other purposes4 #a4 ,short title ,this ,act may be cited as the ,southeast ,alaska ,native ,land ,entitlement ,finalization and ,jobs ,protection ,act4 #b4 ,definitions ,in this ,act3 7#a7 ,maps ,the term maps means the maps entitled ,sealaska ,land ,entitlement ,finalization1 numbered #a through #ag and dated ,october #ag1 #bjab1 and numbered #ah and dated ,december #ba1 #bjab4 7#b7 ,sealaska ,the term ,sealaska means the ,sealaska ,corporation1 a ,regional ,native ,corporation established under the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afja et seq474 7#c7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#d7 ,state ,the term ,state means the ,state of ,alaska4 #c4 ,finalization of entitlement 7a7 ,in general ,if1 not later than #ij days after the date of enactment of this ,act1 the ,secretary receives a corporate resolution adopted by the board of directors of ,sealaska agreeing to accept the conveyance of land described in subsection 7b7 in accordance with this ,act as full and final satisfaction of the remaining land entitlement of ,sealaska under section #ad7;h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h771 the ,secretary shall-- 7#a7 implement the provisions of this ,act2 and 7#b7 charge the entitlement pool under section #ad7;h77#h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#h77 #gj1jge acres1 reduced by the number of acres deducted under subsection 7b77#b71 in fulfillment of the remaining land entitlement for ,sealaska under that ,act1 notwithstanding whether the surveyed acreage of the #ah parcels of land generally depicted on the maps as ,sealaska ,selections and patented under section #d is less than or more than #fi1ehe acres1 reduced by the number of acres deducted under subsection 7b77#b74 7b7 ,final entitlement 7#a7 ,in general ,except as provided in paragraph 7#b71 the land described in subsection 7a7 shall consist of-- 7,a7 the #ah parcels of ,federal land comprising approximately #fi1ehe acres that is generally depicted as ,sealaska ,selections on the maps2 and 7,b7 a total of not more than #dij acres of ,federal land for cemetery sites and historical places comprised of parcels that are applied for in accordance with section #e4 7#b7 ,deduction 7,a7 ,in general ,the ,secretary shall deduct from the number of acres of ,federal land described in paragraph 7#a77;,a7 the number of acres of ,federal land for which the ,secretary has issued a conveyance during the period beginning on ,august #a1 #bjab1 and ending on the date of receipt of the resolution under subsection 7a74 7,b7 ,agreement ,the ,secretary1 the ,secretary of ,agriculture1 and ,sealaska shall negotiate in good faith to make a mutually agreeable adjustment to the parcel of ,federal land generally depicted on the maps entitled ,sealaska ,land ,entitlement ,finalization1 numbered #a of #ag1 and dated ,october #ag1 #bjab1 and the map numbered #ah and dated ,december #ba1 #bjab1 to implement the deduction of acres required by subparagraph 7,a74 7c7 ,effect of acceptance ,the resolution filed by ,sealaska in accordance with subsection 7a7 shall-- 7#a7 be final and irrevocable2 and 7#b7 without any further administrative action by the ,secretary1 result in-- 7,a7 the relinquishment of all existing selections made by ,sealaska under subsection #ad7;h77#h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#h772 and 7,b7 the termination of all withdrawals by section #af of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afae71 except to the extent a selection by a ,village ,corporation under subsections 7b7 and 7d7 of section #af of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afae7 remains pending1 until the date on which those selections are resolved4 7d7 ,failure ,to accept ,if ,sealaska fails to file the resolution in accordance with subsection 7a7-- 7#a7 the provisions of this ,act shall cease to be effective2 and 7#b7 the ,secretary shall1 not later than #bg months after the date of enactment of this ,act1 complete the interim conveyance of the remaining land entitlement to ,sealaska under section #ad7;h77#h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#h77 from prioritized selections on file with the ,secretary on the date of enactment of this ,act4 7e7 ,scope of law ,except as provided in subsections 7d7 and 7f71 this ,act provides the exclusive authority under which the remaining land entitlement of ,sealaska under section #ad7;h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77 may be fulfilled4 7f7 ,effect ,nothing in this ,act affects any land that is-- 7#a7 the subject of an application under subsection 7h77#a7 of section #ad of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7 that is pending on the date of enactment of this ,act2 and 7#b7 conveyed in accordance with that subsection4 #d4 ,conveyances to ,sealaska 7a7 ,interim