amendment made by subsection 7a71 each reference in ,public ,law #ic-dce to the date of enactment shall be considered to be a reference to the date of the enactment of this section4 #d4 ,adjustment of scheduled wage increases in the ,commonwealth of the ,northern ,mariana ,islands ,section #hajc7;b77#a77;,b7 of the ,fair ,minimum ,wage ,act of #bjjg 7#bi ,u4,s4,c4 #bjf note2 ,public ,law #aaj-bh7 is amended by striking #bjaa and inserting #bjaa1 #bjac1 and #bjae4 #e4 ,amendments to the ,consolidated ,natural ,resources ,act ,section #f of the ,joint ,resolution entitled ,a ,joint ,resolution to approve the ,covenant ,to ,establish a ,commonwealth of the ,northern ,mariana ,islands in ,political ,union with the ,united ,states of ,america1 and for other purposes1 approved ,march #bd1 #aigf 7,public ,law #id-bda2 #ij ,stat4 #bfc71 is amended-- 7#a7 in subsection 7a7-- 7,a7 in paragraph 7#b71 by inserting after subsections 7b7 the following3 1 7c712 and 7,b7 by striking paragraph 7#f71 and inserting the following3 7#f7 ,certain ,education ,funding 7,a7 ,in general ,in addition to fees charged pursuant to section #bhf7m7 of the ,immigration and ,nationality ,act 7#h ,u4,s4,c4 #acef 7m77 to recover the full costs of providing adjudication services1 the ,secretary of ,homeland ,security shall charge an annual supplemental fee of #aej per nonimmigrant worker to each prospective employer who is issued a permit under subsection 7d7 of this section during the transition program4 ,such supplemental fee shall be paid into the ,treasury of the ,commonwealth government for the purpose of funding ongoing vocational educational curricula and program development by ,commonwealth educational entities4 7,b7 ,plan for the expenditure of funds ,at the beginning of each fiscal year1 and prior to the payment of the supplemental fee into the ,treasury of the ,commonwealth government in that fiscal year1 the ,commonwealth government must provide to the ,secretary of ,homeland ,security1 a plan for the expenditure of funds1 a projection of the effectiveness of these expenditures in the placement of ,united ,states workers into jobs1 and a report on the changes in employment of ,united ,states workers attributable to prior year expenditures4 7,c7 ,,dhs report ,the ,secretary of ,homeland ,security shall report to the ,congress every #b years on the effectiveness of meeting the goals set out by the ,commonwealth government in its annual plan for the expenditure of funds4 2 7#b7 in subsection 7c7-- 7,a7 in paragraph 7#a71 by striking during the transition period12 and 7,b7 by adding at the end the following3 7#c7 ,duration ,notwithstanding any other provision of this ,act1 the ,secretary may classify aliens pursuant to paragraph 7#a7 until the date on which the transition program terminates4 ,if the transition period is extended1 the ,secretary may continue to classify aliens pursuant to paragraph 7#a7 until the date on which all extensions are terminated4 2 and 7#c7 in subsection 7d77#b71 by striking ,december #ca1 #bjad and inserting ,december #ca1 #bjai4 #f4 ,study of electric rates in the insular areas 7a7 ,definitions ,in this section3 7#a7 ,comprehensive energy plan ,the term comprehensive energy plan means a comprehensive energy plan prepared and updated under subsections 7c7 and 7e7 of section #fjd of the ,act entitled ,an ,act to authorize appropriations for certain insular areas of the ,united ,states1 and for other purposes1 approved ,december #bd1 #aihj 7#dh ,u4,s4,c4 #adib74 7#b7 ,energy action plan ,the term energy action plan means the plan required by subsection 7d74 7#c7 ,freely associated states ,the term ,freely ,associated ,states means the ,federated ,states of ,micronesia1 the ,republic of the ,marshall ,islands1 and the ,republic of ,palau4 7#d7 ,insular areas ,the term insular areas means ,american ,samoa1 the ,commonwealth of the ,northern ,mariana ,islands1 ,puerto ,rico1 ,guam1 and the ,virgin ,islands4 7#e7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#f7 ,team ,the term team means the team established by the ,secretary under subsection 7b74 7b7 ,establishment ,not later than #ahj days after the date of enactment of this ,act1 the ,secretary shall1 within the ,empowering ,insular ,communities activity1 establish a team of technical1 policy1 and financial experts-- 7#a7 to develop an energy action plan addressing the energy needs of each of the insular areas and ,freely ,associated ,states2 and 7#b7 to assist each of the insular areas and ,freely ,associated ,states in implementing such plan4 7c7 ,participation of regional utility organizations ,in establishing the team1 the ,secretary shall consider including regional utility organizations4 7d7 ,energy action plan ,in accordance with subsection 7b71 the energy action plan shall include-- 7#a7 recommendations1 based on the comprehensive energy plan where applicable1 to-- 7,a7 reduce reliance and expenditures on imported fossil fuels2 7,b7 develop indigenous1 nonfossil fuel energy sources2 and 7,c7 improve performance of energy infrastructure and overall energy efficiency2 7#b7 a schedule for implementation of such recommendations and identification and prioritization of specific projects2 7#c7 a financial and engineering plan for implementing and sustaining projects2 and 7#d7 benchmarks for measuring progress toward implementation4 7e7 ,reports to secretary ,not later than #a year after the date on which the ,secretary establishes the team and annually thereafter1 the team shall submit to the ,secretary a report detailing progress made in fulfilling its charge and in implementing the energy action plan4 7f7 ,annual reports to congress ,not later than #cj days after the date on which the ,secretary receives a report submitted by the team under subsection 7e71 the ,secretary shall submit to the appropriate committees of ,congress a summary of the report of the team4 #g4 ,chief financial officer of the ,virgin ,islands 7a7 ,referendum ,as part of the next regularly scheduled1 islands-wide election in the ,virgin ,islands after the date of enactment of this ,act1 the ,board of ,elections of the ,virgin ,islands shall hold a referendum to seek the approval of the people of the ,virgin ,islands regarding whether the position of ,chief ,financial ,officer of the ,government of the ,virgin ,islands shall be established as a part of the executive branch of the ,government of the ,virgin ,islands4 ,the referendum shall be binding and conducted according to the laws of the ,virgin ,islands1 except that the results shall be determined by a majority of the ballots