provide for the establishment of a fund 
to provide for an expanded and sustained
 national investment in biomedical      
research4  #a4 ,short title  ,this ,act 
may be cited as the ,american ,cures    
,act4  #b4 ,biomedical ,research ,fund  
7a7 ,purpose ,it is the purpose of this 
section to establish a ,biomedical      
,research ,fund 7referred to in this    
section as the ,fund71 to be            
administered by the ,secretary of the   
,treasury1 to provide for an expanded   
and sustained national investment in    
biomedical research through the programs

 and agencies described in subsection   
7b77#b74  7b7 ,use of fund  7#a7 ,in    
general ,for each fiscal year1 amounts  
shall be transferred from the ,fund to  
the accounts related to the programs and
 agencies described in paragraph 7#b7 to
 ensure that funding for such programs  
and agencies for such fiscal year does  
not fall below #aje percent of the level
 of funding provided for the fiscal year
 immediately preceding the fiscal year  
for which the determination is being    
made and an additional amount to account
 for any increases in the ,gross        
,domestic ,product for the year         
involved4  7#b7 ,agencies ,the programs 
and agencies described in this paragraph
 are the following3 7,a7 ,the ,national 
,institutes of ,health4  7,b7 ,the      
,centers for ,disease ,control and      
,prevention4  7,c7 ,the ,department of  
,defense health program4  7,d7 ,the     
medical and prosthetics research program
 of the ,department of ,veterans        
,affairs4  7c7 ,minimum continued       

funding requirement ,amounts            
appropriated for each of the programs   
and agencies described in subsection    
7b77#b7 for a fiscal year shall not be  
less than the amounts appropriated for  
such programs and agencies for fiscal   
year #bjad4  7d7 ,funding ,there are    
hereby authorized to be appropriated1   
and appropriated1 to the ,fund1 out of  
any monies in the ,treasury not         
otherwise appropriated1 such sums as may
 be necessary in each fiscal year to    
enable the transfers to be made in      
accordance with subsection 7b77#a74  7e7
 ,transfer authority ,the ,committee on 
,appropriations of the ,senate and the  
,committee on ,appropriations of the    
,house of ,representatives may provide  
for the transfer of funds in the ,fund  
to eligible programs and agencies under 
this section1 subject to subsection 7b74
  7f7 ,exemption of certain payments    
from sequestration  7#a7 ,in general    
,section #bee7;g77#a77;,a7 of the       
,balanced ,budget and ,emergency        

,deficit ,control ,act 7#b ,u4,s4,c4    
#ije7;g77#a77;,a77 is amended by        
inserting after ,advances to the        
,unemployment ,trust ,fund and ,other   
,funds 7#af-jcbg-j-a-fjj74 the          
following3  ,biomedical ,research ,fund4
  4  7#b7 ,applicability ,the amendment 
made by this section shall apply to any 
sequestration order issued under the    
,balanced ,budget and ,emergency        
,deficit ,control ,act of #aihe 7#b     
,u4,s4,c4 #ijj et seq47 on or after the 
date of enactment of this ,act4