conveyance ,subject to valid existing rights1 subsections 7c71 7d71 and 7e71 section #c7;b71 and section #f7;a71 the ,secretary shall complete the interim conveyance of the #ah parcels of ,federal land comprising approximately #fi1ehe acres generally depicted on the maps by the date that is #fj days after the date of receipt of the resolution under section #c7;a71 subject to the ,secretary identifying and reserving1 by the date that is #b years after the date of enactment of this ,act1 any easement that could have been reserved in accordance with this ,act prior to the interim conveyance4 7b7 ,withdrawal 7#a7 ,in general ,subject to valid existing rights1 the ,federal land described in subsection 7a7 is withdrawn from-- 7,a7 all forms of appropriation under the public land laws2 7,b7 location1 entry1 and patent under the mining laws2 7,c7 disposition under laws relating to mineral or geothermal leasing2 and 7,d7 selection under the ,act of ,july #g1 #aieh 7commonly known as the ,alaska ,statehood ,act7 7#dh ,u4,s4,c4 note prec4 #ba2 ,public ,law #he-ejh74 7#b7 ,termination ,the withdrawal under paragraph 7#a7 shall remain in effect until-- 7,a7 if ,sealaska fails to file a resolution in accordance with section #c7;a71 the date that is #ij days after the date of enactment of this ,act2 or 7,b7 the date on which the ,federal land is conveyed under subsection 7a74 7c7 ,treatment of land conveyed ,except as otherwise provided in this ,act1 any land conveyed to ,sealaska under subsection 7a7 shall be-- 7#a7 considered to be land conveyed by the ,secretary under section #ad7;h77#h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#h772 and 7#b7 subject to all laws 7including regulations7 applicable to entitlements under section #ad7;h77#h7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#h771 including section #ijg7;d7 of the ,alaska ,national ,interest ,lands ,conservation ,act 7#dc ,u4,s4,c4 #afcf7;d774 7d7 ,easements 7#a7 ,public easements ,the deeds of conveyance for the land under subsection 7a7 shall be subject to the reservation of public easements under section #ag7;b7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afaf7;b774 7#b7 ,conservation easements 7,a7 ,in general ,in the deeds of conveyance for the land under subsection 7a71 the ,secretary shall reserve a conservation easement to protect the aquatic and riparian habitat extending #ajj feet on each side of the anadromous water bodies depicted as #ajj ,foot ,conservation ,easement on the maps numbered #c1 #d1 and #f4 7,b7 ,prohibition ,the commercial harvest of timber within the conservation easements described in subparagraph 7,a7 shall be prohibited1 except that ,sealaska may1 for the purpose of harvesting timber outside of the conservation easement-- 7i7 maintain roads within the conservation easement that are in existence on the date of enactment of this ,act2 and 7ii7 construct temporary roads and yarding corridors across the conservation easements in accordance with the applicable ,national ,forest ,system construction standards4 7,c7 ,administration ,the ,secretary of ,agriculture shall administer the conservation easements described in subparagraph 7,a74 7#c7 ,research easement ,in the deed of conveyance for the land generally depicted on the map entitled ,sealaska ,land ,entitlement ,finalization1 numbered #g of #ag1 and dated ,october #ag1 #bjab1 the ,secretary shall reserve an easement-- 7,a7 to access and continue ,forest ,service research activities on the study plots located on the land2 and 7,b7 that shall remain in effect for a #aj-year period beginning on the date of enactment of this ,act4 7#d7 ,koscuisko ,island road easement 7,a7 ,in general ,the deeds of conveyance for the land on ,koscuisko ,island under subsection 7a7 shall grant to ,sealaska an easement providing access to and use by ,sealaska of the log transfer facility at ,shipley ,bay on ,koscuisko ,island1 subject to-- 7i7 the agreement under subparagraph 7,c72 and 7ii7 the agreement under section #f7;b74 7,b7 ,scope of the ,easement ,the easement under subparagraph 7,a7 shall enable ,sealaska-- 7i7 to construct1 use1 and maintain a road connecting the ,forest ,service ,road known as ,cape ,pole ,road to the ,forest ,service ,road known as ,south ,shipley ,bay ,road within the corridor depicted on the map entitled ,sealaska ,land ,entitlement ,finalization1 numbered #c of #ag1 and dated ,october #ag1 #bjab2 7ii7 to use1 maintain1 and if necessary1 reconstruct the ,forest ,service ,road known as ,south ,shipley ,bay ,road referred to in clause 7i7 to access the log transfer facility at ,shipley ,bay2 and 7iii7 to use1 maintain1 and expand the log transfer and sort yard facility at ,shipley ,bay that is within the area depicted on the map entitled ,sealaska ,land ,entitlement ,finalization1 numbered #c of #ag and dated ,october #ag1 #bjab4 7,c7 ,roads and facilities use agreement ,in addition to the agreement under section #f7;b71 the ,secretary and ,sealaska shall enter into an agreement relating to the access1 use1 maintenance1 and improvement of the roads and facilities under this paragraph4 7,d7 ,determination of location2 legal description ,sealaska shall-- 7i7 in consultation with the ,secretary1 determine the location within the corridor of the centerline of the road described in subparagraph 7,b77i72 and 7ii7 provide to the ,secretary a legal description of the centerline acceptable for granting the easement described in subparagraph 7,b77i74 7e7 ,hunting1 fishing1 and recreation 7#a7 ,in general ,any land conveyed under subsection 7a7 that is located outside a withdrawal area designated under section #af7;a7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afae7;a77 shall remain open and available to subsistence uses1 as that term is defined in section #hjc of the ,alaska ,national ,interest ,lands ,conservation ,act 7#af ,u4,s4,c4 #caac71 and noncommercial recreational hunting and fishing and other recreational uses by the public under applicable law-- 7,a7 without liability on the part of ,sealaska1 except for willful acts1 to any user as a result of the use2 and 7,b7 subject to-- 7i7 any reasonable restrictions that may be imposed by ,sealaska on the public use-- 7,i7 to ensure public safety2 7,,ii7 to minimize conflicts between recreational and commercial uses2 7,,iii7 to protect cultural resources2 7,,iv7 to conduct scientific research2 or 7,v7 to provide environmental protection2 and 7ii7 the condition that ,sealaska post on any applicable property1 in accordance with ,state law1 notices of the restrictions on use4 7#b7 ,effect ,access provided to any individual or entity under paragraph 7#a7 shall not-- 7,a7 create an interest in any third party in the land conveyed under subsection 7a72 or 7,b7 provide standing to any third party in any review of1 or challenge to1 any determination by ,sealaska with respect to the management or development of the land conveyed under subsection 7a71 except as against ,sealaska for the management of public access under paragraph 7#a74 #e4 ,cemetery sites and historical places 7a7 ,in general ,notwithstanding section #ad7;h77#a77;,e7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#a77;,e771 ,sealaska may submit applications for the conveyance under section #ad7;h77#a77;,a7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#a77;,a77 of not more than #gf cemetery sites and historical places-- 7#a7 that are listed in the document entitled ,sealaska ,cemetery ,sites and ,historical ,places and dated ,october #ag1 #bjab2 7#b7 that are cemetery sites and historical places included in the report by ,wilsey and ,ham1 ,inc41 entitled #aige ,native ,cemetery and ,historic ,sites of ,southeast ,alaska 7,preliminary ,report7 and dated ,october #aige2 7#c7 for which ,sealaska has not previously submitted an application2 and 7#d7 that are not located within a conservation system unit 7as defined in section #ajb of the ,alaska ,national ,interest ,lands ,conservation ,act 7#af ,u4,s4,c4 #cajb774 7b7 ,procedure for evaluating applications ,except as otherwise provided in this section1 the ,secretary shall consider all applications submitted under this section in accordance with the criteria and procedures set forth in applicable regulations in effect as of the date of enactment of this ,act4 7c7 ,conveyance ,the ,secretary may convey cemetery sites and historical places under this section that result in the conveyance of a total of approximately #dij acres of ,federal land comprised of parcels that are-- 7#a7 applied for in accordance with this section2 and 7#b7 subject to-- 7,a7 valid existing rights2 7,b7 the public access provisions of subsection 7g72 7,c7 the condition that the conveyance of land for the site listed under subsection 7a77#a7 as ,bay of ,pillars ,portage is limited to #be acres in ,t4#fj ,s41 ,r4#gb ,e41 ,sec4 #bh1 ,copper ,river ,meridian2 and 7,d7 the condition that any access to or use of the cemetery sites and historical places shall be consistent with the management plans for adjacent public land1 if the management plans are more restrictive than the laws 7including regulations7 applicable under subsection 7i74 7d7 ,timeline ,no application for a cemetery site or historical place may be submitted under subsection 7a7 after the date that is #b years after the date of enactment of this ,act4 7e7 ,consultation with ,recognized ,tribal ,entity ,sealaska shall-- 7#a7 consult with any affected federally recognized ,indian tribe before submitting any application for a cemetery site or historical place located within the traditional territory of the ,indian tribe2 and 7#b7 include with each application described in paragraph 7#a7 a statement that