limitations 7a7 ,in general ,section #ajja of the ,food ,security ,act of #aihe 7#g ,u4,s4,c4 #acjh7 is amended-- 7#a7 in subsection 7a71 by striking paragraph 7#c7 and inserting the following3 7#c7 ,legal entity 7,a7 ,in general ,the term legal entity means-- 7i7 an organization that 7subject to the requirements of this section and section #ajja;,a7 is eligible to receive a payment under a provision of law referred to in subsection 7b71 7c71 or 7d72 7ii7 a corporation1 joint stock company1 association1 limited partnership1 limited liability company1 limited liability partnership1 charitable organization1 estate1 irrevocable trust1 grantor of a revocable trust1 or other similar entity 7as determined by the ,secretary72 and 7iii7 an organization that is participating in a farming operation as a partner in a general partnership or as a participant in a joint venture4 7,b7 ,exclusion ,the term legal entity does not include a general partnership or joint venture4 2 7#b7 by striking subsections 7b7 through 7d7 and inserting the following3 7b7 ,limitation on payments for covered commodities and peanuts ,the total amount of payments received1 directly or indirectly1 by a person or legal entity for any crop year for #a or more covered commodities and peanuts under title ,i of the ,food1 ,conservation1 and ,energy ,act of #bjjh 7#g ,u4,s4,c4 #hgja et seq47 7or a successor provision7 may not exceed #abe1jjj1 of which-- 7#a7 not more than #ge1jjj may consist of marketing loan gains and loan deficiency payments under subtitle ,b or ,c of title ,i of the ,food1 ,conservation1 and ,energy ,act of #bjjh 7#g ,u4,s4,c4 #hgca et seq47 7or a successor provision72 and 7#b7 not more than #ej1jjj may consist of any other payments made for covered commodities and peanuts under title ,i of the ,food1 ,conservation1 and ,energy ,act of #bjjh 7#g ,u4,s4,c4 #hgjb et seq47 7or a successor provision74 7c7 ,spousal equity 7#a7 ,in general ,notwithstanding subsection 7b71 except as provided in paragraph 7#b71 if a person and the spouse of the person are covered by paragraph 7#b7 and receive1 directly or indirectly1 any payment or gain covered by this section1 the total amount of payments or gains 7as applicable7 covered by this section that the person and spouse may jointly receive during any crop year may not exceed an amount equal to twice the applicable dollar amounts specified in subsection 7b74 7#b7 ,exceptions 7,a7 ,separate farming operations ,in the case of a married couple in which each spouse1 before the marriage1 was separately engaged in an unrelated farming operation1 each spouse shall be treated as a separate person with respect to a farming operation brought into the marriage by a spouse1 subject to the condition that the farming operation shall remain a separate farming operation1 as determined by the ,secretary4 7,b7 ,election to receive separate payments ,a married couple may elect to receive payments separately in the name of each spouse if the total amount of payments and benefits described in subsection 7b7 that the married couple receives1 directly or indirectly1 does not exceed an amount equal to twice the applicable dollar amounts specified in those subsections4 2 7#c7 in paragraph 7#c77;,b7 of subsection 7f71 by adding at the end the following3 7iii7 ,irrevocable trusts ,in promulgating regulations to define the term legal entity as the term applies to irrevocable trusts1 the ,secretary shall ensure that irrevocable trusts are legitimate entities that have not been created for the purpose of avoiding a payment limitation4 2 and 7#d7 in subsection 7h71 in the second sentence1 by striking or other entity and inserting or legal entity4 7b7 ,conforming amendments 7#a7 ,section #ajja of the ,food ,security ,act of #aihe 7#g ,u4,s4,c4 #acjh7 is amended-- 7,a7 in subsection 7e71 by striking subsections 7b7 and 7c7 each place it appears in paragraphs 7#a7 and 7#c77;,b7 and inserting subsection 7b72 7,b7 in subsection 7f7-- 7i7 in paragraph 7#b71 