,a ,,bill  ,to require the ,secretary to
 implement standards for short-term     
custody of individuals held in          
facilities of ,u4,s4 ,customs and       
,border ,protection and for other       
purposes4  #a4 ,short title ,this ,act  
may be cited as the ,humane ,short ,term
 ,custody ,act4  #b4 ,standards for     
short-term custody by ,u4,s4 ,customs   
and ,border ,protection  7a7 ,in general
 ,not later than #ahj days after the    
date of the enactment of this ,act1 the 
,secretary of ,homeland ,security shall1
 in consultation with the ,office for   
,civil ,rights and ,civil ,liberties of 
the ,department of ,homeland ,security1 
prescribe regulations establishing      

standards for short-term custody of     
individuals by ,u4,s4 ,customs and      
,border ,protection that provide for    
basic minimums of care at all facilities
 of ,u4,s4 ,customs and ,border         
,protection that hold individuals in    
custody1 including ,border ,patrol      
stations1 ports of entry1 checkpoints1  
forward operating bases1 secondary      
inspection areas1 and short-term custody
 facilities4  7b7 ,requirements  7#a7   
,in general ,the regulations prescribed 
under subsection 7a7 shall include      
standards with respect to the following3
 7,a7 ,limits on detention space        
capacity4  7,b7 ,the availability of    
potable water and food4  7,c7 ,access to
 bathroom facilities and hygiene items4 
7,d7 ,sleeping arrangements for         
detainees held overnight4  7,e7         
,adequate climate control4  7,f7 ,access
 to language-appropriate forms and      
materials that include an explanation of
 the consequences of signing such forms4
  7,g7 ,pregnant women and individuals  

with medical needs4  7,h7 ,reasonable   
accommodations in accordance with the   
,americans with ,disabilities ,act of   
#aiij 7#db ,u4,s4,c4 #abaja et seq474   
7,i7 ,access to emergency medical care1 
if necessary4  7,j7 ,access to          
facilities by nongovernmental           
organizations4  7,k7 ,transferring      
detainees to facilities of ,u4,s4       
,immigrations and ,customs ,enforcement4
  7,l7 ,returning personal property to  
former detainees4  7#b7 ,additional     
standards ,the ,secretary of ,homeland  
,security may prescribe such additional 
standards with respect to the short-term
 custody of individuals as the          
,secretary considers appropriate4  7#c7 
,consistency with the ,prison ,rape     
,elimination ,act of #bjjc ,the         
regulations prescribed under subsection 
7a7 shall be fully consistent with the  
national standards required under       
section #h7;c7 of the ,prison ,rape     
,elimination ,act of #bjjc 7#db         
,u4,s4,c4 #aefjg7;c774  7c7 ,inspections

 ,the ,inspector ,general of the        
,department of ,homeland ,security      
shall-- 7#a7 inspect the facilities     
described in subsection 7a7 not less    
frequently than annually2 and  7#b7 make
 the results of the inspections         
available to the public without the need
 to submit a request under section #eeb 
of title #e1 ,united ,states ,code4  7d7
 ,certification ,not later than #ah     
months after the issuance of the        
regulations required by subsection 7a71 
the ,secretary of ,homeland ,security   
shall certify to ,congress that the     
regulations have been fully implemented4
