local jobs in rural communities that are located in or near ,national ,forest ,system land2 7#b7 to create an immediate1 predictable1 and increased flow of wood fiber with commercial value to support and maintain locally based infrastructure and economies that are necessary for the appropriate management and restoration of ,national ,forest ,system land2 7#c7 to promote cooperation and collaboration in the management of ,national ,forest ,system land2 7#d7 to restore and improve the ecological structure1 composition1 and function and the natural processes of priority watersheds within the ,national ,forest ,system2 7#e7 to carry out collaborative projects to reduce the risk of disturbances from fire1 insects1 and disease to communities1 watersheds1 and natural resources through a collaborative process of planning1 prioritizing1 and implementing ecological restoration and hazardous fuel reduction projects2 and 7#f7 to collect information from the projects carried out under this title in an effort to better understand the manner in which to improve forest restoration and management activities4 #ajb4 ,definitions ,in this title3 7#a7 ,authorized forest and watershed restoration project ,the term authorized forest and watershed restoration project means a collection of activities within a watershed area that are carried out-- 7,a7 on eligible land2 and 7,b7 to achieve the purposes of this title4 7#b7 ,decommission ,the term decommission means-- 7,a7 to reestablish vegetation on a road or trail2 and 7,b7 to restore any natural drainage1 watershed function1 or other ecological processes that are disrupted or adversely impacted by the road or trail by removing or hydrologically disconnecting the road prism4 7#c7 ,eligible land ,the term eligible land means-- 7,a7 land within the approximately #a1ijj1jjj acres of land in the ,beaverhead-,deerlodge ,national ,forest designated as ,suitable for ,timber ,production and ,timber ,harvest ,is ,allowed as generally depicted on the map entitled ,beaverhead-,deerlodge ,national ,forest1 ,revised ,forest ,plan1 ,modeled ,timber ,harvest ,classification and dated ,december #aj1 #bjjh2 and 7,b7 7i7 land within the ,three ,rivers ,ranger ,district of the ,kootenai ,national ,forest2 and 7ii7 any land within the adjacent ranger districts of the ,kootenai ,national ,forest that is necessary to achieve the requirements of section #ajc7;b74 7#d7 ,,infish ,the term ,,infish means the land and resource management plan amendments made before the date of enactment of this ,act arising from the document-- 7,a7 entitled ,inland ,native ,fish ,strategy2 7,b7 published by the ,department of ,agriculture2 and 7,c7 dated ,july #bh1 #aiie4 7#e7 ,initiative ,the term ,initiative means the ,montana ,forest ,jobs and ,restoration ,pilot ,initiative established by section #ajc7;a74 7#f7 ,mechanical treatment 7,a7 ,in general ,the term mechanical treatment means an activity that uses a tool to remove fiber that has commercial value to local markets in the vicinity of the area treated4 7,b7 ,inclusions ,the term mechanical treatment includes leaving fiber on the forest floor after treatment with a tool1 if an option for removal of the fiber was provided4 7,c7 ,exclusions ,the term mechanical treatment excludes prescribed burning4 7#g7 ,secretary ,the term ,secretary means the ,secretary of ,agriculture1 acting through the ,chief of the ,forest ,service4 7#h7 ,stewardship contract ,the term stewardship contract means a contract authorized under section #cdg of the ,omnibus ,consolidated and ,emergency ,supplemental ,appropriations ,act1 #aiii 7#af ,u4,s4,c4 #bajd note2 ,public ,law #aje-bgg7 to carry out land management goals that meet local and rural community needs through a source that is selected on a best-value basis4 7#i7 ,watershed area ,the term watershed area means #a or more subwatersheds 7also known as #fth code hydrologic units74 #ajc4 ,montana ,forest ,jobs and ,restoration ,pilot ,initiative 7a7 ,establishment ,there is established the ,montana ,forest ,jobs and ,restoration ,pilot ,initiative under which the ,secretary shall implement authorized forest and watershed restoration projects and other land management projects on eligible land to achieve-- 7#a7 the performance requirements under subsection 7b72 and 7#b7 the purposes of this title4 7b7 ,performance requirements ,subject to subsection 7g71 on the eligible land1 the ,secretary shall place under contract for the mechanical treatment of vegetation-- 7#a7 on the ,beaverhead-,deerlodge ,national ,forest1 a minimum of #e1jjj acres annually until the date on which a total of #gj1jjj acres in the ,national ,forest have been placed under contract2 and 7#b7 on the ,kootenai ,national ,forest-- 7,a7 #b1jjj acres during the first year after the date of enactment of this ,act2 7,b7 #b1ejj acres during the second year after the date of enactment of this ,act2 and 7,c7 #c1jjj acres during each subsequent year until the date on which a total of #cj1jjj acres in the ,national ,forest have been placed under contract4 7c7 ,collaboration 7#a7 ,in general ,for each ,national ,forest within the ,initiative1 the ,secretary shall identify #a or more collaborative groups or resource advisory committees that support the achievement of the purposes of this title4 7#b7 ,composition ,a collaborative group or resource advisory committee identified under paragraph 7#a7 shall include multiple interested persons representing diverse interests in forest and watershed management4 7#c7 ,consultation ,the ,secretary shall consult with a collaborative group or resource advisory committee identified under paragraph 7#a7 in the development and implementation of each authorized forest and watershed restoration project carried out under the ,initiative4 7#d7 ,expansion ,the ,secretary shall seek to expand the public participation and diversity of interests involved in the implementation of the ,initiative in each ,national ,forest participating in the ,initiative4 7d7 ,administrative review 7#a7 ,in general ,the administrative review provisions of section #aje of the ,healthy ,forests ,restoration ,act of #bjjc 7#af ,u4,s4,c4 #feae7 shall apply to any administrative review of authorized forest and watershed restoration projects carried out under this title4 7#b7 ,proposed decision ,the ,secretary shall provide notice of1 and distribute1 a proposed administrative decision with the environmental assessment or final environmental impact statement for any project subject to review under paragraph 7#a74 7#c7 ,independent mediator ,if #a or more of the parties to a special administrative review process under paragraph 7#a7 requests a mediator to help facilitate the process1 an independent mediator may be used for the administrative review process4 7e7 ,judicial review ,any judicial proceeding arising from an authorized forest and watershed restoration project shall be conducted in accordance with section #ajf of the ,healthy ,forests ,restoration ,act of #bjjc 7#af ,u4,s4,c4 #feaf74 7f7 ,reports 7#a7 ,annual summary ,the ,secretary shall provide to the appropriate committees of ,congress an annual summary of the progress of the ,initiative toward accomplishing the purposes of this title1 including the performance requirements established under subsection 7b74 7#b7 ,progress report 7,a7 ,in general ,not later than #e years after the date of enactment of this ,act and every #e years thereafter1 the ,secretary shall submit to the appropriate committees of ,congress a report that assesses the progress of the ,initiative toward accomplishing the purposes of this title4 7,b7 ,inclusions ,the report under subparagraph 7,a7 shall include an analysis1 with respect to the ,initiative1 of-- 7i7 fire and fuel dynamics1 including changes in-- 7,i7 condition and class2 and 7,,ii7 fuel levels and distribution2 7ii7 biodiversity1 including the selection of plant1 terrestrial animals1 and aquatic organisms2 7iii7 soil and water1 including soil movement1 water quality1 stream flows1 and soil productivity2 7iv7 economic effects1 including job creation1 labor income1 and energy2 and 7v7 social implications1 including land management practices1 aesthetics1 and attitudes towards land use4 7,c7 ,data analysis ,in preparing the report under this paragraph1 the ,secretary may consult with regional institutions of higher education and institutions with the capacity to coordinate1 analyze1 and archive the data collected as a result of monitoring under the ,initiative4 7g7 ,effect on other funds ,amounts expended under the ,initiative shall not reduce the allocations of appropriated funds to the ,secretary for use in other regions of the ,forest ,service or other ,states4 7h7 ,expansion of initiative 7#a7 ,in general ,the ,secretary may elect to include the ,seeley ,ranger ,district of the ,lolo ,national ,forest in the ,initiative1 if-- 7,a7 the ,seeley ,ranger ,district no longer receives funding under section #djjc7;b77#a77;,b7 of the ,omnibus ,public ,land ,management ,act of #bjji 7#af ,u4,s4,c4 #gcjc7;b77#a77;,b772 and 7,b7 a local collaborative group for the ,district requests inclusion in the ,initiative4 7#b7 ,requirements ,on the election by the ,secretary to include the ,seeley ,ranger ,district in the ,initiative1 the requirements of the ,initiative under this title shall apply to the ,district4 7i7 ,termination date 7#a7 ,in general ,the ,initiative shall terminate on the later of-- 7,a7 the date that is #ae years after the date of enactment of this ,act2 or 7,b7 the date on which the ,secretary determines that the performance requirements under subsection 7b7 have been achieved4 7#b7 ,effect ,nothing in this subsection affects a valid contract in effect on the termination date under paragraph 7#a74 #ajd4 ,authorized forest and watershed restoration projects 7a7 ,implementation 7#a7 ,in general ,the ,secretary shall annually implement #a or more authorized forest and watershed restoration projects on the eligible land4 7#b7 ,landscape-scale projects ,the ,secretary shall implement in #a or more watershed areas authorized forest and watershed restoration projects that provide landscape-scale work with the goal of minimizing entries into the watershed4 7#c7 ,stewardship contracts 7,a7 ,in general ,to the maximum extent practicable1 the ,secretary shall enter into stewardship contracts or agreements to carry out authorized forest and watershed restoration projects4 7,b7 ,stewardship contract priorities ,in developing a stewardship contract under subparagraph 7,a71 the ,secretary shall1 after consultation with the relevant collaborative