,security ,act to prohibit ,states from 
charging child support recipients for   
the collection of child support4  #a4   
,short title ,this ,act may be cited as 
the ,elimination of ,single ,parent ,tax
 ,act of #bjac4  #b4 ,prohibition on    
,states from charging child support     
recipients for the collection of child  
support ,section #ded7f77;,b77ii7 of the
 ,social ,security ,act 7#db ,u4,s4,c4  
#fed7f77;,b77ii77 is amended--  7#a7 by 
striking retained by the ,state from    
support collected on behalf of the      
individual 7but not from the first #ejj 
so collected71 paid by the individual   
applying for the services12 and  7#b7 by
 striking the comma after absent parent4
  #c4 ,conforming amendments ,section   

#deg7;a77#d7 of the ,social ,security   
,act 7#db ,u4,s4,c4 #feg7;a77#d77 is    
amended--  7#a7 by striking the portion 
of 2 and  7#b7 by striking that remains 
after withholding any fee pursuant to   
section #ded7f77;,b77ii74  #d4          
,effective date  7a7 ,in general ,except
 as otherwise provided in subsection    
7b71 each amendment made by this ,act   
shall take effect on ,october #a1 #bjac1
 and shall apply to payments under part 
,d of title ,,iv of the ,social         
,security ,act for quarters beginning on
 or after such date4  7b7 ,delay        
permitted if state legislation required 
7#a7 ,in general ,until the date        
described in paragraph 7#b71 a qualified
 ,state plan shall not be regarded as   
failing to comply with part ,d of title 
,,iv of the ,social ,security ,act1     
solely by reason of the plan failing to 
comply with the additional requirements 
imposed by reason of this ,act4  7#b7   
,date described  7,a7 ,in general ,the  
date described in this paragraph is the 

first day of the first calendar quarter 
that begins after the close of the first
 regular session of the ,state          
legislature that ends after the         
effective date of this ,act4  7,b7      
,special rule ,for purposes of          
subparagraph 7,a71 in the case of a     
,state that has a #b-year legislative   
session1 each year of the session is    
deemed to be a separate regular session 
of the ,state legislature4  7#c7        
,qualified state plan ,in paragraph     
7#a71 the term qualified ,state plan    
means a ,state plan1 approved under part
 ,d of title ,,iv of the ,social        
,security ,act1 which the ,secretary of 
,health and ,human ,services determines 
will require ,state legislation 7other  
than legislation appropriating funds7 in
 order for the plan to meet the         
additional requirements imposed by      
reason of this ,act4