cast4 7b7 ,chief ,financial ,officer of the ,virgin ,islands 7#a7 ,appointment of ,chief ,financial ,officer 7,a7 ,in general ,if the majority of ballots cast in a referendum under subsection 7a7 approve the establishment of the position of ,chief ,financial ,officer of the ,government of the ,virgin ,islands1 the ,governor of the ,virgin ,islands shall appoint a ,chief ,financial ,officer1 with the advice and consent of the ,legislature of the ,virgin ,islands1 from the names on the list required under subsection 7b77#d74 ,if the ,governor has nominated a person for ,chief ,financial ,officer but the ,legislature of the ,virgin ,islands has not confirmed a nominee within #ij days after receiving the list pursuant to subsection 7b77#d71 the ,governor shall appoint from such list a ,chief ,financial ,officer on an acting basis until the ,legislature consents to a ,chief ,financial ,officer4 7,b7 ,acting ,chief ,financial ,officer ,if a ,chief ,financial ,officer has not been appointed under subparagraph 7,a7 within #ahj days after the date of the enactment of this ,act1 the ,virgin ,islands ,chief ,financial ,officer ,search ,commission1 by majority vote1 shall appoint from the names on the list submitted under subsection 7b77#d71 an ,acting ,chief ,financial ,officer to serve in that capacity until a ,chief ,financial ,officer is appointed under the first sentence of subparagraph 7,a74 ,in either case1 if the ,acting ,chief ,financial ,officer serves in an acting capacity for #ahj consecutive days1 without further action the ,acting ,chief ,financial ,officer shall become the ,chief ,financial ,officer4 7#b7 ,duties of ,chief ,financial ,officer ,the duties of the ,chief ,financial ,officer shall include the following3 7,a7 ,develop and report on the financial status of the ,government of the ,virgin ,islands not later than #f months after appointment and quarterly thereafter4 ,such reports shall be available to the public4 7,b7 ,each year prepare and certify spending limits of the annual budget1 including annual estimates of all revenues of the territory without regard to sources1 and whether or not the annual budget is balanced4 7,c7 ,revise and update standards for financial management1 including inventory and contracting1 for the ,government of the ,virgin ,islands in general and for each agency in conjunction with the agency head4 7#c7 ,documents provided ,the heads of each department of the ,government of the ,virgin ,islands1 in particular the head of the ,department of ,finance of the ,virgin ,islands and the head of the ,internal ,revenue ,bureau of the ,virgin ,islands shall provide all documents and information under the jurisdiction of that head that the ,chief ,financial ,officer considers required to carry out his or her functions to the ,chief ,financial ,officer4 7#d7 ,conditions related to ,chief ,financial ,officer 7,a7 ,term ,the ,chief ,financial ,officer shall be appointed for a term of #e years4 7,b7 ,removal ,the ,chief ,financial ,officer shall not be removed except for cause4 ,an ,acting ,chief ,financial ,officer may be removed for cause or by a ,chief ,financial ,officer appointed with the advice and consent of the ,legislature of the ,virgin ,islands4 7,c7 ,replacement ,if the ,chief ,financial ,officer is unable to continue acting in that capacity due to removal1 illness1 death1 or otherwise1 another ,chief ,financial ,officer shall be selected in accordance with paragraph 7#a74 7,d7 ,salary ,the ,chief ,financial ,officer shall be paid at a salary to be determined by the ,governor of the ,virgin ,islands1 except such rate may not be less than the highest rate of pay for a cabinet officer of the ,government of the ,virgin ,islands or a ,chief ,financial ,officer serving in any government or semiautonomous agency4 7c7 ,establishment of commission 7#a7 ,establishment ,there is established a commission to be known as the ,virgin ,islands ,chief ,financial ,officer ,search ,commission4 7#b7 ,duty of commission ,the ,commission shall recommend to the ,governor not less than #c candidates for nomination as ,chief ,financial ,officer of the ,virgin ,islands4 ,each candidate must have demonstrated ability in general management of1 knowledge of1 and extensive practical experience at the highest levels of financial management in governmental or business entities and must have experience in the development1 implementation1 and operation of financial management systems4 7#c7 ,membership 7,a7 ,number and appointment ,the ,commission shall be composed of #h members appointed not later than #cj days after the date of the enactment of this ,act4 ,persons appointed as members must have recognized business1 government1 or financial expertise and experience and shall be appointed as follows3 7i7 #a individual appointed by the ,governor of the ,virgin ,islands4 7ii7 #a individual appointed by the ,president of the ,legislature of the ,virgin ,islands4 7iii7 #a individual1 who is an employee of the ,government of the ,virgin ,islands1 appointed by the ,central ,labor ,council of the ,virgin ,islands4 7iv7 #a individual appointed by the ,chamber of ,commerce of ,st4 ,thomas-,st4 ,john4 7v7 #a individual appointed by the ,chamber of ,commerce of ,st4 ,croix4 7vi7 #a individual appointed by the ,president of the ,university of the ,virgin ,islands4 7vii7 #a individual1 who is a resident of ,st4 ,john1 appointed by the ,at-,large ,member of the ,legislature of the ,virgin ,islands4 7viii7 #a individual appointed by the ,president of ,,aarp ,virgin islands4 7,b7 ,terms 7i7 ,in general ,each member shall be appointed for the life of the ,commission4 7ii7 ,vacancies ,a vacancy in the ,commission shall be filled in the manner in which the original appointment was made4 ,any member appointed to fill a vacancy shall be appointed for the remainder of that term4 7,c7 ,basic pay ,members shall serve without pay4 7,d7 ,quorum ,five members of the ,commission shall constitute a quorum4 7,e7 ,chairperson ,the ,chairperson of the ,commission shall be the ,chief ,justice of the ,supreme ,court of the ,united ,states ,virgin ,islands or the designee of the ,chief ,justice4 ,the ,chairperson shall serve as an ex officio member of the ,commission and shall vote only in the case of a tie4 7,f7 ,meetings ,the ,commission shall meet at the call of the ,chairperson4 ,the ,commission shall meet for the first time not later than #ae days after all members have been appointed under this subsection4 7,g7 ,government employment ,members may not be current government employees1 except for the member appointed under subparagraph 