groups or resource advisory committees identified under section #ajc7;c77#a71 prioritize areas consistent with the priorities described in paragraph 7#d74 7#d7 ,priority ,consistent with the purposes of this title1 the ,secretary shall give priority to carrying out authorized forest and watershed restoration projects in areas-- 7,a7 in which the road density exceeds #a4e miles per square mile2 7,b7 in the wildland-urban interface 7as defined in section #aja of the ,healthy ,forests ,restoration ,act of #bjjc 7#af ,u4,s4,c4 #feaa77 that are at risk of wildfire that threatens public infrastructure or private property2 7,c7 in which fish and wildlife habitat connectivity is compromised as a result of past management practices2 and 7,d7 that contain forests that are at risk from insect epidemics or high-severity wildfires4 7#e7 ,environmental review ,an environmental review of authorized forest and watershed restoration projects shall be carried out in accordance with section #ajd of the ,healthy ,forests ,restoration ,act of #bjjc 7#af ,u4,s4,c4 #feae71 except that-- 7,a7 the review shall also address-- 7i7 the activities necessary to meet the purposes and requirements of this title2 and 7ii7 the site-specific impacts of an authorized forest and watershed restoration project2 7,b7 on signing of a record of decision or finding of no significant impact for the authorized forest and watershed restoration project1 the ,secretary shall implement the authorized forest and watershed restoration project2 and 7,c7 if the ,secretary or a court determines that additional review is warranted due to significant new circumstances after implementation of an authorized forest and watershed restoration project has begun1 the additional analysis shall not interrupt the implementation of the activities that are not subject to the additional review1 in accordance with the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 7b7 ,project requirements 7#a7 ,riparian habitat protection 7,a7 ,in general ,except as provided in subparagraph 7,b71 the ,secretary shall comply with ,,infish in carrying out each authorized forest and watershed restoration project4 7,b7 ,modifications ,the ,secretary may modify ,,infish if the ,secretary determines1 after taking into consideration the best available science1 that the modifications would meet or exceed the intent and goals of ,,infish4 7#b7 ,roads ,in carrying out any authorized forest and watershed restoration project under this title1 the ,secretary shall-- 7,a7 not construct any permanent road1 unless-- 7i7 the ,secretary determines that the road is a justifiable realignment of a permanent road to restore or improve the ecological structure1 composition1 and function and the natural processes of the affected forest or watershed2 and 7ii7 the replaced road bed is decommissioned by removing the road prism2 and 7,b7 decommission any temporary road constructed to carry out the land management project by the conclusion of the contract4 7#c7 ,road density 7,a7 ,in general ,except as provided in subparagraph 7,b71 the ,secretary1 at the conclusion of an authorized forest and watershed restoration project1 shall achieve a road density maximum of #a4e linear miles per square mile1 averaged over the watershed area4 7,b7 ,exceptions ,notwithstanding subparagraph 7,a71 the maximum road density provided in an applicable land management plan shall apply if-- 7i7 the applicable land management plan requires a road density maximum that is less than that required under subparagraph 7,a72 or 7ii7 the authorized forest and watershed restoration project is carried out in an area governed by an interagency grizzly bear conservation plan4 7,c7 ,applicable law ,for purposes of determining compliance with the maximum road density under subparagraph 7,a71 the ,secretary shall use the definitions of the terms ,national ,forest ,system road and unauthorized road or trail provided in section #bab4a of title #cf1 ,code of ,federal ,regulations 7or a successor regulation74 7,d7 ,method ,the road density established under subparagraph 7,a7 may be accomplished through a combination of decommissioning and year-round permanent closure1 except that the ,secretary shall prioritize for decommissioning any roads adversely affecting water quality or fish habitat4 7#d7 ,vegetation management ,the ,secretary shall design authorized forest and watershed restoration projects to produce commercial and noncommercial wood products1 consistent with the purposes of this title4 #aje4 ,miscellaneous 7a7 ,in general ,except as otherwise provided in this title1 the ,secretary shall administer the ,national ,forests subject to the ,initiative in accordance with applicable law4 7b7 ,agency participation ,the ,secretary may1 in accordance with applicable law1 permit a ,field ,manager from each applicable ,bureau of ,land ,management office1 the ,seeley ,lake ,district ,ranger of the ,lolo ,national ,forest1 and the ,lincoln ,district ,ranger of the ,helena ,national ,forest to serve on the ,board of ,directors of the ,blackfoot ,challenge in the official capacities of the ,bureau of ,land ,management and the districts1 respectively4 7c7 ,biomass ,to help improve forest restoration activities by using and creating markets for small-diameter material and low-valued