7#a7 ,federal land ,the term ,federal land means the approximately #idh acres of ,bureau of ,reclamation and ,bureau of ,land ,management land within the ,three ,kids ,mine ,project ,site1 as depicted on the map4 7#b7 ,hazardous substance2 pollutant or contaminant2 remedy ,the terms hazardous substance1 pollutant or contaminant1 and remedy have the meanings given those terms in section #aja of the ,comprehensive ,environmental ,response1 ,compensation1 and ,liability ,act of #aihj 7#db ,u4,s4,c4 #ifja74 7#c7 ,henderson ,redevelopment ,agency ,the term ,henderson ,redevelopment ,agency means the redevelopment agency of the ,city of ,henderson1 ,nevada1 established and authorized to transact business and exercise the powers of the agency in accordance with the ,nevada ,community ,redevelopment ,law 7,nev4 ,rev4 ,stat4 #bgi4chb to #bgi4fhe74 7#d7 ,map ,the term map means the map entitled ,three ,kids ,mine ,project ,area and dated ,february #f1 #bjab4 7#e7 ,responsible ,party ,the term ,responsible ,party means the private sector entity designated by the ,henderson ,redevelopment ,agency1 and approved by the ,state of ,nevada1 to complete the assessment1 remediation1 reclamation and redevelopment of the ,three ,kids ,mine ,project ,site74 7#f7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#g7 ,state ,the term ,state means the ,state of ,nevada4 7#h7 ,three ,kids ,mine ,project ,site ,the term ,three ,kids ,mine ,project ,site means the approximately #a1bfb acres of land that is-- 7,a7 comprised of-- 7i7 the ,federal land2 and 7ii7 the approximately #cad acres of adjacent non-,federal land2 and 7,b7 depicted as the ,three ,kids ,mine ,project ,site on the map4 #c4 ,land conveyance 7a7 ,in general ,notwithstanding sections #bjb and #bjc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agab1 #agac71 not later than #ij days after the date on which the ,secretary determines that the conditions described in subsection 7b7 have been met1 and subject to valid existing rights and applicable law1 the ,secretary shall convey to the ,henderson ,redevelopment ,agency all right1 title1 and interest of the ,united ,states in and to the ,federal land4 7b7 ,conditions 7#a7 ,appraisal2 fair market value 7,a7 ,in general ,as consideration for the conveyance under subsection 7a71 the ,henderson ,redevelopment ,agency shall pay the fair market value of the ,federal land1 if any1 as determined under subparagraph 7,b7 and as adjusted under subparagraph 7,f74 7,b7 ,appraisal ,the ,secretary shall determine the fair market value of the ,federal land based on an appraisal-- 7i7 that is conducted in accordance with nationally recognized appraisal standards1 including-- 7,i7 the ,uniform ,appraisal ,standards for ,federal ,land ,acquisitions2 and 7,,ii7 the ,uniform ,standards of ,professional ,appraisal ,practice2 and 7ii7 that does not take into account any existing contamination associated with historical mining on the ,federal land4 7,c7 ,remediation and reclamation costs 7i7 ,in general ,the ,secretary shall prepare a reasonable estimate of the costs to assess1 remediate1 and reclaim the ,three ,kids ,mine ,project ,site4 7ii7 ,considerations ,the estimate prepared under clause 7i7 shall be-- 7,i7 based on the results of a comprehensive ,phase ,,ii environmental site assessment of the ,three ,kids ,mine ,project ,site prepared by the ,henderson ,redevelopment ,agency or a ,responsible ,party that has been approved by the ,state2 and 7,,ii7 prepared in accordance with the current version of the ,,astm ,international ,standard ,e-#bacg-jf 7#bjaa7 entitled ,standard ,guide for ,estimating ,monetary ,costs and ,liabilities for ,environmental ,matters4 7iii7 ,assessment requirements ,the ,phase ,,ii environmental site assessment prepared under clause 7ii77,i7 shall1 without limiting any additional requirements that may be required by the ,state1 be conducted in accordance with the procedures of-- 7,i7 the most recent version of ,,astm ,international ,standard ,e-#aebg-je entitled ,standard ,practice for ,environmental ,site ,assessments3 ,phase ,i ,environmental ,site ,assessment ,process2 and 7,,ii7 the most recent version of ,,astm ,international ,standard ,e-#aijc-aa entitled ,standard ,guide for ,environmental ,site ,assessments3 ,phase ,,ii ,environmental ,site ,assessment ,process4 7iv7 ,review of certain information 7,i7 ,in general ,the ,secretary shall review and consider cost information proffered by the ,henderson ,redevelopment ,agency1 the ,responsible ,party1 and the ,state in the preparation of the estimate under this subparagraph4 7,,ii7 ,final determination ,if there is a disagreement among the ,secretary1 ,henderson ,redevelopment ,agency1 and the ,state over the reasonable estimate of costs under this subparagraph1 the parties shall jointly select #a or more experts to assist the ,secretary in making the final estimate of the costs4 7,d7 ,deadline ,not later than #cj days after the date of enactment of this ,act1 the ,secretary shall begin the appraisal and cost estimates under subparagraphs 7,b7 and 7,c71 respectively4 7,e7 ,appraisal costs ,the ,henderson ,redevelopment ,agency or the ,responsible ,party shall reimburse the ,secretary for the costs incurred in performing the appraisal under subparagraph 7,b74 7,f7 ,adjustment ,the ,secretary shall administratively adjust