7,a77iii74 7#d7 ,report2 recommendations ,the ,commission shall transmit a report to the ,governor1 the ,committee on ,natural ,resources of the ,house of ,representatives and the ,committee on ,energy and ,natural ,resources of the ,senate not later than #fj days after its first meeting4 ,the report shall name the ,commission's recommendations for candidates for nomination as ,chief ,financial ,officer of the ,virgin ,islands4 7#e7 ,termination ,the ,commission shall terminate upon the nomination and confirmation of the ,chief ,financial ,officer4 7d7 ,definitions ,for the purposes of this section1 the following definitions apply3 7#a7 ,chief ,financial ,officer ,in subsections 7a7 and 7b71 the term ,chief ,financial ,officer means a ,chief ,financial ,officer or ,acting ,chief ,financial ,officer1 as the case may be1 appointed under subsection 7a77#a74 7#b7 ,commission ,the term ,commission means the ,virgin ,islands ,chief ,financial ,officer ,search ,commission established pursuant to subsection 7b74 7#c7 ,governor ,the term ,governor means the ,governor of the ,virgin ,islands4 7#d7 ,removal for cause ,the term removal for cause means removal based upon misconduct1 failure to meet job requirements1 or any grounds that a reasonable person would find grounds for discharge4 #h4 ,reports on estimates of revenues ,the ,comptroller ,general of the ,united ,states shall submit to the appropriate committees of ,congress a report that-- 7#a7 evaluates whether the annual estimates or forecasts of revenue and expenditure of ,american ,samoa1 the ,commonwealth of the ,northern ,mariana ,islands1 ,puerto ,rico1 ,guam1 and the ,virgin ,islands are reasonable2 and 7#b7 as the ,comptroller ,general of the ,united ,states determines to be necessary1 makes recommendations for improving the process for developing estimates or forecasts4 #i4 ,low-income home energy assistance program ,with respect to fiscal years #bjad through #bjag1 the percentage described in section #bfje7;b77#b77;,b77i7 of the ,low-,income ,home ,energy ,assistance ,act of #aiha 7#db ,u4,s4,c4 #hfbd7;b77#b77;,b77i77 shall be #cjj percent when applied to households located in the ,virgin ,islands4 #aj4 ,castle ,nugent ,national ,historic ,site ,establishment 7a7 ,definitions ,in this section3 7#a7 ,historic site ,the term historic site means the ,castle ,nugent ,national ,historic ,site established in subsection 7b74 7#b7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7b7 ,castle nugent national historic site 7#a7 ,establishment ,there is established as a unit of the ,national ,park ,system the ,castle ,nugent ,national ,historic ,site on the ,island of ,st4 ,croix1 ,u4,s4 ,virgin ,islands1 in order to preserve1 protect1 and interpret1 for the benefit of present and future generations1 a ,caribbean cultural landscape that spans more than #cjj years of agricultural use1 significant archeological resources1 mangrove forests1 endangered sea turtle nesting beaches1 an extensive barrier coral reef system1 and other outstanding natural features4 7#b7 ,boundaries ,the historic site consists of the approximately #b1ijj acres of land extending from ,lowrys ,hill and ,laprey ,valley to the ,caribbean ,sea and from ,manchenil ,bay to ,great ,pond1 along with associated submerged lands to the three-mile territorial limit1 as generally depicted on the map titled ,castle ,nugent ,national ,historic ,site ,proposed ,boundary ,map1 numbered ,t#bb_/ajj1ddg1 and dated ,october #bjji4 7#c7 ,map availability ,the map referred to in paragraph 7#b7 shall be on file and available for public inspection in the appropriate offices of the ,national ,park ,service1 ,department of the ,interior4 7#d7 ,acquisition of land 7,a7 ,in general ,except as provided in subparagraph 7,b71 the ,secretary is authorized to acquire lands and interests in lands within the boundaries of the historic site by donation1 purchase with donated funds1 or exchange4 7,b7 ,u4,s4 virgin island lands ,the ,secretary is authorized to acquire lands and interests in lands owned by the ,u4,s4 ,virgin ,islands or any political subdivision thereof only by donation or exchange4 7c7 ,administration 7#a7 ,in general ,the ,secretary shall administer the historic site in accordance with this ,act and with laws generally applicable to units of the ,national ,park ,system1 including-- 7,a7 the ,national ,park ,service ,organic ,act 7#ci ,stat4 #ece2 #af ,u4,s4,c4 #a et seq472 and 7,b7 the ,act of ,august #ba1 #aice 7#di ,stat4 #fff2 #af ,u4,s4,c4 #dfa et seq474 7#b7 ,shared resources ,to the greatest extent practicable1 the ,secretary shall use the resources of other sites administered by the ,national ,park ,service or other ,federal assets on the ,island of ,st4 ,croix to administer the historic site4 7#c7 ,continued use ,in order to maintain an important feature of the cultural landscape of the historic site1 the ,secretary may lease to the ,university of the ,virgin ,islands certain lands within the boundary of the historic site for the purpose of continuing the university's operation breeding ,senepol cattle1 a breed developed on ,st4 ,croix4 ,a lease under this subsection shall contain such terms and conditions as the ,secretary considers appropriate1 including those necessary to protect the values of the historic site4 7#d7 ,management plan ,not later than three years after funds are made available for this subsection1 the ,secretary shall prepare a general management plan for the historic site4 #aa4 ,st4 ,croix ,national ,heritage ,area 7a7 ,definitions ,in this section3 7#a7 ,heritage area ,the term ,heritage ,area means the ,st4 ,croix ,national ,heritage ,area established by subsection 7b77#a74 7#b7 ,local coordinating entity ,the term local coordinating entity means the local coordinating entity for the ,heritage ,area designated by subsection 7b77#d74 7#c7 ,management plan ,the term management plan means the management plan for the ,heritage ,area required under subsection 7d74 7#d7 ,map ,the term map means the map entitled ,proposed ,st4 ,croix ,national ,heritage ,area and dated 4 7#e7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#f7 ,state ,the term ,state means ,st4 ,croix1 ,u4,s4 ,virgin ,islands4 7b7 ,st4 ,croix ,national ,heritage ,area 7#a7 ,establishment ,there is established in the ,state the ,st4 ,croix ,national ,heritage ,area4 7#b7 ,conceptual boundaries ,the ,heritage ,area shall consist of the entire island4 7#c7 ,map ,a map of the ,heritage ,area shall be-- 7,a7 included in the management plan2 and 7,b7 on file and available for public inspection in the appropriate offices