trees removed from forest restoration activities in the ,state1 the ,secretary may provide grants through the ,woody ,biomass ,utilization ,grant ,program or any other biomass program in accordance with applicable law4 ,,ii ,designation of wilderness and special management areas in ,montana #bja4 ,purposes ,the purposes of this title are-- 7#a7 to protect and enhance motorized recreational opportunities in the ,beaverhead-,deerlodge ,national ,forest1 the ,lolo ,national ,forest1 and the ,kootenai ,national ,forest2 and 7#b7 to protect and enhance the wild heritage and backcountry traditions of the ,state through-- 7,a7 the addition of certain land to the ,national ,wilderness ,preservation ,system2 and 7,b7 the management of other land in a manner that preserves existing primitive and semi-primitive recreational activities4 #bjb4 ,definitions ,in this title3 7#a7 ,beaverhead-deerlodge national forest ,the term ,beaverhead-,deerlodge ,national ,forest means the ,national ,forest that is-- 7,a7 comprised of-- 7i7 the ,beaverhead ,national ,forest2 and 7ii7 the ,deerlodge ,national ,forest2 and 7,b7 managed by the ,secretary concerned as a single administrative unit4 7#b7 ,designated road1 trail1 or area ,the term designated road1 trail1 or area has the meaning given the term in section #bab4a of title #cf1 ,code of ,federal ,regulations 7or a successor regulation74 7#c7 ,forest plan ,the term forest plan means a land and resource management plan prepared in accordance with section #f of the ,forest and ,rangeland ,renewable ,resources ,planning ,act of #aigd 7#af ,u4,s4,c4 #afjd74 7#d7 ,secretary concerned ,the term ,secretary concerned means-- 7,a7 the ,secretary of ,agriculture1 acting through the ,chief of the ,forest ,service1 with respect to ,national ,forest ,system land2 and 7,b7 the ,secretary of the ,interior1 with respect to land managed by the ,bureau of ,land ,management 7including land held for the benefit of an ,indian tribe74 7#e7 ,state ,the term ,state means the ,state of ,montana4 #bjc4 ,designation of wilderness areas 7a7 ,land administered by the forest service ,in furtherance of the purposes of the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 the following areas in the ,state are designated as wilderness areas and as components of the ,national ,wilderness ,preservation ,system3 7#a7 ,anaconda pintlar wilderness additions ,certain land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #fe1djg acres1 as generally depicted on the map entitled ,anaconda-,pintlar ,wilderness ,additions and dated ,september #ac1 #bjaj1 is incorporated in1 and shall be considered to be a part of1 the ,anaconda-,pintlar ,wilderness4 7#b7 ,bob marshall wilderness additions ,certain land in the ,lolo ,national ,forest1 comprising approximately #dj1jgb acres generally depicted as the ,north ,fork ,blackfoot-,monture ,creek ,wilderness ,addition 7,bob ,pioneers ,wilderness designated by subsection 7a77#d74 #bjd4 ,administration of wilderness areas 7a7 ,management ,subject to valid existing rights1 each area designated as wilderness by section #bjc shall be administered by the ,secretary concerned in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 except that-- 7#a7 any reference in that ,act to the effective date shall be considered to be a reference to the date of enactment of this ,act2 and 7#b7 with respect to public land administered by the ,bureau of ,land ,management1 any reference in that ,act to the ,secretary of ,agriculture shall be considered to be a reference to the ,secretary of the ,interior4 7b7 ,maps and legal descriptions 7#a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary concerned shall file a map and a legal description of each wilderness area and potential wilderness area designated by this section1 with-- 7,a7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7,b7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7#b7 ,force of law ,the maps and legal descriptions filed under paragraph 7#a7 shall have the same force and effect as if included in this title1 except that the ,secretary concerned may correct typographical errors in the maps and legal descriptions4 7#c7 ,public availability ,each map and legal description filed under paragraph 7#a7 shall be on file and available for public inspection in the appropriate offices of the ,forest ,service and the ,bureau of ,land ,management4 7c7 ,incorporation of acquired land and interests ,any land within the boundary of a wilderness area designated by section #bjc that is acquired by the ,united ,states shall-- 7#a7 become part of the wilderness area in which the land is located2 and 7#b7 be managed in accordance with this section1 the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 and any other applicable law4 7d7 ,withdrawal ,subject to valid existing rights1 the ,federal land designated as wilderness by section #bjc is withdrawn from all forms of-- 7#a7 entry1 appropriation1 or disposal under the public land laws2 7#b7 location1 entry1 and patent under the mining laws2 and 7#c7 disposition under all laws pertaining to mineral and geothermal leasing or mineral materials4 7e7 ,fire1 insects1 and diseases ,in accordance with section #d7;d77#a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#a771 within the wilderness areas designated