title ,this ,act may be cited as the ,down ,payment to ,protect ,national ,security ,act of #bjac4 #b4 ,reduction in the number of ,federal employees 7a7 ,definition ,in this section1 the term agency means an executive agency as defined under section #aje of title #e1 ,united ,states ,code4 7b7 ,determination of number of employees ,not later than #fj days after the date of enactment of this ,act1 the ,director of the ,office of ,management and ,budget shall determine the number of full-time employees employed in each agency4 ,the head of each agency shall cooperate with the ,director of the ,office of ,management and ,budget in making the determinations4 7c7 ,replacement hire rate 7#a7 ,in general ,during the period described under paragraph 7#b71 the head of each agency may hire no more than #a employee in that agency for every #c employees who leave employment in that agency4 7#b7 ,period of replacement hire rate ,paragraph 7#a7 shall apply to each agency during the period beginning #fj days after the date of enactment of this ,act through the date on which the ,director of the ,office of ,management and ,budget makes a determination that the number of full-time employees employed in that agency is #aj percent less than the number of full-time employees employed in that agency determined under subsection 7a74 7d7 ,waivers ,this section may be waived upon a determination by the ,president that-- 7#a7 the existence of a state of war or other national security concern so requires2 or 7#b7 the existence of an extraordinary emergency threatening life1 health1 public safety1 property1 or the environment so requires4 #c4 ,reduction of discretionary spending limits to achieve savings from ,federal employee provisions ,paragraphs 7#b7 through 7#aj7 of for funding of ,department of ,defense under continuing resolution consistent with amounts authorized by ,national ,defense ,authorization ,act for fiscal year #bjac 7a7 ,in general ,in accordance with subsection 7b71 the ,secretary of ,defense may transfer amounts appropriated for the ,department of ,defense by the ,continuing ,appropriations ,resolution 7,public ,law #aab-age7 among accounts of the ,department of ,defense4 7b7 ,transfers consistent with amounts appropriated or authorized ,in the event of any transfers under subsection 7a71 the total amount in any account of the ,department of ,defense that is available for obligation and expenditure in fiscal year #bjac shall be consistent with1 and may not exceed-- 7#a7 if a regular appropriation ,act making appropriations for the ,department of ,defense for fiscal year #bjac is enacted before the date of the transfer1 the level provided for that account for that fiscal year by applicable provisions of such ,act2 or 7#b7 if no such ,act is enacted before the date of the transfer1 the amount authorized to be appropriated for that account for that fiscal year by applicable provisions of division ,a of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjac 7,public ,law #aab-bci74 7c7 ,notice to congress ,not later than #ae days before any transfer under subsection 7a71 the ,secretary of ,defense shall submit to the congressional defense committees a report setting forth a description of the transfer1 including the amount of the transfer and the accounts from and to which the funds were transferred4 7d7 ,transfer subject to notification requirements ,in addition to the notice required under subsection 7c71 a transfer under subsection 7a7 shall be subject to the applicable notification requirements for reprogramming in division ,a of ,public ,law #aab-gd4 7e7 ,transfer authority ,the transfer authority provided by subsection 7a7 is in addition to any other transfer authority provided by law4 7f7 ,definition ,in this section1 the term congressional defense committees has the meaning given that term in section #aja7;a77#af7 of title #aj1 ,united ,states ,code4 #f4 ,no cost-of-living adjustments for ,members of ,congress ,notwithstanding any other provision of law1 no adjustment shall be made under section #fja7;a7 of the ,legislative ,reorganization ,act of #aidf 7#b ,u4,s4,c4 #ca7 7relating to cost-of-living adjustments for ,members of ,congress7 for any fiscal year for which the ,congressional ,budget ,office determines there is a ,federal budget deficit4
