,committee on ,energy and ,natural ,resources ,a ,,bill ,to establish the ,hurricane ,sand ,dunes ,national ,recreation ,area in the ,state of ,utah1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,hurricane ,sand ,dunes ,national ,recreation ,area ,act of #bjad4 #b4 ,definitions ,in this ,act3 7#a7 ,federal land ,the term ,federal land means land owned and managed by the ,bureau of ,land ,management in ,washington ,county in the ,state4 7#b7 ,map ,the term map means the map prepared by the ,bureau of ,land ,management entitled ,hurricane ,sand ,dunes ,national ,recreation ,area and dated ,november #ad1 #bjad4 7#c7 ,non-,federal land ,the term non-,federal land means the ,state land identified on the map as ,state land4 7#d7 ,proposed exchange parcel ,the term proposed exchange parcel means the approximately #a1bje acres of ,bureau of ,land ,management land identified on the map as ,proposed ,exchange ,parcel4 7#e7 ,recreation area ,the term ,recreation ,area means the ,hurricane ,sand ,dunes ,national ,recreation ,area established by section #c7;a74 7#f7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#g7 ,state ,the term ,state means the ,state of ,utah4 #c4 ,hurricane ,sand ,dunes ,national ,recreation ,area1 ,utah 7a7 ,designation ,there is established in the ,state the ,hurricane ,sand ,dunes ,national ,recreation ,area to provide for-- 7#a7 the enhancement of recreational uses2 and 7#b7 the use of off-highway vehicles4 7b7 ,boundary 7#a7 ,in general ,the ,recreation ,area shall consist of the approximately #ah1ddg acres of ,bureau of ,land ,management land in the ,state identified on the map as ,open ,,ohv ,area4 7#b7 ,exclusion ,the proposed exchange parcel shall be excluded from the ,recreation ,area4 7c7 ,administration of ,recreation ,area and proposed exchange parcel ,the ,secretary1 acting through the ,director of the ,bureau of ,land ,management1 shall-- 7#a7 administer the ,recreation ,area and proposed exchange parcel-- 7,a7 in accordance with-- 7i7 the applicable ,federal laws 7including regulations7 and rules applicable to the ,bureau of ,land ,management2 and 7ii7 applicable land use plans2 and 7,b7 consistent with the administration of the ,sand ,mountain ,open ,,ohv ,area1 as in existence on the day before the date of enactment of this ,act2 and 7#b7 only allow uses of the ,recreation ,area that are consistent with the purposes described in subsection 7a74 7d7 ,fish and wildlife ,nothing in this section affects the jurisdiction or responsibilities of the ,state with respect to fish and wildlife in the ,state4 7e7 ,adjacent management ,nothing in this section creates any protective perimeter or buffer zone around the ,recreation ,area4 7f7 ,use of off-,highway vehicles ,the land described in subsection 7b77#a7 shall remain open1 in perpetuity1 to the use of off-highway vehicles4 #d4 ,exchange of ,federal land and non-,federal land 7a7 ,in ,general ,if the ,state offers to convey to the ,united ,states title to the non-,federal land1 the ,secretary shall-- 7#a7 accept the offer2 and 7#b7 on receipt of all right1 title1 and interest in and to the non-,federal land1 convey to the ,state all right1 title1 and interest of the ,united ,states in and to the ,federal land4 7b7 ,valid ,existing ,rights ,the exchange authorized under subsection 7a7 shall be subject to valid existing rights4 7c7 ,title approval ,title to the ,federal land and non-,federal land to be exchanged under this section shall be in a format acceptable to the ,secretary and the ,state4 7d7 ,appraisals 7#a7 ,in general ,the value of the ,federal land and the non-,federal land to be exchanged under this section shall be determined by appraisals conducted by #a or more independent appraisers retained by the ,state1 with the consent of the ,secretary4 7#b7 ,applicable law ,the appraisals under paragraph 7#a7 shall be conducted in accordance with nationally recognized appraisal standards1 including1 as appropriate1 the ,uniform ,appraisal ,standards for ,federal ,land ,acquisitions4 7#c7 ,approval ,the appraisals conducted under paragraph 7#a7 shall be submitted to the ,secretary and the ,state for approval4 7e7 ,equal value exchange 7#a7 ,in general ,the value of the ,federal land and non-,federal land to be exchanged under this section-- 7,a7 shall be equal2 or 7,b7 shall be made equal in accordance with paragraph 7#b74 7#b7 ,equalization 7,a7 ,surplus of ,federal land ,if the value of the ,federal land exceeds the value of the non-,federal land1 the value of the ,federal land and non-,federal land shall be equalized1 as determined to be appropriate and acceptable by the ,secretary and the ,state-- 7i7 by reducing the acreage of the ,federal land to be conveyed2 or 7ii7 by adding additional ,state land to the non-,federal land to be conveyed4 7,b7 ,surplus of non-,federal land ,if the value of the non-,federal land exceeds the value of the ,federal land1 the value of the ,federal land and non-,federal land shall be equalized by reducing the acreage of the non-,federal land to be conveyed1 as determined to be appropriate and acceptable by the ,secretary and the ,state4 7f7 ,status and management of non-,federal land ,on conveyance to the ,secretary1 the non-,federal land shall1 in accordance with section #bjf7;c7 of the ,federal ,land ,policy ,act of #aigf 7#dc ,u4,s4,c4 #agaf7;c771 be added to1 and administered by the ,secretary as part of1 the ,recreation ,area4
