with human immunodeficiency virus 7,,hiv74 #a4 ,short title ,this ,act may be cited as the ,,hiv ,organ ,policy ,equity ,act4 #b4 ,amendments to the ,public ,health ,service ,act 7a7 ,standards of quality for the acquisition and transportation of donated organs 7#a7 ,organ ,procurement and ,transplantation ,network ,section #cgb7;b7 of the ,public ,health ,service ,act 7#db ,u4,s4,c4 #bgd7;b77 is amended-- 7,a7 in paragraph 7#b77;,e71 by striking 1 including standards for preventing the acquisition of organs that are infected with the etiologic agent for acquired immune deficiency syndrome2 and 7,b7 by adding at the end the following3 7#c7 ,clarification ,in adopting and using standards of quality under paragraph 7#b77;,e71 the ,organ ,procurement and ,transplantation ,network may adopt and use such standards with respect to organs infected with human immunodeficiency virus 7in this paragraph referred to as ,,hiv71 provided that any such standards ensure that organs infected with ,,hiv may be transplanted only into individuals who-- 7,a7 are infected with ,,hiv before receiving such organ2 and 7,b7 7i7 are participating in clinical research approved by an institutional review board under the criteria1 standards1 and regulations described in subsections 7a7 and 7b7 of section #cgg;,e2 or 7ii7 if the ,secretary has determined under section #cgg;,e7c7 that participation in such clinical research1 as a requirement for such transplants1 is no longer warranted1 are receiving a transplant under the standards and regulations under section #cgg;,e7c74 4 7#b7 ,conforming amendment ,section #cga7;b77#c77;,c7 of the ,public ,health ,service ,act 7#db ,u4,s4,c4 #bgc7;b77#c77;,c72 relating to organ procurement organizations7 is amended by striking including arranging for testing with respect to preventing the acquisition of organs that are infected with the etiologic agent for acquired immune deficiency syndrome and inserting including arranging for testing with respect to identifying organs that are infected with human immunodeficiency virus 7,,hiv74 7#c7 ,technical amendments ,section #cga7;b77#a7 of the ,public ,health ,service ,act 7#db ,u4,s4,c4 #bgc7;b77#a77 is amended by-- 7,a7 striking subparagraph 7,e72 7,b7 redesignating subparagraphs 7,f7 and 7,g7 as subparagraphs 7,e7 and 7,f71 respectively2 7,c7 striking 7,h7 has a director and inserting 7,g7 has a director2 and 7,d7 in subparagraph 7,h7-- 7i7 in clause 7i7 7,v71 by striking paragraph 7#b77;,g7 and inserting paragraph 7#c77;,g72 and 7ii7 in clause 7ii71 by striking paragraph 7#b7 and inserting paragraph 7#c74 7b7 ,publication of research guidelines ,part ,h of title ,,iii of the ,public ,health ,service ,act 7#db ,u4,s4,c4 #bgc et seq47 is amended by inserting after section #cgg;,d the following3 #cgg;,e4 ,criteria1 standards1 and regulations with respect to organs infected with ,,hiv 7a7 ,in general ,not later than #b years after the date of the enactment of the ,,hiv ,organ ,policy ,equity ,act1 the ,secretary shall develop and publish criteria for the conduct of research relating to transplantation of organs from donors infected with human immunodeficiency virus 7in this section referred to as ,,hiv7 into individuals who are infected with ,,hiv before receiving such organ4 7b7 ,corresponding changes to standards and regulations applicable to research ,not later than #b years after the date of the enactment of the ,,hiv ,organ ,policy ,equity ,act1 to the extent determined by the ,secretary to be necessary to allow the conduct of research in accordance with the criteria developed under subsection 7a7-- 7#a7 the ,organ ,procurement and ,transplantation ,network shall revise the standards of quality adopted under section #cgb7;b77#b77;,e72 and 7#b7 the ,secretary shall revise section #aba4f of title #db1 ,code of ,federal ,regulations 7or any successor regulations74 7c7 ,revision of standards and regulations generally ,not later than #d years after the date of the enactment of the ,,hiv ,organ ,policy ,equity ,act1 and annually thereafter1 the ,secretary1 shall-- 7#a7 review the results of scientific research in conjunction with the ,organ ,procurement and ,transplantation ,network to determine whether the results warrant revision of the standards of quality adopted under section #cgb7;b77#b77;,e7 with respect to donated organs infected with ,,hiv and with respect to the safety of transplanting an organ with a particular strain of ,,hiv into a recipient with a different strain of ,,hiv2 7#b7 if the ,secretary determines under paragraph 7#a7 that such results warrant revision of the standards of quality adopted under section #cgb7;b77#b77;,e7 with respect to donated organs infected with ,,hiv and with respect to transplanting an organ with a particular strain of ,,hiv into a recipient with a different strain of ,,hiv1 direct the ,organ ,procurement and ,transplantation ,network to revise such standards1 consistent with section #cgb and in a way that ensures the changes will not reduce the safety of organ transplantation2 and 7#c7 in conjunction with any revision of such standards under paragraph 7#b71 revise section #aba4f of title #db1 ,code of ,federal ,regulations 7or any successor regulations74 4 #c4 ,conforming amendment to title #ah of the ,united ,states ,code ,section #aabb7;a7 of title #ah1 ,united ,states ,code1 is amended by inserting or in accordance with all applicable guidelines and regulations made by the ,secretary of ,health and ,human ,services under section #cgg;,e of the ,public ,health ,service ,act after research or testing4 ,passed the ,senate ,june #ag1 #bjac4 ,secretary
