#aacth ,,congress #ast ,session ,s4 #be ,,an ,,act ,to direct the ,secretary of the ,interior to convey certain ,federal features of the electric distribution system to the ,south ,utah ,valley ,electric ,service ,district1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,south ,utah ,valley ,electric ,conveyance ,act4 #b4 ,definitions ,in this ,act3 7#a7 ,district ,the term ,district means the ,south ,utah ,valley ,electric ,service ,district1 organized under the laws of the ,state of ,utah4 7#b7 ,electric distribution system ,the term ,electric ,distribution ,system means fixtures1 irrigation1 or power facilities lands1 distribution fixture lands1 and shared power poles4 7#c7 ,fixtures ,the term fixtures means all power poles1 cross-members1 wires1 insulators and associated fixtures1 including substations1 that-- 7,a7 comprise those portions of the ,strawberry ,valley ,project power distribution system that are rated at a voltage of #ab4e kilovolts and were constructed with ,strawberry ,valley ,project revenues2 and 7,b7 any such fixtures that are located on ,federal lands and interests in lands4 7#d7 ,irrigation or power facilities lands ,the term irrigation or power facilities lands means all ,federal lands and interests in lands where the fixtures are located on the date of the enactment of this ,act and which are encumbered by other ,strawberry ,valley ,project irrigation or power features1 including lands underlying the ,strawberry ,substation4 7#e7 ,distribution fixture lands ,the term distribution fixture lands means all ,federal lands and interests in lands where the fixtures are located on the date of the enactment of this ,act and which are unencumbered by other ,strawberry ,valley ,project features1 to a maximum corridor width of #cj feet on each side of the centerline of the fixtures' power lines as those lines exist on the date of the enactment of this ,act4 7#f7 ,shared power poles ,the term shared power poles means poles that comprise those portions of the ,strawberry ,valley ,project ,power ,transmission ,system1 that are rated at a voltage of #df4j-kilovolts1 are owned by the ,united ,states1 and support fixtures of the ,electric ,distribution ,system4 7#g7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 #c4 ,conveyance of ,electric ,distribution ,system 7a7 ,in general ,inasmuch as the ,strawberry ,water ,users ,association conveyed its interest1 if any1 in the ,electric ,distribution ,system to the ,district by a contract dated ,april #g1 #aihf1 and in consideration of the ,district assuming from the ,united ,states all liability for administration1 operation1 maintenance1 and replacement of the ,electric ,distribution ,system1 the ,secretary shall1 as soon as practicable after the date of enactment of this ,act and in accordance with applicable law1 convey and assign to the ,district without charge or further consideration-- 7#a7 all of the ,united ,states right1 title1 and interest in and to-- 7,a7 all fixtures owned by the ,united ,states as part of the ,electric ,distribution ,system2 and 7,b7 the distribution fixture land2 7#b7 license for use in perpetuity of the shared power poles to continue to own1 operate1 maintain1 and replace ,electric ,distribution ,fixtures attached to the shared power poles2 and 7#c7 licenses for use and for access in perpetuity for purposes of operation1 maintenance1 and replacement across1 over1 and along-- 7,a7 all project lands and interests in irrigation and power facilities lands where the ,electric ,distribution ,system is located on the date of the enactment of this ,act that are necessary for other ,strawberry ,valley ,project facilities 7the ownership of such underlying lands or interests in lands shall remain with the ,united ,states71 including lands underlying the ,strawberry ,substation2 and 7,b7 such corridors where ,federal lands and interests in lands-- 7i7 are abutting public streets and roads2 and 7ii7 can provide access that will facilitate operation1 maintenance1 and replacement of facilities4 7b7 ,compliance with environmental laws 7#a7 ,in general ,before conveying lands1 interest in lands1 and fixtures under subsection 7a71 the ,secretary shall comply with all applicable requirements under-- 7,a7 the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq472 7,b7 the ,endangered ,species ,act of #aigc 7#af ,u4,s4,c4 #aeca et seq472 and 7,c7 any other law applicable to the land and facilities4 7#b7 ,effect ,nothing in this ,act modifies or alters any obligations under-- 7,a7 the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq472 or 7,b7 the ,endangered ,species ,act of #aigc 7#af ,u4,s4,c4 #aeca et seq474 7c7 ,power ,generation and #dfk,v ,transmission ,facilities ,excluded ,except for the uses as granted by license in ,shared ,power ,poles under section #c7;a77#b71 nothing in this ,act shall be construed to grant or convey to the ,district or any other party1 any interest in any facilities shared or otherwise that comprise a portion of the ,strawberry ,valley ,project power generation system or the federally owned portions of the #df kilovolt transmission system which ownership shall remain in the ,united ,states4 #d4 ,effect of conveyance ,on conveyance of any land or facility under section #c7;a77#a7-- 7#a7 the conveyed and assigned land and facilities shall no longer be part of a ,federal reclamation project2 7#b7 the ,district shall not be entitled to receive any future ,bureau or ,reclamation benefits with respect to the conveyed and assigned land and facilities1 except for benefits that would be available to other non-,bureau of ,reclamation facilities2 and 7#c7 the ,united ,states shall not be liable for damages arising out of any act1 omission1 or occurrence relating to the land and facilities1 including the transaction of ,april #g1 #aihf1 between the ,strawberry ,water ,users ,association and the ,strawberry ,electric ,service ,district4 #e4 ,report ,if a conveyance required under section #c is not completed by the date that is #a year after the date of the enactment of this ,act1 the ,secretary shall1 not later than #cj days after that date1 submit to ,congress a report that-- 7#a7 describes the status of the conveyance2 7#b7 describes any obstacles to completing the conveyance2 and 7#c7 specifies an anticipated date for completion of the conveyance4 ,passed the ,senate ,june #ai1 #bjac4 ,secretary