of the ,national ,park ,service4 7#d7 ,local coordinating entity 7,a7 ,in general ,the local coordinating entity for the ,heritage ,area shall be known as ,st4 ,croix ,united for ,community1 ,culture1 ,environment1 and ,economic ,development 7,,succeed7 ,inc4 7,b7 ,membership requirements ,membership in ,,succeed1 ,inc4 shall be open to a broad cross-section of public1 private1 and non-governmental sectors including businesses1 individuals1 agencies1 and organizations that were involved in the planning and development of the ,heritage ,area prior to the enactment of this ,act4 7c7 ,administration 7#a7 ,authorities ,for purposes of carrying out the management plan1 the ,secretary1 acting through the local coordinating entity1 may use amounts made available under this section to-- 7,a7 make grants to the ,state or a political subdivision of the ,state1 nonprofit organizations1 and other persons2 7,b7 enter into cooperative agreements with1 or provide technical assistance to1 the ,state or a political subdivision of the ,state1 nonprofit organizations1 and other interested parties2 7,c7 hire and compensate staff1 which shall include individuals with expertise in natural1 cultural1 and historical resources protection1 and heritage programming2 7,d7 obtain money or services from any source including any that are provided under any other ,federal law or program2 7,e7 contract for goods or services2 and 7,f7 undertake to be a catalyst for any other activity that furthers the ,heritage ,area and is consistent with the approved management plan4 7#b7 ,duties ,the local coordinating entity shall-- 7,a7 in accordance with subsection 7d71 prepare and submit a management plan for the ,heritage ,area to the ,secretary2 7,b7 assist units of local government1 regional planning organizations1 and nonprofit organizations in carrying out the approved management plan by-- 7i7 carrying out programs and projects that recognize1 protect1 and enhance important resource values in the ,heritage ,area2 7ii7 establishing and maintaining interpretive exhibits and programs in the ,heritage ,area2 7iii7 developing recreational and educational opportunities in the ,heritage ,area2 7iv7 increasing public awareness of1 and appreciation for1 natural1 historical1 scenic1 and cultural resources of the ,heritage ,area2 7v7 protecting and restoring historic sites and buildings in the ,heritage ,area that are consistent with ,heritage ,area themes2 7vi7 ensuring that clear1 consistent1 and appropriate signs identifying points of public access1 and sites of interest are posted throughout the ,heritage ,area2 and 7vii7 promoting a wide range of partnerships among governments1 organizations1 and individuals to further the ,heritage ,area2 7,c7 consider the interests of diverse units of government1 businesses1 organizations1 and individuals in the ,heritage ,area in the preparation and implementation of the management plan2 7,d7 conduct meetings open to the public at least semiannually regarding the development and implementation of the management plan2 7,e7 for any year that ,federal funds have been received under this section-- 7i7 submit an annual report to the ,secretary that describes the activities1 expenses1 and income of the local coordinating entity 7including grants to any other entities during the year that the report is made72 7ii7 make available to the ,secretary for audit all records relating to the expenditure of the funds and any matching funds2 and 7iii7 require1 with respect to all agreements authorizing expenditure of ,federal funds by other organizations1 that the organizations receiving the funds make available to the ,secretary for audit all records concerning the expenditure of the funds2 and 7,f7 encourage by appropriate means economic viability that is consistent with the ,heritage ,area4 7#c7 ,prohibition on the acquisition of real property ,the local coordinating entity shall not use ,federal funds to acquire real property or any interest in real property4 7d7 ,management plan 7#a7 ,in general ,not later than #c years after the date of enactment of this ,act1 the local coordinating entity shall submit to the ,secretary for approval a proposed management plan for the ,heritage ,area4 7#b7 ,requirements ,the management plan shall-- 7,a7 incorporate an integrated and cooperative approach for the protection1 enhancement1 and interpretation of the natural1 cultural1 historic1 scenic1 and recreational resources of the ,heritage ,area2 7,b7 take into consideration ,state and local plans2 7,c7 include-- 7i7 an inventory of-- 7,i7 the resources located in the core area described in subsection 7b77#b72 and 7,,ii7 any other property in the core area that-- 7aa7 is related to the themes of the ,heritage ,area2 and 7bb7 should be preserved1 restored1 managed1 or maintained because of the significance of the property2 7ii7 describe comprehensive policies1 goals1 strategies and recommendations for telling the story of the heritage of the area covered by the designation and encouraging long-term resource protection1 enhancement1 interpretation1 funding1 management1 and development2 7iii7 a description of actions that governments1 private organizations1 and individuals have agreed to take to protect the natural1 historical and cultural resources of the ,heritage ,area2 7iv7 a program of implementation for the management plan by the local coordinating entity that includes a description of-- 7,i7 actions to facilitate ongoing collaboration among partners to promote plans for resource protection1 restoration1 and construction2 and 7,,ii7 specific commitments for implementation that have been made by the local coordinating entity or any government1 organization1 or individual for the first #e years of operation2 7v7 the identification of sources of funding for carrying out the management plan2 7vi7 analysis and recommendations for means by which local1 ,state1 and ,federal programs1 may best be coordinated to carry out this section2 and 7vii7 a business plan that describes the role1 operation1 financing1 and functions of the local coordinating entity and of each of the major activities contained in the management plan and provides adequate assurances that the local coordinating entity has the partnerships and financial and other resources necessary to implement the management plan for the ,national ,heritage ,area2 and 7,d7 recommend policies and strategies for resource management that consider and detail the application of appropriate land and water management techniques1 including the development of intergovernmental and interagency cooperative