the fair market value of the ,federal land1 as determined under subparagraph 7,b71 based on the estimate of remediation1 and reclamation costs1 as determined under subparagraph 7,c74 7#b7 ,mine remediation and reclamation agreement executed 7,a7 ,in general ,the conveyance under subsection 7a7 shall be contingent on-- 7i7 the ,secretary receiving from the ,state written notification that a mine remediation and reclamation agreement has been executed in accordance with subparagraph 7,b72 and 7ii7 the ,secretary concurring1 not later than #cj days after the date of receipt of the written notification under clause 7i71 that the requirements under subparagraph 7,b7 have been met4 7,b7 ,requirements ,the mine remediation and reclamation agreement required under subparagraph 7,a7 shall be an enforceable consent order or agreement between the ,state and the ,responsible ,party who will be obligated to perform under the consent order or agreement administered by the ,state that-- 7i7 obligates the ,responsible ,party to perform1 after the conveyance of the ,federal land under this ,act1 the remediation and reclamation work at the ,three ,kids ,mine ,project ,site necessary to ensure all remedial actions necessary to protect human health and the environment with respect to any hazardous substances1 pollutant1 or contaminant will be taken1 in accordance with all ,federal1 ,state1 and local requirements2 and 7ii7 contains provisions determined to be necessary by the ,state and the ,henderson ,redevelopment ,agency1 including financial assurance provisions to ensure the completion of the remedy4 7#c7 ,notification from agency ,as a condition of the conveyance under subsection 7a71 not later than #ij days after the date of execution of the mine remediation and reclamation agreement required under paragraph 7#b71 the ,secretary shall accept written notification from the ,henderson ,redevelopment ,agency that the ,henderson ,redevelopment ,agency is prepared to accept conveyance of the ,federal land under subsection 7a74 #d4 ,withdrawal 7a7 ,in general ,subject to valid existing rights1 for the #aj-year period beginning on the earlier of the date of enactment of this ,act or the date of the conveyance required by this ,act1 the ,federal land is withdrawn from all forms of-- 7#a7 entry1 appropriation1 operation1 or disposal under the public land laws2 7#b7 location1 entry1 and patent under the mining laws2 and 7#c7 disposition under the mineral leasing1 mineral materials1 and the geothermal leasing laws4 7b7 ,existing reclamation withdrawals ,subject to valid existing rights1 any withdrawal under the public land laws that includes all or any portion of the ,federal land for which the ,bureau of ,reclamation has determined that the ,bureau of ,reclamation has no further need under applicable law is relinquished and revoked solely to the extent necessary-- 7#a7 to exclude from the withdrawal the property that is no longer needed2 and 7#b7 to allow for the immediate conveyance of the ,federal land as required under this ,act4 7c7 ,existing ,reclamation ,project and ,permitted ,facilities ,except as provided in subsection 7a71 nothing in this ,act diminishes1 hinders1 or interferes with the exclusive and perpetual use by the existing rights holders for the operation1 maintenance1 and improvement of water conveyance infrastructure and facilities1 including all necessary ingress and egress1 situated on the ,federal land that were constructed or permitted by the ,bureau of ,reclamation before the effective date of this ,act4 #e4 ,,acec boundary adjustment ,notwithstanding section #bjc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agac71 the boundary of the ,river ,mountains ,area of ,critical ,environmental ,concern 7,,nvn #gfhhd7 is adjusted to exclude any portion of the ,three ,kids ,mine ,project ,site consistent with the map4 #f4 ,responsibilities of the parties 7a7 ,responsibility of parties to mine remediation and reclamation agreement ,on completion of the conveyance under section #c1 the responsibility for complying with the mine remediation and reclamation agreement executed under section #c7;b77#b7 shall apply to the ,responsible ,party and the ,state of ,nevada4 7b7 ,savings provision ,if the conveyance under this ,act has occurred1 but the terms of the agreement executed under section #c7;b77#b7 have not been met1 nothing in this ,act-- 7#a7 affects the responsibility of the ,secretary to take any additional response action necessary to protect public health and the environment from a release or the threat of a release of a hazardous substance1 pollutant1 or contaminant2 or 7#b7 unless otherwise expressly provided1 modifies1 limits1 or otherwise affects-- 7,a7 the application of1 or obligation to comply with1 any law1 including any environmental or public health law2 or 7,b7 the authority of the ,united ,states to enforce compliance with the requirements of any law or the agreement executed under section #c7;b77#b74 #g4 ,southern ,nevada ,public ,lands ,management ,act ,southern ,nevada ,public ,land ,management ,act of #aiih 7#ca ,u4,s4,c4 #fija note2 ,public ,law #aje-bfc7 shall not apply to land conveyed under this ,act4 ,july #h1 #bjac ,reported with an amendment1 committed to the ,committee of the ,whole ,house on the ,state of the ,union1 and ordered to be printed
