increased ,federal funding for ,medicaid expansion with respect to inmates' hospital care under the ,patient ,protection and ,affordable ,care ,act1 to apply the savings towards a #bjae ,medicare ,advantage stabilization program to help protect seniors' choices1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,protecting ,seniors' ,medicare ,choices from ,obamacare ,act of #bjad4 #b4 ,eliminating ,,ppaca enhanced ,medicaid ,,fmap for prisoners and applying savings to ,medicare ,advantage ,improvement ,fund 7a7 ,elimination of ,,ppaca enhanced ,medicaid ,,fmap for prisoners 7#a7 ,in general ,section #aije of the ,social ,security ,act 7#db ,u4,s4,c4 #acif;d7 is amended-- 7,a7 in subsection 7y77#b77;,a71 by adding at the end the following3 ,such term does not include an individual described in such subparagraph during the period in which the individual is an inmate in a public institution or in which the public institution maintains jurisdiction over the individual42 and 7,b7 in subsection 7z77#a77;,a71 by inserting before the period at the end the following3 and who are not inmates of a public institution 7or individuals over whom a public institution maintains jurisdiction74 7#b7 ,effective date ,the amendments made by paragraph 7#a7 shall apply to items and services furnished on or after ,january #a1 #bjae4 7b7 ,application of savings to #bjae to establishment of #bjae ,medicare ,advantage stabilization program ,section #ahei of the ,social ,security ,act 7#db ,u4,s4,c4 #aciew-#bh7 is amended by adding at the end the following new subsection3 7h7 #bjae ,medicare ,advantage stabilization program 7#a7 ,establishment ,there is established a ,medicare ,advantage stabilization program 7in this subsection referred to as the stabilization program7 under which the ,secretary shall1 subject to paragraph 7#f71 provide a ,,pmpm stabilization funding amount to each eligible ,medicare ,advantage plan in accordance with this subsection to be used by such plan for plan year #bjae to address the beneficiary plan inadequacies applicable to such plan 7as described in paragraph 7#e774 7#b7 ,eligible ,medicare ,advantage plans ,for purposes of this subsection1 an eligible ,medicare ,advantage plan is a ,medicare ,advantage plan to be offered for plan year #bjae that the ,secretary determines1 based on the bid of such plan submitted under section #ahed for such plan year1 satisfies at least one of the following criteria3 7,a7 ,increased beneficiary costs ,the total costs 7including premiums1 cost-sharing responsibilities1 and deductibles7 projected to be applicable to individuals who enroll in such plan for such plan year are at least #g percent more than the such total costs that were applicable to individuals enrolled in such plan for plan year #bjad4 7,b7 ,decreased supplemental benefits ,the supplemental benefits to be offered under such plan for such plan year #bjae are less than the supplemental benefits offered under such plan for plan year #bjad4 7,c7 ,decreased provider network ,the number of physicians in the plan's network has been reduced by #c percent or more from plan year #bjad to plan year #bjae4 7#c7 ,distribution of ,,pmpm stabilization funding amounts 7,a7 ,in general ,subject to the availability of funds under paragraph 7#f71 under the stabilization program1 the ,secretary shall distribute1 not later than ,december #ca1 #bjad1 to each eligible ,medicare ,advantage plan a ,,pmpm stabilization funding amount1 as determined by the ,secretary in accordance with subparagraph 7,b74 7,b7 ,,pmpm stabilization funding amount ,a ,,pmpm stabilization funding amount1 with respect to an eligible ,medicare ,advantage plan1 shall be determined in accordance with the following3 7i7 ,such amount shall be an amount1 with respect to each month of plan year #bjae1 for each individual projected to be enrolled in such plan for such plan year4 7ii7 ,subject to paragraph 7#f7 and clause 7iii71 such amount shall be an amount determined by the ,secretary to be sufficient for such plan to address for plan year #bjae each beneficiary plan inadequacy specified in paragraph 7#d7 applicable to such plan4 7iii7 ,such amount shall not be more than #he per member per month4 7#d7 ,timing of determinations ,under the stabilization program1 the ,secretary shall determine which ,medicare ,advantage plans are eligible ,medicare ,advantage plans under paragraph 7#b71 and the ,,pmpm stabilization funding amount to be distributed to each such eligible ,medicare ,advantage plan under paragraph 7#c71 by not later than ,october #ae1 #bjad4 7#e7 ,applicable beneficiary plan inadequacies ,for purposes of this subsection1 a beneficiary plan inadequacy applicable to an eligible ,medicare ,advantage plan is each of the criteria described in paragraph 7#b7 that the ,secretary determined the plan satisfied for qualifying as such an eligible ,medicare ,advantage plan4 7#f7 ,funding 7,a7 ,in general ,there shall be available to the ,secretary from amounts in the general fund in the ,treasury not otherwise appropriated an amount1 not to exceed #c1jjj1jjj1jjj1 to carry out this subsection4 ,such amounts shall remain so available until ,december #ca1 #bjae4 ,any amounts made so available but not expended on or before such date shall be transferred to the general fund in the ,treasury4 7,b7 ,clarification ,payments under the stabilization program shall not be taken into account for purposes of determining the premium payments applicable under part ,b4 4
