eligibility assessment activities include an assessment of why the individual is still unemployed and the actions that the individual must undertake in order to improve their employment prospects 7#a7 ,in general ,section #djja7;i77#b77;,a77ii7 of the ,supplemental ,appropriations ,act1 #bjjh 7,public ,law #aaj-beb2 #bf ,u4,s4,c4 #ccjd note7 is amended by inserting and an assessment of the reasons why the individual continues to be unemployed and the actions that the individual must undertake in order to improve their employment prospects 7including through enrollment in a job retraining program under subsection 7k77#a7 if the ,state has made the election under such section7 before the semicolon at the end4 7#b7 ,effective date ,the amendment made by this subsection shall apply on and after the date of the enactment of this ,act4 7b7 ,state option to require that an individual participate in a job retraining program or perform community service in order to be eligible to receive emergency unemployment compensation 7#a7 ,in general ,section #djja of the ,supplemental ,appropriations ,act1 #bjjh 7,public ,law #aaj-beb2 #bf ,u4,s4,c4 #ccjd note7 is amended by adding at the end the following new subsection3 7k7 ,state option to require that an individual participate in a job retraining program or perform community service as a condition of receiving emergency unemployment compensation 7#a7 ,in general ,under an agreement under subsection 7a71 a ,state may elect to require an individual1 as a condition of eligibility for emergency unemployment compensation for any week1 to meet the following for such week3 7,a7 ,participate in a ,state-approved job retraining program ,the individual is participating in a job retraining program approved by the ,state during such week4 7,b7 ,perform community service if the ,state determines that a job training program is not appropriate ,if the ,state determines that participation in a program under subparagraph 7,a7 for such week is not appropriate for the individual1 in lieu of such participation the individual performs at least #bj hours of community service during such week4 ,for purposes of the preceding sentence1 the term community service means unpaid service by an individual to an organization described in section #eja7;c77#c7 of the ,internal ,revenue ,code of #aihf or to a ,federal1 ,state1 or local agency 7as permitted in accordance with applicable ,federal1 ,state1 and local law74 7#b7 ,application ,if the ,state makes the election under paragraph 7#a7-- 7,a7 such election shall apply with respect to all claimants for emergency unemployment in the ,state2 and 7,b7 the services and activities under subsection 7i7 with respect to an individual1 including the assessments under paragraph 7#b77;,a77ii7 of such subsection1 are required to begin prior to the individual receiving emergency unemployment compensation under this title4 7#c7 ,information ,if the ,state makes the election under paragraph 7#a71 an individual shall provide the ,state agency with such information as the ,state agency may require to ensure the individual is meeting the requirement under paragraph 7#a7 for a week4 4 7#b7 ,effective date ,the amendment made by this subsection shall apply to weeks of unemployment beginning on or after the date of the enactment of this ,act4 #h4 ,requirement that individuals receiving emergency unemployment compensation be actively engaged in a systematic and sustained effort to obtain suitable work 7a7 ,in general ,subsection 7h7 of section #djja of the ,supplemental ,appropriations ,act1 #bjjh 7,public ,law #aaj-beb2 #bf ,u4,s4,c4 #ccjd note7 is amended to read as follows3 7h7 ,actively seeking work 7#a7 ,in general ,for purposes of subsection 7b77#d71 payment of emergency unemployment compensation shall not be made to any individual for any week of unemployment-- 7,a7 during which the individual fails to accept any offer of suitable work 7as defined in paragraph 7#c77 or fails to apply for any suitable work to which the individual was referred by the ,state agency2 or 7,b7 during which the individual fails to actively engage in seeking work1 unless such individual is not actively engaged in seeking work because such individual is1 as determined in accordance with ,state law-- 7i7 before any court of the ,united ,states or any ,state pursuant to a lawfully issued summons to appear for jury duty 7as such term may be defined by the ,secretary72 or 7ii7 hospitalized for treatment of an emergency or a life-threatening condition 7as such term may be defined by the ,secretary71 if such exemptions in clauses 7i7 and 7ii7 apply to recipients of regular benefits1 and the ,state chooses to apply such exemptions for recipients of emergency unemployment benefits4 7#b7 ,period of ineligibility ,if any individual is ineligible for emergency unemployment compensation for any week by reason of a failure described in subparagraph 7,a7 or 7,b7 of paragraph 7#a71 the individual shall be ineligible to receive emergency unemployment compensation for any week which begins during