,states ,code1 to require that ,federal1
 ,state1 and local agencies to which    
surplus military equipment and personal 
property is sold or donated demonstrate 
that agency personnel are certified1    
trained1 or licensed1 as appropriate1 in
 the proper operation of the equipment  
prior to the sale or donation4  #a4     
,requirement that ,state and local      
agencies receive training in proper     
operation of surplus military equipment 
and property prior to sale or transfer  
of equipment by ,department of ,defense 
7a7 ,sale to ,state and local law       
enforcement1 firefighting1 homeland     
security1 and emergency management      
agencies ,section #begf of title #aj1   
,united ,states ,code1 is amended by    

adding at the end the following new     
subsection3  7c7 ,the ,secretary of     
,defense shall require1 as a condition  
of the sale of any surplus military     
equipment under this section1 that the  
,state or local law enforcement1        
firefighting1 homeland security1 or     
emergency management agency purchasing  
the equipment demonstrates1 prior to the
 sale of the equipment1 that agency     
personnel have been certified1 trained1 
or licensed1 as appropriate1 in the     
proper operation of the equipment4  4   
7b7 ,sale or donation for law           
enforcement activities ,section         
#begf;a7b7 of such title is amended--   
7#a7 in paragraph 7#c71 by striking and 
at the end2  7#b7 in paragraph 7#d71 by 
striking the period and inserting 2 and2
 and  7#c7 by adding at the end the     
following new paragraph3  7#e7 the      
recipient agency demonstrates1 prior to 
the transfer1 that agency personnel have
 been certified1 trained1 or licensed1  
as appropriate1 in the proper operation 

of the property4  4  7c7 ,sale or       
donation ,to assist firefighting        
agencies ,section #begf;b of such title 
is amended--  7#a7 in paragraph 7#c71 by
 striking and at the end2  7#b7 in      
paragraph 7#d71 by striking the period  
and inserting 2 and2 and  7#c7 by adding
 at the end the following new paragraph3
  7#e7 the recipient agency             
demonstrates1 prior to the transfer1    
that agency personnel have been         
certified1 trained1 or licensed1 as     
appropriate1 in the proper operation of 
the property4  4  7d7 ,effective date   
,the amendments made by this ,act shall 
apply with respect to the sale1         
transfer1 or donation of property or    
equipment made after the date of the    
enactment of this ,act4
