operation of ,melville ,hall at the     
,united ,states ,merchant ,marine       
,academy1 after receipt of a gift from  
the ,united ,states ,merchant ,marine   
,academy ,alumni ,association and       
,foundation1 ,inc41 for renovation of   
such hall and for other purposes4  #a4  
,short title ,this ,act may be cited as 
the ,u4,s4 ,merchant ,marine ,academy   
,improvement ,act of #bjad4  #b4        
,melville ,hall of ,united ,states      
,merchant ,marine ,academy  7a7 ,gift to
 the ,merchant ,marine ,academy ,the    
,maritime ,administrator may accept a   
gift of money from the ,foundation under
 section #eacae of title #df1 ,united   
,states ,code1 for the purpose of       

renovating ,melville ,hall on the campus
 of the ,united ,states ,merchant       
,marine ,academy4  7b7 ,covered gifts ,a
 gift described in this subsection is a 
gift under subsection 7a7 that the      
,maritime ,administrator determines     
exceeds the sum of--  7#a7 the minimum  
amount that is sufficient to ensure the 
renovation of ,melville ,hall in        
accordance with the capital improvement 
plan of the ,united ,states ,merchant   
,marine ,academy that was in effect on  
the date of enactment of this ,act2 and 
7#b7 #be percent of the amount described
 in paragraph 7#a74  7c7 ,operation     
contracts ,subject to subsection 7d71 in
 the case that the ,maritime            
,administrator accepts a gift of money  
described in subsection 7b71 the        
,maritime ,administrator may enter into 
a contract with the ,foundation for the 
operation of ,melville ,hall to make    
available facilities for1 among other   
possible uses1 official academy         
functions1 third-party catering         

functions1 and industry events and      
conferences4  7d7 ,contract terms ,the  
contract described in subsection 7c7    
shall be for such period and on such    
terms as the ,maritime ,administrator   
considers appropriate1 including a      
provision1 mutually agreeable to the    
,maritime ,administrator and the        
,foundation1 that--  7#a7 requires the  
,foundation--  7,a7 at the expense      
solely of the ,foundation through the   
term of the contract to maintain        
,melville ,hall in a condition that is  
as good as or better than the condition 
,melville ,hall was in on the later of--
  7i7 the date that the renovation of   
,melville ,hall was completed2 or  7ii7 
the date that the ,foundation accepted  
,melville ,hall after it was tendered to
 the ,foundation by the ,maritime       
,administrator2 and  7,b7 to deposit all
 proceeds from the operation of         
,melville ,hall1 after expenses         
necessary for the operation and         
maintenance of ,melville ,hall1 into the

 account of the ,regimental ,affairs    
,non-,appropriated ,fund                
,instrumentality or successor entity1 to
 be used solely for the morale and      
welfare of the cadets of the ,united    
,states ,merchant ,marine ,academy2 and 
7#b7 prohibits the use of ,melville     
,hall as lodging or an office by any    
person for more than #d days in any     
calendar year other than--  7,a7 by the 
,united ,states2 or  7,b7 for the       
administration and operation of         
,melville ,hall4  7e7 ,definitions ,in  
this section3  7#a7 ,contract ,the term 
contract includes any modification1     
extension1 or renewal of the contract4  
7#b7 ,foundation ,in this section1 the  
term ,foundation means the ,united      
,states ,merchant ,marine ,academy      
,alumni ,association and ,foundation1   
,inc4  7f7 ,rules of construction       
,nothing in this section may be         
construed under section #caje of title  
#da1 ,united ,states ,code1 as requiring
 the ,maritime ,administrator to award a

 contract for the operation of ,melville
 ,hall to the ,foundation4