a period which-- 7,a7 begins with the week following the week in which such failure occurs2 and 7,b7 does not end until such individual has been employed during at least #d weeks which begin after such failure and the total of the remuneration earned by the individual for being so employed is not less than the product of #d multiplied by the individual's average weekly benefit amount for the individual's benefit year4 7#c7 ,suitable work ,for purposes of this subsection1 the term suitable work means1 with respect to any individual1 any work which is within such individual's capabilities1 except that1 if the individual furnishes evidence satisfactory to the ,state agency that such individual's prospects for obtaining work in his customary occupation within a reasonably short period are good1 the determination of whether any work is suitable work with respect to such individual shall be made in accordance with the applicable ,state law4 7#d7 ,exception ,extended compensation shall not be denied under subparagraph 7,a7 of paragraph 7#a7 to any individual for any week by reason of a failure to accept an offer of1 or apply for1 suitable work-- 7,a7 if the gross average weekly remuneration payable to such individual for the position does not exceed the sum of-- 7i7 the individual's average weekly benefit amount for his benefit year1 plus 7ii7 the amount 7if any7 of supplemental unemployment compensation benefits 7as defined in section #eja7;c77#ag77;,d7 of the ,internal ,revenue ,code of #aihf7 payable to such individual for such week2 7,b7 if the position was not offered to such individual in writing and was not listed with the ,state employment service2 7,c7 if such failure would not result in a denial of compensation under the provisions of the applicable ,state law to the extent that such provisions are not inconsistent with the provisions of paragraphs 7#c7 and 7#e72 or 7,d7 if the position pays wages less than the higher of-- 7i7 the minimum wage provided by section #f7;a77#a7 of the ,fair ,labor ,standards ,act of #aich1 without regard to any exemption2 or 7ii7 any applicable ,state or local minimum wage4 7#e7 ,actively engaged in seeking work ,for purposes of this subsection1 an individual shall be treated as actively engaged in seeking work during any week if-- 7,a7 the individual has engaged in a systematic and sustained effort to obtain work during such week1 and 7,b7 the individual provides tangible evidence to the ,state agency that he has engaged in such an effort during such week4 7#f7 ,referral ,the ,state agency shall provide for referring applicants for emergency unemployment benefits to any suitable work to which paragraph 7#d7 would not apply4 4 7b7 ,effective date ,the amendments made by this section shall take effect on the date of the enactment of this ,act4 #i4 ,ending unemployment payments to jobless millionaires and billionaires 7a7 ,prohibition ,notwithstanding any other provision of law1 no ,federal funds may be used to make payments of unemployment compensation 7including such compensation under the ,federal-,state ,extended ,compensation ,act of #aigj and the emergency unemployment compensation program under title ,,iv of the ,supplemental ,appropriations ,act1 #bjjh7 to an individual whose adjusted gross income in the preceding year was equal to or greater than #a1jjj1jjj4 7b7 ,compliance ,unemployment ,insurance applications shall include a form or procedure for an individual applicant to certify the individual's adjusted gross income was not equal to or greater than #a1jjj1jjj in the preceding year4 7c7 ,audits ,the certifications required by subsection 7b7 shall be auditable by the ,u4,s4 ,department of ,labor or the ,u4,s4 ,government ,accountability ,office4 7d7 ,status of applicants ,it is the duty of the states to verify the residency1 employment1 legal1 and income status of applicants for ,unemployment ,insurance and no ,federal funds may be expended for purposes of determining an individual's eligibility under this ,act4 7e7 ,effective date ,the prohibition under subsection 7a7 shall apply to weeks of unemployment beginning on or after the date of the enactment of this ,act4 #aj4 ,consolidations of relevant job training programs and activities 7a7 ,report ,the ,secretary of ,labor1 in coordination with the ,director of the ,office of ,management and ,budget1 shall prepare a report on the consolidations of ,federal job training programs and activities determined to be unnecessarily duplicative 7referred to in this section as relevant job training programs and activities74 ,such report shall-- 7#a7 describe all ,federal job training programs and activities2 7#b7 propose consolidations of the relevant job training programs and activities2 7#c7 provide a justification for those ,federal job training programs and activities not included in such consolidations2 and 7#d7 establish a plan to provide for such consolidations1 including recommendations for necessary legislation4 7b7 ,submission ,not later than #c months after the date of enactment of this ,act1 the ,secretary of ,labor shall submit the report to the appropriate committees of ,congress4 #aa4 ,funding stabilization 7a7 ,funding stabilization under the ,internal ,revenue ,code ,the table in subclause 7,,ii7 of section #dcj7;h77#b77;,c77iv7 of the ,internal ,revenue ,code of #aihf is amended to read as follows3 ,if of #aihf is amended by striking of such plan and inserting of such plan 7determined by not taking into account any adjustment of segment rates under section #dcj7;h77#b77;,c77iv774 7#b7 ,employee ,retirement ,income ,security ,act of #aigd ,the second sentence of subparagraph 7,b7 of section #bjf7;g77#c7 of the ,employee ,retirement ,income ,security ,act of #aigd 7#bi ,u4,s4,c4 #ajef7;g77#c77;,b77 is amended by striking of such plan and inserting of such plan 7determined by not taking into account any adjustment of segment rates under section #cjc7;h77#b77;,c77iv774 7#c7 ,effective date 7,a7 ,in general ,except as provided in subparagraph 7,b71 the amendments made by this subsection shall apply to plan years beginning after ,december #ca1 #bjad4 7,b7 ,collectively bargained plans ,in the case of a plan maintained pursuant to #a or more collective bargaining agreements1 the amendments made by this subsection shall apply to plan years beginning after ,december #ca1 #bjae4 7#d7 ,provisions relating to plan amendments 7,a7 ,in general ,if this paragraph applies to any amendment to any plan or annuity contract1 such plan or contract shall be treated as being operated in accordance with the terms of the plan during the period described in subparagraph 7,b77ii74 7,b7 ,amendments to which paragraph applies 7i7 ,in general ,this paragraph shall apply to any amendment to any plan or annuity contract which is made-- 7,i7 pursuant to the amendments made by this subsection1 or pursuant to any regulation issued by the ,secretary of the ,treasury or the ,secretary of ,labor under any provision as so amended1 and 7,,ii7 on or before the last day of the first plan year beginning on or after ,january #a1 #bjaf1 or such later date as the ,secretary of the ,treasury may prescribe4 7ii7 ,conditions ,this subsection shall not apply to any amendment unless1 during the period-- 7,i7 beginning on the date that the amendments made by this subsection or the regulation described in clause 7i77,i7 takes effect 7or in the case of a plan or contract amendment not required by such amendments or such regulation1 the effective date specified by the plan71 and 7,,ii7 ending on the date described in clause 7i77,,ii7 7or1 if earlier1 the date the plan or contract amendment is adopted71 the plan or contract is operated as if such plan or contract amendment were in effect1 and such plan or contract amendment applies retroactively for such period4 7,c7 ,anti-cutback relief ,a plan shall not be treated as failing to meet the requirements of section #bjd7;g7 of the ,employee ,retirement ,income ,security ,act of #aigd and section #daa7;d77#f7 of the ,internal ,revenue ,code of #aihf solely by reason of a plan amendment to which this paragraph applies4 7d7 ,modification of funding target determination periods 7#a7 ,internal ,revenue ,code of #aihf ,clause 7i7 of section #dcj7;h77#b77;,b7 of the ,internal ,revenue ,code of #aihf is amended by striking the first day of the plan year and inserting the valuation date for the plan year4 7#b7 ,employee ,retirement ,income ,security ,act of #aigd ,clause 7i7 of section #cjc7;h77#b77;,b7 of the ,employee ,retirement ,income ,security ,act of #aigd 7#bi ,u4,s4,c4 #ajhc7;h77#b77;,b77i77 is amended by striking the first day of the plan year and inserting the valuation date for the plan year4 7e7 ,effective date 7#a7 ,in general ,the amendments made by subsections 7a71 7b71 and 7d7 shall apply with respect to plan years beginning after ,december #ca1 #bjab4 7#b7 ,elections ,a plan sponsor may elect not to have the amendments made by subsections 7a71 7b71 and 7d7 apply to any plan year beginning before ,january #a1 #bjad1 either 7as specified in the election7-- 7,a7 for all purposes for which such amendments apply1 or 7,b7 solely for purposes of determining the adjusted funding target attainment percentage under sections #dcf of the ,internal ,revenue ,code of #aihf and #bjf7;g7 of the ,employee ,retirement ,income ,security ,act of #aigd for such plan year4 ,a plan shall not be treated as failing to meet the requirements of section #bjd7;g7 of such ,act and section #daa7;d77#f7 of such ,code solely by reason of an election under this paragraph4 #ab4 ,reduction in benefits based on receipt of unemployment compensation 7a7 ,in general ,title ,,ii of the ,social ,security ,act 7#db ,u4,s4,c4 #dja et seq47 is amended by inserting after section #bbd the following new section3 #bbd;,a ,reduction in benefits based on receipt of unemployment compensation 7a7 7#a7 ,if for any month prior to the month in which an individual attains retirement age 7as defined in section #baf7l77#a77-- 7,a7 such individual is entitled to benefits under section #bbc1 and 7,b7 such individual is entitled for such month