agreements to protect the natural1 historical1 cultural1 educational1 scenic1 and recreational resources of the ,heritage ,area4 7#c7 ,deadline ,if a proposed management plan is not submitted to the ,secretary by the date that is #c years after the date of enactment of this ,act1 the local coordinating entity shall be ineligible to receive additional funding under this section until the date that the ,secretary receives and approves the management plan4 7#d7 ,approval or disapproval of management plan 7,a7 ,in general ,not later than #ahj days after the date of receipt of the management plan under paragraph 7#a71 the ,secretary1 in consultation with the ,state1 shall approve or disapprove the management plan4 7,b7 ,criteria for approval ,in determining whether to approve the management plan1 the ,secretary shall consider whether-- 7i7 the local coordinating entity is representative of the diverse interests of the ,heritage ,area1 including governments1 natural and historic resource protection organizations1 educational institutions1 businesses1 and recreational organizations2 7ii7 the local coordinating entity has afforded adequate opportunity1 including public hearings1 for public and governmental involvement in the preparation of the management plan2 and 7iii7 the resource protection and interpretation strategies contained in the management plan1 if implemented1 would adequately protect the natural1 historical1 and cultural resources of the ,heritage ,area4 7,c7 ,action following disapproval ,if the ,secretary disapproves the management plan under subparagraph 7,a71 the ,secretary shall-- 7i7 advise the local coordinating entity in writing of the reasons for the disapproval2 7ii7 make recommendations for revisions to the management plan2 and 7iii7 not later than #ahj days after the receipt of any proposed revision of the management plan from the local coordinating entity1 approve or disapprove the proposed revision4 7,d7 ,amendments 7i7 ,in general ,the ,secretary shall approve or disapprove each amendment to the management plan that the ,secretary determines make a substantial change to the management plan4 7ii7 ,use of funds ,the local coordinating entity shall not use ,federal funds authorized by this section to carry out any amendments to the management plan until the ,secretary has approved the amendments4 7e7 ,relationship to other federal agencies 7#a7 ,in general ,nothing in this section affects the authority of a ,federal agency to provide technical or financial assistance under any other law4 7#b7 ,consultation and coordination ,the head of any ,federal agency planning to conduct activities that may have an impact on the ,heritage ,area is encouraged to consult and coordinate the activities with the ,secretary and the local coordinating entity to the maximum extent practicable4 7#c7 ,other federal agencies ,nothing in this section-- 7,a7 modifies1 alters1 or amends any law or regulation authorizing a ,federal agency to manage ,federal land under the jurisdiction of the ,federal agency2 7,b7 limits the discretion of a ,federal land manager to implement an approved land use plan within the boundaries of the ,heritage ,area2 or 7,c7 modifies1 alters1 or amends any authorized use of ,federal land under the jurisdiction of a ,federal agency4 7f7 ,private property and regulatory protections ,nothing in this section-- 7#a7 abridges the rights of any property owner 7whether public or private71 including the right to refrain from participating in any plan1 project1 program1 or activity conducted within the ,heritage ,area2 7#b7 requires any property owner to permit public access 7including access by ,federal1 ,state1 or local agencies7 to the property of the property owner1 or to modify public access or use of property of the property owner under any other ,federal1 ,state1 or local law2 7#c7 alters any duly adopted land use regulation1 approved land use plan1 or other regulatory authority of any ,federal1 ,state1 or local agency1 or conveys any land use or other regulatory authority to the local coordinating entity2 7#d7 authorizes or implies the reservation or appropriation of water or water rights2 7#e7 diminishes the authority of the ,state to manage fish and wildlife1 including the regulation of fishing and hunting within the ,heritage ,area2 or 7#f7 creates any liability1 or affects any liability under any other law1 of any private property owner with respect to any person injured on the private property4 7g7 ,evaluation2 report 7#a7 ,in general ,not later than #c years before the date on which authority for ,federal funding terminates for the ,heritage ,area1 the ,secretary shall-- 7,a7 conduct an evaluation of the accomplishments of the ,heritage ,area2 and 7,b7 prepare a report in accordance with paragraph 7#c74 7#b7 ,evaluation ,an evaluation conducted under paragraph 7#a77;,a7 shall-- 7,a7 assess the progress of the local coordinating entity with respect to-- 7i7 accomplishing the purposes of this section for the ,heritage ,area2 and 7ii7 achieving the goals and objectives of the approved management plan for the ,heritage ,area2 7,b7 analyze the ,federal1 ,state1 local1 and private investments in the ,heritage ,area to determine the leverage and impact of the investments2 and 7,c7 review the management structure1 partnership relationships1 and funding of the ,heritage ,area for purposes of identifying the critical components for sustainability of the ,heritage ,area4 7#c7 ,report 7,a7 ,in general ,based on the evaluation conducted under paragraph 7#a77;,a71 the ,secretary shall prepare a report that includes recommendations for the future role of the ,national ,park ,service1 if any1 with respect to the ,heritage ,area4 7,b7 ,required analysis ,if the report prepared under subparagraph 7,a7 recommends that ,federal funding for the ,heritage ,area be reauthorized1 the report shall include an analysis of-- 7i7 ways in which ,federal funding for the ,heritage ,area may be reduced or eliminated2 and 7ii7 the appropriate time period necessary to achieve the recommended reduction or elimination4 7,c7 ,submission to congress ,on completion of the report1 the ,secretary shall submit the report to-- 7i7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7ii7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7h7 ,termination of authority ,the authority of the ,secretary to provide assistance under this section terminates on the date that is #ae years after the date of enactment of this ,act4 #ab4 ,guam ,war ,claims ,review ,commission 7a7 ,recognition of the suffering and loyalty of the residents