by striking ,subsections 7b7 and 7c7 and inserting ,subsection 7b72 7ii7 in paragraph 7#d77;,b71 by striking subsection 7b7 or 7c7 and inserting subsection 7b72 7iii7 in paragraph 7#e7-- 7,i7 in subparagraph 7,a71 by striking subsection 7d72 and 7,,ii7 in subparagraph 7,b71 by striking subsection 7b71 7c71 or 7d7 and inserting #acjh-a7 is amended-- 7,a7 in subsection 7a71 by striking subsections 7b7 and 7c7 of section #ajja and inserting section #ajja7;b72 and 7,b7 in subsection 7b77#a71 by striking subsection 7b7 or 7c7 of section #ajja and inserting section #ajja7;b74 7#c7 ,section #ajja;,b7a7 of the ,food ,security ,act of #aihe 7#g ,u4,s4,c4 #acjh-b7;a77 is amended in the matter preceding paragraph 7#a7 by striking subsections 7b7 and 7c7 of section #ajja and inserting section #ajja7;b74 7c7 ,application ,the amendments made by this section shall apply beginning with the #bjad crop year4 #c4 ,payments limited to active farmers ,section #ajja;,a of the ,food ,security ,act of #aihe 7#g ,u4,s4,c4 #acjh-a7 is amended-- 7#a7 in subsection 7b77#b7-- 7,a7 by striking or active personal management each place it appears in subparagraphs 7,a77i77,,ii7 and 7,b77ii72 and 7,b7 in subparagraph 7,c71 by striking 1 as applied to the legal entity1 are met by the legal entity1 the partners or members making a significant contribution of personal labor or active personal management and inserting are met by partners or members making a significant contribution of personal labor1 those partners or members2 and 7#b7 in subsection 7c7-- 7,a7 in paragraph 7#a7-- 7i7 by striking subparagraph 7,a7 and inserting the following3 7,a7 the landowner share-rents the land at a rate that is usual and customary2 2 7ii7 in subparagraph 7,b71 by striking the period at the end and inserting 2 and2 and 7iii7 by adding at the end the following3 7,c7 the share of the payments received by the landowner is commensurate with the share of the crop or income received as rent4 2 7,b7 in paragraph 7#b77;,a71 by striking active personal management or2 7,c7 in paragraph 7#e7-- 7i7 by striking 7#e7 and all that follows through 7,a7 ,in general4--,a person and inserting the following3 7#e7 ,custom farming services ,a person 2 7ii7 by inserting under usual and customary terms after services2 and 7iii7 by striking subparagraph 7,b72 and 7,d7 by adding at the end the following3 7#g7 ,farm managers ,a person who otherwise meets the requirements of this subsection other than 7b77#b77;,a77i77,,ii7 shall be considered to be actively engaged in farming1 as determined by the ,secretary1 with respect to the farming operation1 including a farming operation that is a sole proprietorship1 a legal entity such as a joint venture or general partnership1 or a legal entity such as a corporation or limited partnership1 if the person-- 7,a7 makes a significant contribution of management to the farming operation necessary for the farming operation1 taking into account-- 7i7 the size and complexity of the farming operation2 and 7ii7 the management requirements normally and customarily required by similar farming operations2 7,b7 7i7 is the only person in the farming operation qualifying as actively engaged in farming by using the farm manager special class designation under this paragraph2 and 7ii7 together with any other persons in the farming operation qualifying as actively engaged in farming under subsection 7b77#b7 or as part of a special class under this subsection1 does not collectively receive1 directly or indirectly1 an amount equal to more than the applicable limits under section #ajja7;b72 7,c7 does not use the management contribution under this paragraph to qualify as actively engaged in more than #a farming operation2 and 7,d7 manages a farm operation that does not substantially share equipment1 labor1 or management with persons or legal entities that with the person collectively receive1 directly or indirectly1 an amount equal to more than the applicable limits under section #ajja7;b74 4
