 by striking ,such operation and maintenance payments and inserting the following3 7iii7 ,adjustment of payments ,the operation and maintenance payments under this subparagraph 2 and 7#e7 by adding after paragraph 7#a7 7as so designated7 the following3 7#b7 ,community water systems upgrades 7,a7 ,in general ,after the date on which public or tribal water systems on the ,pine ,ridge ,indian ,reservation1 the ,rosebud ,indian ,reservation1 and the ,lower ,brule ,indian ,reservation that are in existence on the date of enactment of this paragraph have been brought up to the standards for the water systems established in the plans developed under section #c;,c7a71 but not later than #ae years after the date of enactment of this paragraph1 title to each of the water systems shall be transferred to the ,united ,states1 to be held in trust for the benefit of the applicable ,indian tribe1 on the request of the ,oglala ,sioux ,tribe1 the ,rosebud ,sioux ,tribe1 or the ,lower ,brule ,sioux ,tribe1 as applicable1 and the owner of the water system4 7,b7 ,improvements and repairs and replacement ,the ,secretary shall use amounts authorized to be appropriated under paragraph 7#a7 for the improvement1 repair1 and replacement of any water system that is transferred or proposed1 by request of the owner of the water system1 to be transferred and improved under subparagraph 7,a74 4 #d4 ,offset ,notwithstanding any other provision of law1 in the case of the project authorized by section #afag of the ,reclamation ,projects ,authorization and ,adjustment ,act of #aiib 7#dc ,u4,s4,c4 #cij;h-#ab;c71 the maximum amount of the ,federal share of the cost of the project under section #afca7;d77#a7 of that ,act 7#dc ,u4,s4,c4 #cij;h-#ac7;d77#a77 otherwise available as of the date of enactment of this ,act shall be reduced by #ae1jjj1jjj4 ,passed the ,senate ,december #af1 #bjad4 ,secretary