by section #bjc1 the ,secretary concerned may take such measures as are necessary to control fire1 insects1 and diseases1 subject to such terms and conditions as the ,secretary concerned determines to be appropriate4 7f7 ,access to private land ,in accordance with section #e7;a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacd7;a771 the ,secretary concerned shall provide any owner of private land within the boundary of a wilderness area designated by section #bjc adequate access to the private land4 7g7 ,fish and wildlife 7#a7 ,in general ,nothing in this title affects the jurisdiction or responsibilities of the ,state with respect to fish and wildlife1 including the regulation of hunting1 fishing1 and trapping4 7#b7 ,management activities ,in furtherance of the purposes and principles of the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 the ,secretary concerned may carry out management activities to maintain or restore fish and wildlife populations 7including activities to maintain and restore fish and wildlife habitats to support the populations7 in a wilderness area designated by section #bjc if the activities are-- 7,a7 consistent with applicable wilderness management plans2 and 7,b7 carried out in accordance with applicable guidelines and policies4 7h7 ,snow sensors and stream gauges ,nothing in this title prevents the installation or maintenance of hydrological1 meteorological1 or climatological instrumentation in a wilderness area designated by section #bjc if the ,secretary concerned determines that the installation or maintenance of the instrumentation is necessary to further the scientific1 educational1 or conservation purposes of the wilderness area4 7i7 ,livestock ,within the wilderness areas1 the grazing of livestock in which grazing is established before the date of enactment of this ,act shall be allowed to continue1 subject to such reasonable regulations1 policies1 and practices as the ,secretary concerned determines to be necessary1 in accordance with-- 7#a7 section #d7;d77#d7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aaca7;d77#d772 7#b7 with respect to wilderness areas administered by the ,secretary of ,agriculture1 the guidelines described in ,house ,report #if-fag of the #ifth ,congress2 and 7#c7 with respect to wilderness areas administered by the ,secretary of the ,interior1 the guidelines described in ,appendix ,a of ,house ,report #aja-dje of the #ajast ,congress4 7j7 ,outfitting and guide activities 7#a7 ,in general ,in accordance with section #d7;d77#e7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#e771 commercial services 7including authorized outfitting and guide activities7 within the wilderness areas designated by section #bjc may be performed to the extent necessary for activities that are proper for realizing the recreational or other wilderness purposes of the wilderness areas4 7#b7 ,effect ,nothing in this title requires the ,secretary concerned to modify permits in effect as of the date of enactment of this ,act to provide outfitting and guide services within the areas designated as wilderness by section #bjc1 if the ,secretary concerned determines that the activities are in compliance with section #d7;d77#e7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#e774 7k7 ,adjacent management 7#a7 ,in general ,the designation of a wilderness area by section #bjc shall not create any protective perimeter or buffer zone around the wilderness area4 7#b7 ,nonwilderness activities ,the fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness area designated by section #bjc shall not preclude the conduct of the activities or uses outside the boundary of the wilderness area4 7l7 ,water impoundment structures 7#a7 ,in general ,the ,secretary concerned may issue a special use authorization to an owner of a water storage1 transport1 or diversion facility located within the areas designated as wilderness by section #bjc for the continued operation1 maintenance1 and reconstruction of the facility if-- 7,a7 the facility was in existence before the date of the designation of the wilderness area2 and 7,b7 the ,secretary concerned determines that-- 7i7 the facility has been in substantially continuous use to deliver water for the beneficial use on the non-,federal land of the owner since the date of the designation of the wilderness area2 7ii7 the owner of the facility holds a valid water right for use of the water under ,state law1 with a priority date that predates the date of the designation of the wilderness area2 and 7iii7 it is not practicable or feasible to relocate the facility to land outside the boundary of the wilderness and continue the beneficial use of water on the non-,federal land recognized under ,state law4 7#b7 ,use of motorized equipment and mechanized transport ,the special use authorization under paragraph 7#a7 may allow for the use of motorized equipment and mechanized transport if the ,secretary concerned determines1 after conducting a minimum tool analysis1 that the use of nonmotorized equipment and nonmechanized transport is impracticable or infeasible4 7#c7 ,terms and conditions ,the ,secretary concerned may include such terms and conditions in the special use authorization under paragraph 7#a7 as the ,secretary concerned determines appropriate to