microhydro project2 land exchange 7a7 ,definitions ,in this section3 7#a7 ,appurtenance ,the term appurtenance includes-- 7,a7 transmission lines2 7,b7 distribution lines2 7,c7 signs2 7,d7 buried communication lines2 7,e7 necessary access routes for microhydro project construction1 operation1 and maintenance2 and 7,f7 electric cables4 7#b7 ,kantishna ,hills area ,the term ,kantishna ,hills area means the area of the ,park located within #b miles of ,moose ,creek1 as depicted on the map4 7#c7 ,map ,the term map means the map entitled ,kantishna ,hills ,micro-,hydro ,area1 numbered #ahd_/hj1bgf1 and dated ,august #bg1 #bjaj4 7#d7 ,microhydro project 7,a7 ,in general ,the term microhydro project means a hydroelectric power generating facility with a maximum power generation capability of #ajj kilowatts4 7,b7 ,inclusions ,the term microhydro project includes-- 7i7 intake pipelines1 including the intake pipeline located on ,eureka ,creek1 approximately mile upstream from the ,park ,road1 as depicted on the map2 7ii7 each system appurtenance of the microhydro projects2 and 7iii7 any distribution or transmission lines required to serve the ,kantishna ,hills area4 7#e7 ,park ,the term ,park means the ,denali ,national ,park and ,preserve4 7#f7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7b7 ,permits for microhydro projects 7#a7 ,in general ,the ,secretary may issue permits for microhydro projects in the ,kantishna ,hills area4 7#b7 ,terms and conditions ,each permit under paragraph 7#a7 shall be-- 7,a7 issued in accordance with such terms and conditions as are generally applicable to rights-of-way within units of the ,national ,park ,system2 and 7,b7 subject to such other terms and conditions as the ,secretary determines to be necessary4 7#c7 ,completion of environmental analysis ,not later than #ahj days after the date on which an applicant submits an application for the issuance of a permit under this subsection1 the ,secretary shall complete any analysis required by the ,national ,environment ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq47 of any proposed or existing microhydro projects located in the ,kantishna ,hills area4 7c7 ,land exchange 7#a7 ,in general ,for the purpose of consolidating ownership of ,park and ,doyon ,tourism1 ,inc4 lands1 including those lands affected solely by the ,doyon ,tourism microhydro project1 and subject to paragraph 7#d71 the ,secretary may exchange ,park land near or adjacent to land owned by ,doyon ,tourism1 ,inc41 located at the mouth of ,eureka ,creek in sec4 #ac1 ,t4#af ,s41 ,r4 #ah ,w41 ,fairbanks ,meridian1 for approximately #ah acres of land owned by ,doyon ,tourism1 ,inc41 within the ,galena patented mining claim4 7#b7 ,map availability ,the map shall be on file and available for public inspection in the appropriate offices of the ,national ,park ,service4 7#c7 ,timing ,the ,secretary shall seek to complete the exchange under this subsection by not later than ,february #a1 #bjae4 7#d7 ,applicable laws2 terms and conditions ,the exchange under this subsection shall be subject to-- 7,a7 the laws 7including regulations7 and policies applicable to exchanges of land administered by the ,national ,park ,service1 including the laws and policies concerning land appraisals1 equalization of values1 and environmental compliance2 and 7,b7 such terms and conditions as the ,secretary determines to be necessary4 7#e7 ,equalization of values ,if the tracts proposed for exchange under this subsection are determined not to be equal in value1 an equalization of values may be achieved by adjusting the quantity of acres described in paragraph 7#a74 7#f7 ,administration ,the land acquired by the ,secretary pursuant to the exchange under this subsection shall be administered as part of the ,park4 #c4 ,denali ,national ,park and ,preserve natural gas pipeline 7a7 ,definitions ,in this section3 7#a7 ,appurtenance 7,a7 ,in general ,the term appurtenance includes cathodic protection or test stations1 valves1 signage1 and buried communication and electric cables relating to the operation of high-pressure natural gas transmission4 7,b7 ,exclusions ,the term appurtenance does not include compressor stations4 7#b7 ,park ,the term ,park means the ,denali ,national ,park and ,preserve in the ,state of ,alaska4 7#c7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7b7 ,permit ,the ,secretary may issue right-of-way permits for-- 7#a7 a high-pressure natural gas transmission pipeline 7including appurtenances7 in nonwilderness areas within the boundary of ,denali ,national ,park within1 along1 or near the approximately #g-mile segment of the ,george ,parks ,highway that runs through the ,park2 and 7#b7 any distribution and transmission pipelines and appurtenances that the ,secretary determines to be necessary to provide natural gas supply to the ,park4 7c7 ,terms and conditions ,a permit authorized under subsection 7b7-- 7#a7 may be issued only-- 7,a7 if the permit is consistent with the laws 7including regulations7 generally applicable to utility rights-of-way within units of the ,national ,park ,system2 7,b7 in accordance with section #aajf7;a7 of the ,alaska ,national ,interest ,lands ,conservation ,act 7#af ,u4,s4,c4 #caff7;a772 and 7,c7 if1 following an appropriate analysis prepared in compliance with the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq471 the route of the right-of-way is the route through the ,park with the least adverse environmental effects for the ,park2 and 7#b7 shall be subject to such terms and conditions as the ,secretary determines to be necessary4 #d4 ,designation of the ,walter ,harper ,talkeetna ,ranger ,station 7a7 ,designation ,the ,talkeetna ,ranger ,station located on ,b ,street in ,talkeetna1 ,alaska1 approximately #ajj miles south of the entrance to ,denali ,national ,park1 shall be known and designated as the ,walter ,harper ,talkeetna ,ranger ,station4 7b7 ,references ,any reference in a law1 map1 regulation1 document1 paper1 or other record of the ,united ,states to the ,talkeetna ,ranger ,station referred to in subsection 7a7 shall be deemed to be a reference to the ,walter ,harper ,talkeetna ,ranger ,station4 ,september #aj1 #bjac;,committed to the ,committee of the ,whole ,house on the ,state of the ,union and ordered to be printed
