financed under section #ead or #eaf of the ,act may not be recaptured for use in another project until such assistance has remained unused for a period of #ab consecutive months1 if such project has a waiting list of tenants seeking such assistance or the project has rental assistance eligible tenants who are not receiving such assistance3 ,provided further1 ,that such recaptured rental assistance shall1 to the extent practicable1 be applied to another farm labor multi-family housing project financed under section #ead or #eaf of the ,act4 ,multi-family housing revitalization program account ,for the rural housing voucher program as authorized under section #edb of the ,housing ,act of #aidi1 but notwithstanding subsection 7b7 of such section1 and for additional costs to conduct a demonstration program for the preservation and revitalization of multi-family rental housing properties described in this paragraph1 #cb1ege1jjj1 to remain available until expended3 ,provided1 ,that of the funds made available under this heading1 #ab1ege1jjj1 shall be available for rural housing vouchers to any low-income household 7including those not receiving rental assistance7 residing in a rent for the section #eae unit and the tenant paid rent for such unit3 ,provided further1 ,that funds made available for such vouchers shall be subject to the availability of annual appropriations3 ,provided further1 ,that the ,secretary shall1 to the maximum extent practicable1 administer such vouchers with current regulations and administrative guidance applicable to section #h housing vouchers administered by the ,secretary of the ,department of ,housing and ,urban ,development3 ,provided further1 ,that if the ,secretary determines that the amount made available for vouchers in this or any other ,act is not needed for vouchers1 the ,secretary may use such funds for the demonstration program for the preservation and revitalization of multi-family rental housing properties described in this paragraph3 ,provided further1 ,that of the funds made available under this heading1 #bj1jjj1jjj shall be available for a demonstration program for the preservation and revitalization of the sections #ead1 #eae1 and #eaf multi-family rental housing properties to restructure existing ,,usda multi-family housing loans1 as the ,secretary deems appropriate1 expressly for the purposes of ensuring the project has sufficient resources to preserve the project for the purpose of providing safe and affordable housing for low-income residents and farm laborers including reducing or eliminating interest2 deferring loan payments1 subordinating1 reducing or reamortizing loan debt2 and other financial assistance including advances1 payments and incentives 7including the ability of owners to obtain reasonable returns on investment7 required by the ,secretary3 ,provided further1 ,that the ,secretary shall as part of the preservation and revitalization agreement obtain a restrictive use agreement consistent with the terms of the restructuring3 ,provided further1 ,that if the ,secretary determines that additional funds for vouchers described in this paragraph are needed1 funds for the preservation and revitalization demonstration program may be used for such vouchers3 ,provided further1 ,that if ,congress enacts legislation to permanently authorize a multi-family rental housing loan restructuring program similar to the demonstration program described herein1 the ,secretary may use funds made available for the demonstration program under this heading to carry out such legislation with the prior approval of the ,committees on ,appropriations of both ,houses of ,congress3 ,provided further1 ,that in addition to any other available funds1 the of financial and technical assistance3 ,provided further1 ,that such intermediary organizations shall provide matching funds from other sources1 including ,federal funds for related activities1 in an amount not less than funds provided3 ,provided further1 ,that #e1ggh1jjj of the amount appropriated under this heading shall be to provide grants for facilities in rural communities with extreme unemployment and severe economic depression 7,public ,law #ajf-chg71 with up to #e percent for administration and capacity building in the ,state rural development offices3 ,provided further1 ,that #d1jjj1jjj of the amount appropriated under this heading shall be available for community facilities grants to tribal colleges1 as authorized by section #cjf7;a77#ai7 of such ,act3 ,provided further1 ,that the ,secretary shall set aside for ,rural ,economic ,area ,partnership 7,,reap7 ,zones an amount of funds made available under this paragraph equal to the amount obligated for ,,reap ,zones by program of loan guarantees1 under the same terms and conditions as authorized by section #ijjg of the ,farm ,security and ,rural ,investment ,act of #bjjb 7#g ,u4,s4,c4 #hajg71 #d1jjj1jjj3 ,provided1 pursuant to section #cbe of ,public ,law #aje-hc for training and technical assistance programs3 ,provided further1 ,that not to exceed #ai1jjj1jjj of the amount appropriated under this heading shall be for technical assistance grants for rural water and waste systems pursuant to section #cjf7;a77#ad7 of such ,act1 unless the ,secretary makes a determination of extreme need1 of which #f1jjj1jjj shall be made available for a grant to a qualified non-profit multi-state regional technical assistance organization1 with experience in working with small communities on water and waste water problems1 the principal purpose of such grant shall be to assist rural communities with populations of #c1cjj or less1 in improving the planning1 financing1 development1 operation1 and management of water and waste water systems1 and of which not less than #hjj1jjj shall be for a qualified national ,native ,american organization to provide technical assistance for rural water systems for tribal communities3 ,provided further1 ,that not to exceed #ae1jjj1jjj of the amount appropriated under this heading shall be for contracting with qualified national organizations for a circuit rider program to pay negotiated indirect cost rates on cooperative agreements or similar arrangements between the ,united ,states ,department of ,agriculture and nonprofit institutions in excess of #aj percent of the total direct cost of the agreement when the purpose of such cooperative arrangements is to carry out programs of mutual interest between the two parties4 ,this does not preclude appropriate payment of indirect costs on grants and contracts with such institutions when such indirect costs are computed on a similar basis for all agencies for which appropriations are provided in this ,act4 #gje4 ,appropriations to the ,department of ,agriculture for the cost of direct and guaranteed loans made available in the current fiscal year shall remain available until expended to disburse obligations made in the current fiscal year for the following accounts3 the ,rural ,development ,loan ,fund program account1 the ,rural ,electrification and ,telecommunication ,loans program account1 and the ,rural ,housing ,insurance ,fund program account4 #gjf4 ,none of the funds made available to the ,department of ,agriculture by this ,act may be used to acquire new information technology systems or significant upgrades1 as determined by the ,office of the ,chief ,information ,officer1 without the approval of the ,chief ,information ,officer and the concurrence of the ,executive ,information ,technology ,investment ,review ,board3 ,provided1 ,that notwithstanding any other provision of law1 none of the funds appropriated or otherwise made available by this ,act may be transferred to the ,office of the ,chief ,information ,officer without written notification to and the prior approval of the ,committees on ,appropriations of both ,houses of ,congress3 ,provided further1 ,that none of the funds available to the ,department of ,agriculture for information technology shall be obligated for projects over #be1jjj prior to receipt of written approval by the ,chief ,information ,officer4 #gjg4 ,funds made available under section #abdj;,i and section #abda7;a7 of the ,food ,security ,act of #aihe and section #ebd7;b7 of the ,federal ,crop ,insurance ,act 7#g ,u4,s4,c4 #aebd7;b77 in the current fiscal year shall remain available until expended to disburse obligations made in the current fiscal year4 #gjh4 ,hereafter1 notwithstanding any other provision of law1 any former ,,rus borrower that has repaid or prepaid an insured1 direct or guaranteed loan under the ,rural ,electrification ,act of #aicf1 or any not-for-profit utility that is eligible to receive an insured or direct loan under such ,act1 shall be eligible for assistance under section #cac7;b77#b77;,b7 of such ,act in the same manner as a borrower under such ,act4 #gji4 ,notwithstanding any other provision of law1 for the purposes of a grant under section #dab of the ,agricultural ,research1 ,extension1 and ,education ,reform ,act of #aiih1 none of the funds in this or any other ,act may be used to prohibit the provision of in-kind support from non-,federal sources under section #dab7;e77#c7 of such ,act in the form of unrecovered indirect costs not otherwise charged against the grant1 consistent with the indirect rate of cost approved for a recipient4 #gaj4 ,except as otherwise specifically provided by law1 unobligated balances from