protect the wilderness values of the area4 7m7 ,snowcrest wilderness area ,with respect to the ,snowcrest ,wilderness ,area-- 7#a7 the continuation of reasonable motorized access to maintain water infrastructure for cattle that was constructed to protect fluvial ,arctic ,grayling and other aquatic species in the ,ruby ,river may continue-- 7,a7 subject to a permit2 and 7,b7 in accordance with-- 7i7 section #d7;d77#d7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#d772 and 7ii7 the guidelines described in ,house ,report #if-fag of the #ifth ,congress2 and 7#b7 the trailing of sheep across the ,snowcrest ,wilderness area to reach existing grazing allotments in the ,gravelly ,mountains may be continued for the tenure of the allotments-- 7,a7 subject to-- 7i7 a permit2 and 7ii7 a determination by the ,secretary of ,agriculture 7acting through the ,forest ,supervisor7 that the use of nonmechanized transport is impracticable or infeasible2 and 7,b7 to the maximum extent practicable1 in accordance with the guidelines described in ,house ,report #if-fag of the #ifth ,congress4 #bje4 ,release of ,bureau of ,land ,management study areas 7a7 ,finding ,congress finds that1 for purposes of section #fjc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb71 any portion of a wilderness study area described in subsection 7b7 that is not designated as a wilderness area by section #bjc or any other ,act enacted before the date of enactment of this ,act has been adequately studied for wilderness4 7b7 ,description of study areas ,the study areas referred to in subsection 7a7 are-- 7#a7 the ,axolotl ,lakes ,wilderness ,study ,area2 7#b7 the ,bell and ,limekiln ,canyons ,wilderness ,study ,area2 7#c7 the ,blacktail ,mountains ,wilderness ,study ,area2 7#d7 the ,centennial ,mountains ,wilderness ,study ,area2 7#e7 the ,farlin ,creek ,wilderness ,study ,area2 7#f7 the ,henneberry ,ridge ,wilderness ,study ,area2 7#g7 the ,hidden ,pasture ,wilderness ,study ,area2 7#h7 the ,humbug ,spires ,wilderness ,study ,area2 and 7#i7 the ,ruby ,mountains ,wilderness ,study ,area4 7c7 ,release ,any study area described in subsection 7b7 that is not designated as a wilderness area by section #bjc-- 7#a7 is no longer subject to section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c772 and 7#b7 shall be managed in accordance with the applicable land management plans adopted under section #bjb of that ,act 7#dc ,u4,s4,c4 #agab74 #bjf4 ,release of ,sapphire and ,west ,pioneer ,wilderness ,study ,areas 7a7 ,findings ,congress finds that-- 7#a7 the studies conducted under section #b of the ,montana ,wilderness ,study ,act of #aigg 7,public ,law #ie-aej2 #ia ,stat4 #abdc7 regarding each study area described in subsection 7b7 are adequate for the consideration of the suitability of each study area for inclusion as a component of the ,national ,wilderness ,preservation ,system2 and 7#b7 the ,secretary of ,agriculture is not required-- 7,a7 to review the wilderness option for each study area described in subsection 7b7 prior to the revision of the forest plan required for each land that comprises each study area in accordance with the ,forest and ,rangeland ,renewable ,resources ,planning ,act of #aigd 7#af ,u4,s4,c4 #afjj et seq472 and 7,b7 to manage the portion of each study area described in subsection 7b7 that is not designated as wilderness by section #bjc to ensure the suitability of the area for designation as a component of the ,national ,wilderness ,preservation ,system pending revision of the applicable forest plan4 7b7 ,description of study areas ,the study areas referred to in subsection 7a7 are those portions of the following wilderness study areas which are not designated as wilderness by section #bjc3 7#a7 ,the portion of the ,sapphire ,wilderness ,study ,area that is located on the ,beaverhead-,deerlodge ,national ,forest1 as described in section #b7d7 of the ,montana ,wilderness ,study ,act of #aigg 7,public ,law #ie-aej2 #ia ,stat4 #abdc74 7#b7 ,the ,west ,pioneer ,wilderness ,study ,area1 as described in section #b7a7 of the ,montana ,wilderness ,study ,act of #aigg 7,public ,law #ie-aej2 #ia ,stat4 #abdc74 #bjg4 ,special management and recreation management areas 7a7 ,designation ,to conserve1 protect1 and enhance the scenic1 fish and wildlife1 recreational1 backcountry heritage1 and other natural resource values of the areas1 the following areas in the ,state are designated for special management by the ,secretary concerned in accordance with this section3 7#a7 ,highlands special management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #e1jaa acres1 as generally depicted on the map entitled ,highlands ,wilderness ,area and ,special ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,highlands ,special ,management ,area4 7#b7 ,lost creek recreation management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #ad1ehi acres1 as generally depicted on the map entitled ,lost ,creek ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,lost ,creek ,recreation ,management ,area4 7#c7 ,otatsy recreation management area ,certain ,federal land in the ,lolo ,national ,forest1 comprising approximately #a1hei acres1 as generally depicted on the map entitled ,bob ,marshall1 ,mission ,mountains and ,scapegoat ,wilderness ,additions and ,otatsy ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,otatsy ,recreation ,management ,area4 7#d7 ,roderick special management area ,certain ,federal land in the ,kootenai ,national ,forest1 comprising approximately #c1gae acres1 as generally depicted on the map entitled ,roderick ,wilderness and ,special ,management ,area and ,three ,rivers ,special ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,roderick ,special ,management ,area4 7#e7 ,three rivers special management area ,certain ,federal land in the ,kootenai ,national ,forest1 comprising approximately #ga1iid acres1 as generally depicted on the map entitled ,roderick ,wilderness and ,special ,management ,area and ,three ,rivers ,special ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,three ,rivers ,special ,management ,area4 7#f7 ,thunderbolt creek recreation management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #ai1fda acres1 as generally depicted on the map entitled ,electric ,peak ,wilderness and ,thunderbolt ,creek ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,thunderbolt ,recreation ,management ,area4 7#g7 ,tobacco roots recreation management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #bi1ahf acres1 as generally depicted on the map entitled ,tobacco ,roots ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,tobacco ,roots ,recreation ,management ,area4 7#h7 ,west big hole recreation management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest comprising approximately #ie1add acres1 as generally depicted on the map entitled ,west ,big ,hole ,wilderness and ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,west ,big ,hole ,recreation ,management ,area4 7#i7 ,west pioneers recreation management area ,certain ,federal land in the ,beaverhead-,deerlodge ,national ,forest1 comprising approximately #abh1cfa acres1 as generally depicted on the map entitled ,west ,pioneers ,wilderness and ,recreation ,management ,area and dated ,september #ac1 #bjaj1 which is designated as the ,west ,pioneers ,recreation ,management ,area4 7b7 ,administration 7#a7 ,applicable law 7,a7 ,in general ,the ,secretary concerned shall administer each area designated by subsection 7a7-- 7i7 in furtherance of the purposes for which the area is established2 and 7ii7 in accordance with-- 7,i7 this section2 and 7,,ii7 any laws 7including regulations7 relating to the ,national ,forest ,system4 7,b7 ,closure of trails ,nothing in this title precludes the ,secretary concerned from closing any trail or area located in the areas designated by subsection 7a7-- 7i7 to protect a natural resource2 or 7ii7 to help ensure public safety4 7#b7 ,withdrawal ,subject to valid existing rights1 any ,federal land within an area designated by subsection 7a7 7including any ,federal land acquired after the date of enactment of this ,act for inclusion in an area designated by subsection 7a77 is withdrawn from all forms of-- 7,a7 entry1 appropriation1 or disposal under the public land laws2 7,b7 location1 entry1 and patent under the mining laws2 and 7,c7 disposition under all laws pertaining to mineral and geothermal leasing or mineral materials4 7#c7 ,timber harvesting 7,a7 ,in general ,except as provided in subparagraph 7,b7 or as authorized under subsection 7c71 timber harvesting shall not be permitted within an area designated by subsection 7a74 7,b7 ,fire1 insects1 and diseases ,timber harvesting may be permitted in an area designated by subsection 7a7 to the extent consistent with protecting and preserving the purposes of the areas designated by subsection 7a7 for purposes relating to the necessary control of fire1 insects1 and diseases4 7#d7 ,use of motorized or mechanized vehicles 7,a7 ,in general ,nothing in this section affects the use of motorized or mechanized vehicles that the ,secretary concerned determines is necessary for administrative use or to respond to an emergency4 7,b7 ,mechanized vehicles1 pedestrians1 and horse travel ,except as authorized under subsection 7c71 nothing in this section prohibits-- 7i7 the use of mechanized vehicles1 access by pedestrians1 or horse travel within the areas designated by subsection 7a72 or 7ii7 the construction of trails for use by mechanized vehicles1 pedestrians1 and horse travel within the areas designated by subsection 7a74 7#e7 ,firewood ,the ,secretary concerned may allow for the collection of firewood for noncommercial personal use within the areas designated by subsection 7a7-- 7,a7 in accordance with any applicable laws2 and 7,b7 subject to such terms and conditions as the ,secretary concerned determines to be appropriate4 7c7 ,area specific management requirements 7#a7 ,highlands special management area 7,a7 ,campground development ,no permanent campground may be constructed within the ,highlands ,special ,management ,area4 7,b7 ,motorized and mechanized recreation ,except as provided in subparagraph 7,c71 and as necessary for administrative use or to respond to an emergency1 the use of motorized or mechanized vehicles within the ,highlands ,special ,management ,area shall be prohibited4 7,c7 ,transmission towers and municipal water pipelines ,nothing in this section affects-- 7i7 the reasonable access of the government of the applicable county to operate and maintain the communication site located on ,table ,mountain