to unemployment compensation1 the total of the individual's benefits under section #bbc for such month and of any benefits under section #bjb for such month based on the individual's wages and self-employment income shall be reduced 7but not below zero7 by the total amount of unemployment compensation received by such individual for such month4 7#b7 ,the reduction of benefits under paragraph 7#a7 shall also apply to any past-due benefits under section #bbc for any month in which the individual was entitled to-- 7,a7 benefits under such section1 and 7,b7 unemployment compensation4 7#c7 ,the reduction of benefits under paragraph 7#a7 shall not apply to any benefits under section #bbc for any month1 or any benefits under section #bjb for such month based on the individual's wages and self-employment income for such month1 if the individual is entitled for such month to unemployment compensation following a period of trial work 7as described in section #bbb7;c77#a71 participation in the ,ticket to ,work and ,self-,sufficiency ,program established under section #aadh1 or participation in any other program that is designed to encourage an individual entitled to benefits under section #bbc or #bjb to work4 7b7 ,if any unemployment compensation is payable to an individual on other than a monthly basis 7including a benefit payable as a lump sum to the extent that it is a commutation of1 or a substitute for1 such periodic compensation71 the reduction under this section shall be made at such time or times and in such amounts as the ,commissioner of ,social ,security 7referred to in this section as the ,commissioner7 determines will approximate as nearly as practicable the reduction prescribed by subsection 7a74 7c7 ,reduction of benefits under this section shall be made after any applicable reductions under section #bjc7;a7 and section #bbd1 but before any other applicable deductions under section #bjc4 7d7 7#a7 ,subject to paragraph 7#b71 if the ,commissioner determines that an individual may be eligible for unemployment compensation which would give rise to a reduction of benefits under this section1 the ,commissioner may require1 as a condition of certification for payment of any benefits under section #bbc to any individual for any month and of any benefits under section #bjb for such month based on such individual's wages and self-employment income1 that such individual certify-- 7,a7 whether the individual has filed or intends to file any claim for unemployment compensation1 and 7,b7 if the individual has filed a claim1 whether there has been a decision on such claim4 7#b7 ,for purposes of paragraph 7#a71 the ,commissioner may1 in the absence of evidence to the contrary1 rely upon a certification by the individual that the individual has not filed and does not intend to file such a claim1 or that the individual has so filed and no final decision thereon has been made1 in certifying benefits for payment pursuant to section #bje7;i74 7e7 ,whenever a reduction in total benefits based on an individual's wages and self-employment income is made under this section for any month1 each benefit1 except the disability insurance benefit1 shall first be proportionately decreased1 and any excess of such reduction over the sum of all such benefits other than the disability insurance benefit shall then be applied to such disability insurance benefit4 7f7 7#a7 ,notwithstanding any other provision of law1 the head of any ,federal agency shall provide such information within its possession as the ,commissioner may require for purposes of making a timely determination of the amount of the reduction1 if any1 required by this section in benefits payable under this title1 or verifying other information necessary in carrying out the provisions of this section4 7#b7 ,the ,commissioner is authorized to enter into agreements with ,states1 political subdivisions1 and other organizations that administer unemployment compensation1 in order to obtain such information as the ,commissioner may require to carry out the provisions of this section4 7g7 ,for purposes of this section1 the term unemployment compensation has the meaning given that term in section #he7;b7 of the ,internal ,revenue ,code of #aihf1 and the total amount of unemployment compensation to which an individual is entitled shall be determined prior to any applicable reduction under ,state law based on the receipt of benefits under section #bjb or #bbc4 4 7b7 ,conforming amendment ,section #bbd7;a7 of the ,social ,security ,act 7#db ,u4,s4,c4 #dbd;a7a77 is amended1 in the matter preceding paragraph 7#a71 by striking the age of #fe and inserting retirement age 7as defined in section #baf7l77#a774 7c7 ,effective date ,the amendments made by subsections 7a7 and 7b7 shall apply to benefits payable for months beginning on or after the date that is #ab months after the date of enactment of this section4 #ac4 ,extension of customs user fees ,section #acjca7;j77#c7 of the ,consolidated ,omnibus ,budget ,reconciliation ,act of #aihe 7#ai ,u4,s4,c4 #eh;c7j77#c77 is amended--
