,patient ,protection and ,affordable    
,care ,act to allow sole proprietors and
 the spouses and domestic partners of   
sole proprietors to purchase insurance  
on the small business exchange1 and for 
other purposes4  #a4 ,short title ,this 
,act may be cited as the ,mom and ,pop  
,,shop ,act of #bjad1 the ,mom and ,mom 
,,shop ,act of #bjad1 or the ,pop and   
,pop ,,shop ,act of #bjad4  #b4         
,allowing sole proprietors and their    
spouses and domestic partners to        
purchase insurance on the ,,ppaca small 
business exchange  7a7 ,treating sole   
proprietors and their spouses and       
domestic partners as qualified employers
 in small business exchange ,section    
#acab7;f77#b77;,a7 of the ,patient      

,protection and ,affordable ,care ,act  
7#db ,u4,s4,c4 #ahjcb7;f77#b77;,a77 is  
amended by adding at the end the        
following new sentence3 ,for purposes of
 section #acaa1 the reference to a small
 employer in the preceding sentence     
includes an individual 7and the spouse  
or domestic partner of such individual1 
if any7 who owns1 or who is a partner   
in1 a trade or business that has no     
employees and that is not an ,s         
corporation 7as defined in section      
#acfa7;a77#a7 of the ,internal ,revenue 
,code of #aihf74  7b7 ,treating sole    
proprietors and their spouses and       
domestic partners as small employers in 
small business exchange ,section        
#acjd7;b77#b7 of the ,patient           
,protection and ,affordable ,care ,act  
7#db ,u4,s4,c4 #ahjbd7;b77#b77 is       
amended by adding at the end the        
following new sentence3 ,for purposes of
 section #acaa1 such term also includes 
an individual 7and the spouse or        
domestic partner of such individual1 if 

any7 who owns1 or who is a partner in1 a
 trade or business that has no employees
 and that is not an ,s corporation 7as  
defined in section #acfa7;a77#a7 of the 
,internal ,revenue ,code of #aihf74  7c7
 ,treating health plans for sole        
proprietors and their spouses and       
domestic partners as group health plans 
in small business exchange ,section     
#acjd7;a77#c7 of the ,patient           
,protection and ,affordable ,care ,act  
7#db ,u4,s4,c4 #ahjbd7;a77#c77 is       
amended by adding at the end the        
following new sentence3 ,in determining 
whether a health plan is a group health 
plan under the preceding sentence for   
purposes of section #acaa1 an individual
 7and the spouse or domestic partner of 
such individual1 if any7 who owns1 or   
who is a partner in1 a trade or business
 shall be considered both an employer   
and an employee of such trade or        
business4