under a special use permit issued by the ,forest ,service2 and 7ii7 the reasonable access of the city of ,butte1 ,montana1 to operate1 maintain1 and if necessary1 upgrade or replace the water supply pipeline within the ,highlands ,special ,management ,area in existence as of the date of enactment of this ,act for the city of ,butte 7including the surrounding community of the city of ,butte74 7,d7 ,helicopter landings ,nothing in this section precludes or restricts the authority of the ,secretary concerned to enter into agreements with the ,secretary of ,defense or the ,montana ,national ,guard to authorize limited and scheduled landings of aircraft in the ,highlands ,special ,management ,area4 7#b7 ,lost creek1 thunderbolt1 and west pioneers recreation management areas 7,a7 ,motorized recreation ,subject to any terms and conditions the ,secretary concerned determines to be necessary1 the use of motorized vehicles within the ,lost ,creek1 ,thunderbolt1 and ,west ,pioneers ,recreation ,management ,areas shall be limited to-- 7i7 roads1 trails1 or areas that1 as of the date of enactment of this ,act1 are designated roads1 trails1 or areas2 and 7ii7 during periods of adequate snow cover1 the areas authorized for snowmobile use as of the date of enactment of this ,act4 7,b7 ,campground development ,no permanent campground may be constructed within the ,lost ,creek ,recreation ,area4 7#c7 ,otatsy recreation management area 7,a7 ,motorized and mechanized recreation 7i7 ,in general ,the use of motorized and mechanized vehicles in the ,otatsy ,recreation ,management ,area shall be permitted only on the roads1 trails1 and areas that are designated for use by motorized and mechanized vehicles by the management plan required under subparagraph 7,b74 7ii7 ,interim management ,until the date on which the management plan required under subparagraph 7,b7 is approved1 and subject to any terms and conditions that the ,secretary concerned determines to be necessary1 the use of motorized or mechanized vehicles in the ,otatsy ,recreation ,management ,area shall be limited to the roads and trails designated for such use as of the date of enactment of this ,act1 except that during periods of adequate snow cover1 the use of snowmobiles shall be allowed within the ,otatsy ,recreation ,management ,area4 7,b7 ,management plan ,the ,secretary concerned shall prepare a management plan for the ,otatsy ,recreation ,management ,area as part of the first revision of the applicable forest plan that is carried out after the date of enactment of this ,act4 7#d7 ,three rivers and roderick special management areas 7,a7 ,motorized and mechanized recreation ,except as provided in subparagraphs 7,b7 and 7,c71 the use of motorized or mechanized vehicles within the ,three ,rivers ,special ,management ,area and the ,roderick ,special ,management ,area shall be limited to the roads on which use by highway legal vehicles is permitted as of the date of enactment of this ,act4 7,b7 ,snowmobile area ,subject to any terms and conditions the ,secretary concerned determines to be necessary1 during periods of adequate snow cover1 the use of snowmobiles shall be allowed in the areas designated as motorized in the map entitled 8,roderick ,wilderness and ,special ,management ,area and ,three ,rivers ,special ,management ,area0 and dated ,september #ac1 #bjaj4 7,c7 ,game carts ,the ,secretary concerned may authorize the use of nonmotorized game carts in the area identified as ,roderick ,special ,management ,area on the map described in subparagraph 7,b74 7,d7 ,campground development ,no permanent campground may be constructed in the ,three ,rivers ,special ,management ,area or the ,roderick ,special ,management ,area4 7#e7 ,tobacco roots recreation management area ,subject to any terms and conditions that the ,secretary concerned determines to be necessary1 the use of motorized vehicles shall be limited to the roads and trails in the ,tobacco ,roots ,recreation ,management ,area designated for such use as of the date of enactment of this ,act4 7#f7 ,west big hole recreation management area 7,a7 ,motorized recreation ,subject to any terms and conditions the ,secretary concerned determines to be necessary1 the use of motorized vehicles within the ,west ,big ,hole ,recreation ,management ,area shall be limited to-- 7i7 the roads1 trails1 and areas that1 as of the date of enactment of this ,act1 are designated roads1 trails1 or areas2 and 7ii7 during periods of adequate snow cover1 the areas authorized for snowmobile use as of the date of enactment of this ,act4 7,b7 ,timber harvest ,the ,secretary concerned may authorize post and pole1 firewood1 and fuel reduction timber projects in the ,west ,big ,hole ,recreation ,management ,area1 subject to such terms and conditions that the ,secretary concerned determines to be appropriate4 #bjh4 ,all-terrain-vehicle study and report ,not later than #a year after the date of enactment of this ,act1 the ,secretary concerned shall study and report on-- 7#a7 the opportunities for expanded all-terrain vehicle roads and trails across the ,three ,rivers ,district and adjacent areas on the ,kootenai ,national ,forest2 7#b7 the interconnectedness of roads on private or ,state land2 and 7#c7 the opportunities for expanded access points to existing trails4