appropriations made available for salaries and expenses in this ,act for the ,farm ,service ,agency and the ,rural ,development mission area1 shall remain available through ,september #cj1 #bjae1 for information technology expenses4 #gaa4 ,the ,secretary of ,agriculture may authorize a ,state agency to use funds provided in this ,act to exceed the maximum amount of liquid infant formula specified in #g ,,cfr #bdf4aj when issuing liquid infant formula to participants4 #gab4 ,none of the funds appropriated or otherwise made available by this ,act may be used for first-class travel by the employees of agencies funded by this ,act in contravention of sections #cja-aj4abb through #cja-aj4abd of title #da1 ,code of ,federal ,regulations4 #gac4 ,in the case of each program established or amended by the ,food1 ,conservation1 and ,energy ,act of #bjjh 7,public ,law #aaj-bdf71 other than by title ,i or subtitle ,a of title ,,iii of such ,act1 or programs for which indefinite amounts were provided in that ,act1 that is authorized or required to be carried out using funds of the ,commodity ,credit ,corporation-- 7#a7 such funds shall be available for salaries and related administrative expenses1 including technical assistance1 associated with the implementation of the program1 without regard to the limitation on the total amount of allotments and fund transfers contained in section #aa of the ,commodity ,credit ,corporation ,charter ,act 7#ae ,u4,s4,c4 #gad;i72 and 7#b7 the use of such funds for such purpose shall not be considered to be a fund transfer or allotment for purposes of applying the limitation on the total amount of allotments and fund transfers contained in such section4 #gad4 ,none of the funds made available in fiscal year #bjac or preceding fiscal years for programs authorized under the ,food for ,peace ,act 7#g ,u4,s4,c4 #afia et seq47 in excess of #bj1jjj1jjj shall be used to reimburse the ,commodity ,credit ,corporation for the release of eligible commodities under section #cjb7;f77#b77;,a7 of the ,bill ,emerson ,humanitarian ,trust ,act 7#g ,u4,s4,c4 #agcf;f-#a73 ,provided1 ,that any such funds made available to reimburse the ,commodity ,credit ,corporation shall only be used pursuant to section #cjb7;b77#b77;,b77i7 of the ,bill ,emerson ,humanitarian ,trust ,act4 #gae4 ,of the funds made available by this ,act1 not more than #b1jjj1jjj shall be used to cover necessary expenses of activities related to all advisory committees1 panels1 commissions1 and task forces of the ,department of ,agriculture1 except for panels used to comply with negotiated rule makings and panels used to evaluate competitively awarded grants4 #gaf4 ,none of the funds in this ,act shall be available to pay indirect costs charged against any agricultural research1 education1 or extension grant awards issued by the ,national ,institute of ,food and ,agriculture that exceed #cj percent of total ,federal funds provided under each award3 ,provided1 ,that notwithstanding section #adfb of the ,national ,agricultural ,research1 ,extension1 and ,teaching ,policy ,act of #aigg 7#g ,u4,s4,c4 #ccaj71 funds provided by this ,act for grants awarded competitively by the ,national ,institute of ,food and ,agriculture shall be available to pay full allowable indirect costs for each grant awarded under section #i of the ,small ,business ,act 7#ae ,u4,s4,c4 #fch74 #gag4 ,for loans and loan guarantees that do not require budget authority and the program level has been established in this ,act1 the ,secretary of ,agriculture may increase the program level for such loans and loan guarantees by not more than #be percent3 ,provided1 ,that prior to the ,secretary implementing such an increase1 the ,secretary notifies1 in writing1 the ,committees on ,appropriations of both ,houses of ,congress at least #ae days in advance4 #gah4 ,none of the funds appropriated or otherwise made available by this or any other ,act shall be used to pay the salaries and expenses of personnel to carry out the following3 7#a7 ,the ,watershed ,rehabilitation program authorized by section #ad7;h77#a7 of the ,watershed ,protection and ,flood ,prevention ,act 7#af ,u4,s4,c4 #ajab7;h77#a772 7#b7 ,the ,environmental ,quality ,incentives ,program as authorized by sections #abdj-abdj;,h of the ,food ,security ,act of #aihe 7#af ,u4,s4,c4 #chci;aa-#chci;aa-#h7 in excess of #a1cej1jjj1jjj2 7#c7 ,the ,wildlife ,habitat ,incentives ,act authorized by section #abdj,n of the ,food ,security ,act of #aihe1 as amended 7#af ,u4,s4,c4 #chci;bb-#a77 in excess of #gj1jjj1jjj2 and 7#d7 ,agricultural ,management ,assistance ,program as authorized by section #ebd of the ,federal ,crop ,insurance ,act1 as amended 7#g ,u4,s4,c4 #aebd7 in excess of #b1ejj1jjj for the ,natural ,resources ,conservation ,service4 #gai4 ,none of the funds appropriated or otherwise made available by this or any other ,act shall be used to pay the salaries and expenses of personnel to carry out a program under subsection 7b77#b77;,a77vi7 of section #adbbb of ,public ,law #aaj-bdf in excess of #ija1jjj1jjj1 as follows3 ,child ,nutrition ,programs ,entitlement ,commodities--#dfe1jjj1jjj2 ,state ,option ,contracts--#e1jjj1jjj2 ,removal of ,defective ,commodities--#b1ejj1jjj3 ,provided1 ,that none of the funds made available in this ,act or any other ,act shall be used for salaries and expenses to carry out in this fiscal year section #ai7;i77#a77;,e7 of the ,richard ,b4 ,russell ,national ,school ,lunch ,act1 as amended1 except in an amount that excludes the transfer of #aai1jjj1jjj of the funds to be transferred under subsection 7c7 of section #adbbb of ,public ,law #aaj-bdf1 until ,october #a1 #bjad3 ,provided further1 ,that #aai1jjj1jjj made available on ,october #a1 #bjad1 to carry out section #ai7;i77#a77;,e7 of the ,richard ,b4 ,russell ,national ,school ,lunch ,act1 as amended1 shall be excluded from the limitation described in subsection 7b77#b77;,a77vii7 of section #adbbb of ,public ,law #aaj-bdf3 ,provided further1 ,that none of the funds appropriated or otherwise made available by this or any other ,act shall be used to pay the salaries or expenses of any employee of the ,department of ,agriculture or officer of the ,commodity ,credit ,corporation to carry out clause #c of section #cb of the ,agricultural ,adjustment ,act of #aice 7,public ,law #gd-cbj1 #g ,u4,s4,c4 #fab;c1 as amended71 or for any surplus removal activities or price support activities under section #e of the ,commodity ,credit ,corporation ,charter ,act3 ,provided further1 ,that of the available unobligated balances under 7b77#b77;,a77vi7 of section #adbbb of ,public ,law #aaj-bdf1 #aff1jjj1jjj are hereby rescinded4 #gbj4 ,none of the funds appropriated by this or any other ,act shall be used to pay the salaries and expenses of personnel who prepare or submit appropriations language as part of the ,president's budget submission to the ,congress of the ,united ,states for programs under the jurisdiction of the ,appropriations ,subcommittees on ,agriculture1 ,rural ,development1 ,food and ,drug ,administration1 and ,related ,agencies that assumes revenues or reflects a reduction from the previous year due to user fees proposals that have not been enacted into law prior to the submission of the budget unless such budget submission identifies which additional spending reductions should occur in the event the user fees proposals are not enacted prior to the date of the convening of a committee of conference for the fiscal year #bjae appropriations ,act4 #gba4 7a7 ,none of the funds provided by this ,act1 or provided by previous ,appropriations ,acts to the agencies funded by this ,act that remain available for obligation or expenditure in the current fiscal year1 or provided from any accounts in the ,treasury of the ,united ,states derived by the collection of fees available to the agencies funded by this ,act1 shall be available for obligation or expenditure through a reprogramming1 transfer of funds1 or reimbursements as authorized by the ,economy ,act1 or in the case of the ,department of ,agriculture1 through use of the authority provided by section #gjb7;b7 of the ,department of ,agriculture ,organic ,act of #aidd 7#g ,u4,s4,c4 #bbeg7 or section #h of ,public ,law #hi-ajf 7#g ,u4,s4,c4 #bbfc71 that-- 7#a7 creates new programs2 7#b7 eliminates a program1 project1 or activity2 7#c7 increases funds or personnel by any means for any project or activity for which funds have been denied or restricted2 7#d7 relocates an office or employees2 7#e7 reorganizes offices1 programs1 or activities2 or 7#f7 contracts out or privatizes any functions or activities presently performed by ,federal employees2 unless the ,secretary of ,agriculture or the ,secretary of ,health and ,human ,services 7as the case may be7 notifies1 in writing1 the ,committees on ,appropriations of both ,houses of ,congress at least #cj days in advance of the reprogramming of such funds or the use of such authority4 7b7 ,none of the funds provided by this ,act1 or provided by previous ,appropriations ,acts to the agencies funded by this ,act that remain available for obligation or expenditure in the current fiscal year1 or provided from any accounts in the ,treasury of the ,united ,states derived by the collection of fees available to the agencies funded by this ,act1 shall be available for obligation or expenditure for activities1 programs1 or projects