the required consultation was carried out in accordance with that paragraph4 7f7 ,selection of additional cemetery sites ,if ,sealaska submits timely applications to the ,secretary in accordance with subsections 7a71 7d71 and 7e71 for all #gf sites listed under subsection 7a77#a71 and the ,secretary rejects any of those applications in whole or in part-- 7#a7 not later than #b years after the date on which the ,secretary completes the conveyance of eligible cemetery sites and historical places applied for under subsection 7a71 and subject to subsection 7e71 ,sealaska may submit applications for the conveyance under section #ad 7h77#a77;,a7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#a77;,a77 of additional cemetery sites that are not located in a conservation system unit described in 7a77#d71 the total acreage of which1 together with the cemetery sites and historical places previously conveyed by the ,secretary under subsection 7c71 shall not exceed #dij acres2 and 7#b7 the ,secretary shall-- 7,a7 consider any applications for the conveyance of additional cemetery sites in accordance with subsection 7b72 and 7,b7 if the applications are approved1 provide for the conveyance of the sites in accordance with subsection 7c74 7g7 ,public access 7#a7 ,in general ,subject to paragraph 7#b71 any land conveyed under this section shall be subject to-- 7,a7 the reservation of public easements under section #ag7;b7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afaf7;b772 7,b7 public access across the conveyed land in cases in which no reasonable alternative access around the land is available1 without liability to ,sealaska1 except for willful acts1 to any user by reason of the use2 and 7,c7 public access within #be feet of any ,class ,i stream described in section #gje7;e7 of the ,alaska ,national ,interest ,lands ,conservation ,act 7#af ,u4,s4,c4 #eci;d7e77 for noncommercial recreational and subsistence fishing1 without liability to ,sealaska1 except for willful acts1 to any user by reason of the use4 7#b7 ,limitations ,the public access and use under subparagraphs 7,b7 and 7,c7 of paragraph 7#a7 shall be subject to-- 7,a7 any reasonable restrictions that may be imposed by ,sealaska on the public access and use-- 7i7 to ensure public safety2 7ii7 to protect and conduct research on the historic1 archaeological1 and cultural resources of the conveyed land2 or 7iii7 to provide environmental protection2 7,b7 the condition that ,sealaska post on any applicable property1 in accordance with ,state law1 notices of the restrictions on the public access and use2 and 7,c7 the condition that the public access and use shall not be incompatible with or in derogation of the values of the area as a cemetery site or historical place1 as provided in section #bfec4aa of title #dc1 ,code of ,federal ,regulations 7or a successor regulation74 7#c7 ,effect ,access provided to any individual or entity by paragraph 7#a7 shall not-- 7,a7 create an interest in any third party in the land conveyed under this section2 or 7,b7 provide standing to any third party in any review of1 or challenge to1 any determination by ,sealaska with respect to the management or development of the land conveyed under this section1 except as against ,sealaska for the management of public access under paragraph 7#b74 7h7 ,prohibition on transfer or loss 7#a7 ,prohibition on transfer ,notwithstanding any other provision of law1 ,sealaska shall not-- 7,a7 alienate1 transfer1 assign1 mortgage1 or pledge any cemetery site or historical place conveyed under this section to any person or entity other than the ,united ,states2 or 7,b7 permit development or improvement of the cemetery site or historical place for any use which is incompatible with1 or is in derogation of1 the values of the area as a cemetery site or historical place4 7#b7 ,prohibition on loss ,notwithstanding any other provision of law1 any cemetery site or historical place conveyed to ,sealaska under this section shall be exempt from-- 7,a7 adverse possession and similar claims based on estoppel2 7,b7 real property taxes by any governmental entity2 7,c7 title #aa of the ,united ,states ,code or a successor law1 any other insolvency or moratorium law1 or any other law generally affecting creditors' rights2 7,d7 judgments in any action at law or in equity to recover sums owed or penalties incurred by ,sealaska or any employee1 officer1 director1 or shareholder of ,sealaska2 and 7,e7 involuntary distributions or conveyances to any person or entity other than the ,united ,states related to the involuntary dissolution of ,sealaska4 7i7 ,treatment of land conveyed ,except as otherwise provided in this ,act1 any land conveyed to ,sealaska under this section shall be-- 7#a7 considered land conveyed by the ,secretary under section #ad7;h77#a7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#a772 