of ,guam 7#a7 ,recognition of the ,suffering of the ,residents of ,guam ,the ,united ,states recognizes that1 as described by the ,guam ,war ,claims ,review ,commission1 the residents of ,guam1 on account of their ,united ,states nationality1 suffered unspeakable harm as a result of the occupation of ,guam by ,imperial ,japanese military forces during ,world ,war ,,ii1 by being subjected to death1 rape1 severe personal injury1 personal injury1 forced labor1 forced march1 or internment4 7#b7 ,recognition of the ,loyalty of the ,residents of ,guam ,the ,united ,states forever will be grateful to the residents of ,guam for their steadfast loyalty to the ,united ,states1 as demonstrated by the countless acts of courage they performed despite the threat of death or great bodily harm they faced at the hands of the ,imperial ,japanese military forces that occupied ,guam during ,world ,war ,,ii4 7b7 ,guam ,world ,war ,,ii ,claims ,fund 7#a7 ,establishment of fund ,the ,secretary of the ,treasury shall establish in the ,treasury of the ,united ,states a special fund 7in this ,act referred to as the ,claims ,fund7 for the payment of claims submitted by compensable ,guam victims and survivors of compensable ,guam decedents in accordance with subsections 7c7 and 7d74 7#b7 ,composition of fund ,the ,claims ,fund established under paragraph 7#a7 shall be composed of amounts deposited into the ,claims ,fund under paragraph 7#c7 and any other amounts made available for the payment of claims under this ,act4 7#c7 ,payment of certain duties1 taxes1 and fees collected from ,guam deposited into fund 7,a7 ,in general ,notwithstanding section #cj of the ,organic ,act of ,guam 7#dh ,u4,s4,c4 #adba;h71 the excess of-- 7i7 any amount of duties1 taxes1 and fees collected under such subsection after fiscal year #bjab1 over 7ii7 the amount of duties1 taxes1 and fees collected under such subsection during fiscal year #bjab1 shall be deposited into the ,claims ,fund4 7,b7 ,application ,subparagraph 7,a7 shall not apply after the date for which the ,secretary of the ,treasury determines that all payments required to be made under subsection 7c7 have been made4 7#d7 ,limitation on payments made from fund 7,a7 ,in general ,no payment may be made in a fiscal year under subsection 7c7 until funds are deposited into the ,claims ,fund in such fiscal year under paragraph 7#c74 7,b7 ,amounts ,for each fiscal year in which funds are deposited into the ,claims ,fund under paragraph 7#c71 the total amount of payments made in a fiscal year under subsection 7c7 may not exceed the amount of funds available in the ,claims ,fund for such fiscal year4 7#e7 ,deductions from fund for administrative expenses ,the ,secretary of the ,treasury shall deduct from any amounts deposited into the ,claims ,fund an amount equal to #e per cent of such amounts as reimbursement to the ,federal ,government for expenses incurred by the ,foreign ,claims ,settlement ,commission and by the ,department of the ,treasury in the administration of this ,act4 ,the amounts so deducted shall be covered into the ,treasury as miscellaneous receipts4 7c7 ,payments for ,guam ,world ,war ,,ii claims 7#a7 ,payments for ,death1 ,personal ,injury1 ,forced ,labor1 ,forced ,march1 and ,internment ,after the ,secretary of the ,treasury receives the certification from the ,chairman of the ,foreign ,claims ,settlement ,commission as required under subsection 7d77#b77;,h71 the ,secretary of the ,treasury shall make payments to compensable ,guam victims and survivors of a compensable ,guam decedents as follows3 7,a7 ,compensable ,guam victim ,before making any payments under subparagraph 7,b71 the ,secretary shall make payments to compensable ,guam victims as follows3 7i7 ,in the case of a victim who has suffered an injury described in paragraph 7#c77;,b77i71 #ae1jjj4 7ii7 ,in the case of a victim who is not described in clause 7i71 but who has suffered an injury described in paragraph 7#c77;,b77ii71 #ab1jjj4 7iii7 ,in the case of a victim who is not described in clause 7i7 or 7ii71 but who has suffered an injury described in paragraph 7#c77;,b77iii71 #aj1jjj4 7,b7 ,survivors of compensable ,guam decedents ,in the case of a compensable ,guam decedent1 the ,secretary shall pay #be1jjj for distribution to survivors of the decedent in accordance with paragraph 7#b74 ,the ,secretary shall make payments under this paragraph only after all payments are made under subparagraph 7,a74 7#b7 ,distribution of ,survivor ,payments ,a payment made under paragraph 7#a77;,b7 to the survivors of a compensable ,guam decedent shall be distributed as follows3 7,a7 ,in the case of a decedent whose spouse is living as of the date of the enactment of this ,act1 but who had no living children as of such date1 the payment shall be made to such spouse4 7,b7 ,in the case of a decedent whose spouse is living as of the date of the enactment of this ,act and who had one or more living children as of such date1 #ej percent of the payment shall be made to the spouse and #ej percent shall be made to such children1 to be divided among such children to the greatest extent possible into equal shares4 7,c7 ,in the case of a decedent whose spouse is not living as of the date of the enactment of this ,act and who had one or more living children as of such date1 the payment shall be made to such children1 to be divided among such children to the greatest extent possible into equal shares4 7,d7 ,in the case of a decedent whose spouse is not living as of the date of the enactment of this ,act and who had no living children as of such date1 but who-- 7i7 had a parent who is living as of such date1 the payment shall be made to the parent2 or 7ii7 had two parents who are living as of such date1 the payment shall be divided equally between the parents4 7,e7 ,in the case of a decedent whose spouse is not living as of the date of the enactment of this ,act1 who had no living children as of such date1 and who had no parents who are living as of such date1 no payment shall be made4 7#c7 ,definitions ,for purposes of this ,act3 7,a7 ,compensable ,guam decedent ,the term compensable ,guam decedent means an individual determined under subsection 7d7 to have been a resident of ,guam who died as a result of the attack and occupation of ,guam by ,imperial ,japanese military forces during ,world ,war ,,ii1 or incident to the liberation of ,guam by ,united ,states military forces1 and whose death would have been compensable under the ,guam ,meritorious ,claims ,act of #aide 7,public ,law #gi-bbd7 if a timely claim had been filed under the terms of such ,act4 7,b7 ,compensable ,guam victim ,the term compensable ,guam victim means an individual who is not deceased as of the date of the enactment of this ,act and who is determined under subsection 7d7 to have suffered1 as a result of the attack and occupation of ,guam by ,imperial ,japanese military forces during ,world ,war ,,ii1 or incident to the liberation of ,guam by ,united ,states military forces1 any of the following3 7i7 ,rape or severe personal injury 7such as loss of a limb1 dismemberment1 or paralysis74 7ii7 ,forced labor or a personal injury not under subparagraph 7,a7 7such as disfigurement1 scarring1 or burns74 7iii7 ,forced march1 internment1 or hiding to evade internment4 7,c7 ,definitions of severe personal injuries and personal injuries ,not later than #ahj days after the date of the enactment of this ,act1 the ,foreign ,claims ,settlement ,commission shall promulgate regulations to specify the injuries that constitute a severe personal injury or a personal injury for purposes of subparagraphs 7,a7 and 7,b71 respectively1 of paragraph 7#b74 7d7 ,adjudication 7#a7 ,authority of ,foreign ,claims ,settlement ,commission 7,a7 ,in general ,the ,foreign ,claims ,settlement ,commission shall adjudicate claims and determine the eligibility of individuals for payments under subsection 7c74 7,b7 ,rules and regulations ,not later than #ahj days after the date of the enactment of this ,act1 the ,chairman of the ,foreign ,claims ,settlement ,commission shall publish in the ,federal ,register such rules and regulations as may be necessary to enable the ,commission to carry out the functions of the ,commission under this ,act4 7#b7 ,claims ,submitted for ,payments 7,a7 ,submittal of claim ,for purposes of paragraph 7#a77;,a7 and subject to subparagraph 7,b71 the ,foreign ,claims ,settlement ,commission may not determine an individual is eligible for a payment under subsection 7c7 unless the individual submits to the ,commission a claim in such manner and form and containing such information as the ,commission specifies4 7,b7 ,filing period for claims and notice 7i7 ,filing period ,an individual filing a claim for a payment under subsection 7c7 shall file such claim not later than one year after the date on which the ,foreign ,claims ,settlement ,commission publishes the notice described in clause 7ii74 7ii7 ,notice of filing period ,not later than #ahj days after the date of the enactment of this ,act1 the ,foreign ,claims ,settlement ,commission shall publish a notice of the deadline for filing a claim described in clause 7i7-- 7,i7 in the ,federal ,register2 and 7,,ii7 in newspaper1 radio1 and television media in ,guam4 7,c7 ,adjudicatory decisions ,the decision of the ,foreign ,claims ,settlement ,commission on each claim filed under this ,act shall-- 7i7 be by majority vote2 7ii7 be in writing2 7iii7 state the reasons for the approval or denial of the claim2 and 7iv7 if approved1 state the amount of the payment awarded and the distribution1 if any1 to be made of the payment4 7,d7 ,deductions in payment ,the ,foreign ,claims ,settlement ,commission shall deduct1 from a payment made to a compensable ,guam victim or survivors of a compensable ,guam decedent under this subsection1 amounts paid to such victim or survivors under the ,guam ,meritorious ,claims ,act of #aide 7,public ,law #gi-bbd7 before the date of the enactment of this ,act4 7,e7 ,interest ,no interest shall be paid on payments made by the ,foreign ,claims ,settlement ,commission under subsection 7c74 7,f7 ,limited compensation for provision of representational services 7i7 ,limit on compensation ,any agreement under which an individual who provided representational services to an individual who filed a claim for a payment under this ,act that provides for compensation to the individual who provided such services in an amount that is more than one percent of the total amount of such payment shall be unlawful and void4 7ii7 ,penalties ,whoever demands or receives any compensation in excess of the amount allowed under subparagraph 7,a7 shall be fined not more than #e1jjj or imprisoned not more than one year1 or both4 7,g7 ,appeals and finality ,objections and appeals of decisions of the ,foreign ,claims ,settlement ,commission shall be to the ,commission1 and upon rehearing1 the decision in each claim shall be final1 and not subject to further review by any court or agency4 7,h7 ,certifications for payment ,after a decision approving a claim becomes final1 the ,chairman of the ,foreign ,claims ,settlement ,commission shall certify such decision to the ,secretary of the ,treasury for authorization of a payment under subsection 7c74 7,i7 ,treatment of affidavits ,for purposes of subsection 7c7 and subject to subparagraph 7,b71 the ,foreign ,claims ,settlement ,commission shall treat a claim that is accompanied by an affidavit of an individual that attests to all of the material facts required for establishing the eligibility of such individual for payment under such subsection as establishing a prima facie case of the eligibility of the individual for such payment without the need for further documentation1 except as the ,commission may otherwise require4 ,such material facts shall include1 with respect to a claim for a payment made under subsection 7c77#a71 a detailed description of the injury or other circumstance supporting the claim involved1 including the level of payment sought4 7,j7 ,release of related claims ,acceptance of a payment under subsection 7c7 by an individual for a claim related to a compensable ,guam decedent or a compensable ,guam victim shall be in full satisfaction of all claims related to such decedent or victim1 respectively1 arising under the ,guam ,meritorious ,claims ,act of #aide 7,public ,law #gi-bbd71 the implementing regulations issued by the ,united ,states ,navy pursuant to such ,act 7,public ,law #gi-bbd71 or this ,act4 #ac4 ,use of certain expenditures as in-kind contributions 7a7 ,in ,general ,except as provided under subsection 7c71 local matching requirements required of an affected jurisdiction for ,federal programs may be paid in cash or in-kind services provided by the affected jurisdiction pursuant to the following3 7#a7 ,section #caa of the ,compact of ,free ,association between the ,government of the ,united ,states and the ,government of the ,federated ,states of ,micronesia1 approved in the ,compact of ,free ,association ,amendments ,act of #bjjc 7,public ,law #ajh-ahh2 #aag ,stat4 #bgha74 7#b7 ,section #caa of the ,compact of ,free ,association between the ,government of the ,united ,states