through a reprogramming or use of the authorities referred to in subsection 7a7 involving funds in excess of #ejj1jjj or #aj percent1 whichever is less1 that-- 7#a7 augments existing programs1 projects1 or activities2 7#b7 reduces by #aj percent funding for any existing program1 project1 or activity1 or numbers of personnel by #aj percent as approved by ,congress2 or 7#c7 results from any general savings from a reduction in personnel which would result in a change in existing programs1 activities1 or projects as approved by ,congress2 unless the ,secretary of ,agriculture or the ,secretary of ,health and ,human ,services 7as the case may be7 notifies1 in writing1 the ,committees on ,appropriations of both ,houses of ,congress at least #cj days in advance of the reprogramming or transfer of such funds or the use of such authority4 7c7 ,the ,secretary of ,agriculture or the ,secretary of ,health and ,human ,services shall notify in writing the ,committees on ,appropriations of both ,houses of ,congress before implementing any program or activity not carried out during the previous fiscal year unless the program or activity is funded by this ,act or specifically funded by any other ,act4 7d7 ,as described in this section1 no funds may be used for any activities unless the ,secretary of ,agriculture or the ,secretary of ,health and ,human ,services receives from the ,committee on ,appropriations of both ,houses of ,congress written or electronic mail confirmation of receipt of the notification as required in this section4 #gbb4 ,notwithstanding section #caj;,b7g77#e7 of the ,consolidated ,farm and ,rural ,development ,act 7#g ,u4,s4,c4 #aicb7;g77#e771 the ,secretary may assess a one-time fee for any guaranteed business and industry loan in an amount that does not exceed #c percent of the guaranteed principal portion of the loan4 #gbc4 ,none of the funds appropriated or otherwise made available to the ,department of ,agriculture or the ,food and ,drug ,administration shall be used to transmit or otherwise make available to any non-,department of ,agriculture or non-,department of ,health and ,human ,services employee questions or responses to questions that are a result of information requested for the appropriations hearing process4 #gbd4 ,unless otherwise authorized by existing law1 none of the funds provided in this ,act1 may be used by an executive branch agency to produce any prepackaged news story intended for broadcast or distribution in the ,united ,states unless the story includes a clear notification within the text or audio of the prepackaged news story that the prepackaged news story was prepared or funded by that executive branch agency4 #gbe4 ,no employee of the ,department of ,agriculture may be detailed or assigned from an agency or office funded by this ,act or any other ,act to any other agency or office of the ,department for more than #cj days unless the individual's employing agency or office is fully reimbursed by the receiving agency or office for the salary and expenses of the employee for the period of assignment4 #gbf4 ,there is hereby appropriated #a1iif1jjj to carry out section #afba of ,public ,law #aaj-bdf4 #gbg4 ,there is hereby appropriated #fjj1jjj for the purposes of section #gbg of division ,a of ,public ,law #aab-ee4 #gbh4 ,not later than #cj days after the date of enactment of this ,act1 the ,secretary of ,agriculture1 the ,commissioner of the ,food and ,drug ,administration1 and the ,chairman of the ,farm ,credit ,administration shall submit to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate a detailed spending plan by program1 project1 and activity for the funds made available under this ,act4 #gbi4 ,of the unobligated balances for buildings operations and maintenance expenses within ,agriculture ,buildings and ,facilities and ,rental ,payments1 #cj1jjj1jjj are rescinded3 ,provided1 ,that no amount may be rescinded from funds made available for payments to the ,general ,services ,administration for rent and funds made available for payments to the ,department of ,homeland ,security for building security activities4 #gcj4 ,notwithstanding any other provision of law1 any area eligible for rural housing programs of the ,rural ,housing ,service on ,september #cj1 #bjac1 shall remain eligible for such programs until ,september #cj1 #bjad4 #gca4 ,funds received by the ,secretary of ,agriculture in the global settlement of any ,federal litigation concerning ,federal mortgage loans during fiscal year #bjab may be obligated and expended1 in addition to any other available funds1 by the ,rural ,housing ,service to pay for costs associated with servicing single family housing loans guaranteed by the ,rural ,housing ,service and such funds shall remain available until expended4 #gcb4 ,hereafter1 the ,secretary may charge a fee for lenders to access ,department loan guarantee systems in connection with such lenders' participation in loan guarantee programs of the ,rural ,housing ,service3 ,provided1 ,that the funds collected from such fees shall be made available to the ,secretary without further appropriation and such funds shall be deposited into the ,rural ,development ,salaries and ,expense ,account and shall remain available until expended for obligation and expenditure by the ,secretary for administrative expenses of the ,rural ,housing ,service ,loan ,guarantee ,program in addition to other available funds3 ,provided further1 ,that such fees collected shall not exceed #ej per loan4 #gcc4 ,in addition to amounts otherwise made available by this ,act and notwithstanding the last sentence of #af ,u4,s4,c4 #acaj1 there is appropriated #d1jjj1jjj1 to remain available until expended1 to implement non-renewable agreements for flooded agricultural lands1 as determined by the ,secretary1 under the ,water ,bank ,act 7#af ,u4,s4,c4 #acja-acaa74 #gcd4 7a7 ,the ,secretary of ,agriculture and the ,commissioner of the ,food and ,drug ,administration shall submit annual reports to the ,inspector ,general or senior ethics official for any entity without an ,inspector ,general1 regarding the costs and contracting procedures related to each conference held by any such ,department1 agency1 board1 commission1 or office during fiscal year #bjad for which the cost to the ,united ,states ,government was more than #ajj1jjj4 7b7 ,each report submitted shall include1 for each conference described in subsection 7a7 held during the applicable period-- 7#a7 a description of its purpose2 7#b7 the number of participants attending2 7#c7 a detailed statement of the costs to the ,united ,states ,government1 including-- 7,a7 the cost of any food or beverages2 7,b7 the cost of any audio-visual services2 7,c7 the cost of employee or contractor travel to and from the conference2 and 7,d7 a discussion of the methodology used to determine which costs relate to the conference2 and 7#d7 a description of the contracting procedures used including-- 7,a7 whether contracts were awarded on a competitive basis2 and 7,b7 a discussion of any cost comparison conducted by the departmental component or office in evaluating potential contractors for the conference4 7c7 ,within #ae days of the date of a conference held by any executive branch department1 agency1 board1 commission1 or office funded by this ,act during fiscal year #bjad for which the cost to the ,united ,states ,government was more than #bj1jjj1 the head of any such ,department1 agency1 board1 commission1 or office shall notify the ,inspector ,general or senior ethics official for any entity without an ,inspector ,general1 of the date1 location1 and number of employees attending such conference4 7d7 ,a grant or contract funded by amounts appropriated by this ,act to an executive branch agency may not be used for the purpose of defraying the costs of a conference described in subsection 7c7 that is not directly and programmatically related to the purpose for which the grant or contract was awarded1 such as a conference held in connection with planning1 training1 assessment1 review1 or other routine purposes related to a project funded by the grant or contract4 7e7 ,none of the funds made available in this ,act may be used for travel and conference activities that are not in compliance with ,office of ,management and ,budget ,memorandum ,m-#ab-ab dated ,may #aa1 #bjab4 #gce4 7a7 ,designation ,the ,federal building located at #fd ,nowelo ,street1 ,hilo1 ,hawaii1 shall be known and designated as the ,daniel ,k4 ,inouye ,united ,states ,pacific ,basin ,agricultural ,research ,center4 7b7 ,references ,any reference in a law1 map1 regulation1 document1 paper1 or other record of the ,united ,states to the ,federal building referred to in subsection 7a7 shall be deemed to be a reference to the ,daniel ,k4 ,inouye ,united ,states ,pacific ,basin ,agricultural ,research ,center4 #gcf4 ,none of the funds made available in this ,act may be used to pay the salaries or expenses of personnel to-- 7#a7 inspect horses under section #c of the ,federal ,meat ,inspection ,act 7#ba ,u4,s4,c4 #fjc72 7#b7 inspect horses under section #ijc of the ,federal ,agriculture ,improvement and ,reform ,act of #aiif 7#g ,u4,s4,c4 #aija note2 ,public ,law #ajd-abg72 or 7#c7 implement or enforce section #ceb4ai of title #i1 ,code of ,federal ,regulations4 ,this ,act may be cited as the ,agriculture1 ,rural ,development1 ,food and ,drug ,administration1