and 7#b7 subject to all laws 7including regulations7 applicable to conveyances under section #ad7;h77#a7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;h77#a771 including section #ijg7;d7 of the ,alaska ,national ,interest ,lands ,conservation ,act 7#dc ,u4,s4,c4 #afcf7;d774 #f4 ,miscellaneous 7a7 ,special use authorizations 7#a7 ,in general ,on the conveyance of land to ,sealaska under section #d7;a7-- 7,a7 any guiding or outfitting special use authorization issued by the ,forest ,service for the use of the conveyed land shall terminate2 and 7,b7 as a condition of the conveyance and consistent with section #ad7;g7 of the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afac7;g771 ,sealaska shall allow the holder of the special use authorization terminated under subparagraph 7,a7 to continue the authorized use1 subject to the terms and conditions that were in the special use authorization issued by the ,forest ,service1 for-- 7i7 the remainder of the term of the authorization2 and 7ii7 #a additional consecutive #aj-year renewal period4 7#b7 ,notice of commercial activities ,sealaska and any holder of a guiding or outfitting authorization under this subsection shall have a mutual obligation1 subject to the guiding or outfitting authorization1 to inform the other party of any commercial activities prior to engaging in the activities on the land conveyed to ,sealaska under section #d7;a74 7#c7 ,negotiation of new terms ,nothing in this subsection precludes ,sealaska and the holder of a guiding or outfitting authorization from negotiating a new mutually agreeable guiding or outfitting authorization4 7#d7 ,liability ,neither ,sealaska nor the ,united ,states shall bear any liability1 except for willful acts of ,sealaska or the ,united ,states1 regarding the use and occupancy of any land conveyed to ,sealaska under this ,act1 as provided in any outfitting or guiding authorization under this subsection4 7b7 ,roads and facilities ,not later than #a year after the date of enactment of this ,act1 the ,secretary of ,agriculture and ,sealaska shall negotiate in good faith to develop a binding agreement-- 7#a7 for the use of ,national ,forest ,system roads and related transportation facilities by ,sealaska2 and 7#b7 the use of ,sealaska roads and related transportation facilities by the ,forest ,service4 7c7 ,traditional trade and migration route designations 7#a7 ,designations 7,a7 ,the ,inside ,passage ,the route from ,yakutat to ,dry ,bay1 as generally depicted on the map entitled 8,traditional ,trade and ,migration ,route1 ,neix naax aan nx--,the ,inside ,passage0 and dated ,october #ag1 #bjab1 is designated as 8,neix naax aan nx0 78,the ,inside ,passage074 7,b7 ,canoe ,road ,the route from the ,bay of ,pillars to ,port ,camden1 as generally depicted on the map entitled 8,traditional ,trade and ,migration ,route1 ,yakwdeiy--,canoe ,road0 and dated ,october #ag1 #bjab1 is designated as 8,yakwdeiy0 78,canoe ,road074 7,c7 ,the ,people's ,road ,the route from ,portage ,bay to ,duncan ,canal1 as generally depicted on the map entitled 8,traditional ,trade and ,migration ,route1 ,lingt ,deiy--,the ,people's ,road0 and dated ,october #ag1 #bjab1 is designated 8,lingt ,deiy0 78,the ,people's ,road074 7#b7 ,access to traditional trade and migration routes ,the culturally and historically significant trade and migration routes designated by paragraph 7#a7 shall be open to travel by ,sealaska and the public in accordance with applicable law1 subject to such terms1 conditions1 and special use authorizations as the ,secretary of ,agriculture may require4 7d7 ,effect on other laws 7#a7 ,in general ,nothing in this ,act delays the duty of the ,secretary to convey land to-- 7,a7 the ,state under the ,act of ,july #g1 #aieh 7commonly known as the ,alaska ,statehood ,act7 7#dh ,u4,s4,c4 note prec4 #ba2 ,public ,law #he-ejh72 or 7,b7 a ,native ,corporation under-- 7i7 the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afja et seq472 or 7ii7 the ,alaska ,land ,transfer ,acceleration ,act 7#dc ,u4,s4,c4 #afaa note2 ,public ,law #ajh-deb74 7#b7 ,conveyances ,the ,secretary shall promptly proceed with the conveyance of all land necessary to fulfill the final entitlement of all ,native ,corporations in accordance with-- 7,a7 the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afja et seq472 and 7,b7 the ,alaska ,land ,transfer ,acceleration ,act 7#dc ,u4,s4,c4 #afaa note2 ,public ,law #ajh-deb74 7e7 ,escrow funds ,if ,sealaska files the resolution in accordance with section #c7;a7-- 7#a7 the escrow requirements of section #b of ,public ,law #id-bjd 7#dc ,u4,s4,c4 #afac note7 shall apply to proceeds 7including interest7 derived from the land withdrawn under section #d7;b7 from the date of receipt of the resolution2 and 7#b7 ,sealaska shall have no right to any