and the ,government of the ,republic of the ,marshall ,islands1 approved in the ,compact of ,free ,association ,amendments ,act of #bjjc 7,public ,law #ajh-ahh2 #aag ,stat4 #bgha74 7#c7 ,the ,compact of ,free ,association between the ,government of the ,united ,states and the ,government of the ,republic of ,palau1 approved in the ,palau ,compact of ,free ,association ,act 7,public ,law #ii-feh2 #ajj ,stat4 #cfgb74 7b7 ,determination of ,amounts ,to ,be ,considered ,in-,kind ,contributions ,the ,secretary of the ,interior shall determine the amounts that may be considered in-kind contributions for an affected jurisdiction under this section based on a reasonable estimate of the amount of impact expenditures for the ,freely ,associated ,states4 7c7 ,competitive ,grants ,local matching requirements required of an affected jurisdiction for ,federal competitive grant programs may not be paid with in-kind services under this section4 7d7 ,affected ,jurisdictions ,the term affected jurisdiction shall have the meaning given that term in section #ajd7;e7 of ,public ,law #ajh-ahh 7#aag ,stat4 #bgci74 #ad4 ,improvements in ,,hud assisted programs ,section #bad7;a77#g7 of the ,housing and ,community ,development ,act of #aihj 7#db ,u4,s4,c4 #adcf;a7a77#g77 is amended by striking such alien and all that follows through the period at the end and inserting any citizen or national of the ,united ,states shall be entitled to a preference or priority in receiving assistance before any such alien who is otherwise eligible for such assistance44 #ae4 ,benefit to cost ratio study for projects in ,american ,samoa 7a7 ,study ,the ,comptroller ,general of the ,united ,states shall conduct a study regarding the use of benefit-to-cost ratio formulas by ,federal departments and agencies for purposes of evaluating projects in ,american ,samoa4 7b7 ,contents ,in conducting the study1 the ,comptroller ,general shall-- 7#a7 assess whether the benefit-to-cost ratio formulas described in subsection 7a7 take into consideration-- 7,a7 the remote locations in1 and the cost of transportation to and from1 ,american ,samoa2 and 7,b7 other significant factors that are not comparable to locations within the #dh contiguous ,states2 and 7#b7 assess1 in particular1 the use of benefit-to-cost ratio formulas by-- 7,a7 the ,secretary of ,transportation with respect to airport traffic control tower programs2 and 7,b7 the ,secretary of the ,army1 acting through the ,corps of ,engineers1 with respect to a harbor project or other water resources development project4 7#c7 ,report to ,congress ,not later than #a year after the date of enactment of this ,act1 the ,comptroller ,general shall submit to ,congress a report on the results of the study4 #af4 ,waiver of local matching requirements 7a7 ,waiver of certain matching requirements ,section #eja of the ,act entitled ,an ,act to authorize certain appropriations for the territories of the ,united ,states1 to amend certain ,acts relating thereto1 and for other purposes1 approved ,october #ae1 #aigg 7#dh ,u4,s4,c4 #adfi;a2 #ia ,stat4 #aafd7 is amended-- 7#a7 in the last sentence of subsection 7d71 by striking by law2 and 7#b7 by adding at the end the following new subsection3 7e7 ,notwithstanding any other provision of law1 in the case of ,american ,samoa1 ,guam1 the ,virgin ,islands1 and the ,northern ,mariana ,islands1 each department or agency of the ,united ,states shall waive any requirement for local matching funds 7including in-kind contributions7 that the insular area would otherwise be required to provide for any non-competitive grant as follows3 7#a7 ,for a grant requiring matching funds 7including in-kind contributions7 of #ejj1jjj or less1 the entire matching requirement shall be waived4 7#b7 ,for a grant requiring matching funds 7including in-kind contributions7 of more than #ejj1jjj1 #ejj1jjj of the matching requirement shall be waived4 4 7b7 ,conforming amendment ,section #fja of the ,act entitled ,an ,act to authorize appropriations for certain insular areas of the ,united ,states1 and for other purposes1 approved ,march #ab1 #aihj 7#dh ,u4,s4,c4 #adfi;a note2 #id ,stat4 #ij71 is amended by striking 1 and adding the following sentence and all that follows through ,islands'44 #ag4 ,fishery endorsements ,section #abaac of title #df1 ,united ,states ,code1 is amended by adding at the end the following3 7j7 ,certain exemption ,paragraph 7#c7 of subsection 7a7 shall not apply to any vessel-- 7#a7 the catch of which1 pursuant to the fishery endorsement1 is offloaded and processed in ,american ,samoa2 and 7#b7 that was rebuilt outside of the ,united ,states before ,january #a1 #bjaa4 4 #ah4 ,effects of minimum wage differentials in ,american ,samoa ,section #hajd of the ,fair ,minimum ,wage ,act of #bjjg 7#bi ,u4,s4,c4 #bjf note7 is amended by adding at the end the following3 7c7 ,effects of ,minimum ,wage differentials in ,american ,samoa ,the reports required under this section shall include an analysis of the economic effects on employees and employers of the differentials in minimum wage rates among industries and classifications in ,american ,samoa under section #fig of title #bi1 ,code of ,federal ,regulations1 including the potential effects of eliminating such differentials prior to the time when such rates are scheduled to be equal to the minimum wage set forth in section #f7;a77#a7 of the ,fair ,labor ,standards ,act 7#bi ,u4,s4,c4 birth4 7,b7 ,the term national of the ,united ,states is defined under the ,immigration and ,nationality ,act to include persons who1 though not citizens of the ,united ,states1 owe permanent allegiance to the ,united ,states4 7,c7 ,for more than #ajj years1 ,american ,samoans who are ,united ,states nationals have demonstrated their loyalty and allegiance to the ,united ,states4 ,on ,april #ag1 #aijj1 the village chiefs of ,tutuila and ,aunu'u ceded their islands to the ,united ,states4 ,on ,july #af1 #aijd1 his ,majesty ,king ,tuimanu'a of the ,manu'a ,islands and his village chiefs did the same4 ,on ,february #bj1 #aibi1 the ,united ,states ,congress officially ratified the ,treaty of ,cession of ,tutuila and ,aunu'u and the ,treaty of ,cession of ,manu'a4 ,on ,march #d1 advance the economic1 social and political development of the territories of the ,united ,states4 7#b7 ,purpose ,the purpose of this section is to provide for a federally authorized vote in ,american ,samoa on the question of citizenship and if a majority of voters vote for citizenship1 to describe the steps that the ,president and ,congress shall take to enable ,american ,samoans to be granted
