jurisdiction of the committee concerned ,a ,,bill ,to amend the ,communications ,act of #aicd to provide for greater access to in-,state television broadcast programming1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,orphan ,county ,telecommunications ,rights ,act of #bjad4 #b4 ,modification of local television markets 7a7 ,in general ,part ,i of title ,,iii of the ,communications ,act of #aicd 7#dg ,u4,s4,c4 #cja et seq47 is amended by adding at the end the following3 #cdc4 ,modification of local television markets 7a7 ,in general ,the adjacent underserved county of a television broadcast station may file with the ,commission a petition for the inclusion of such county in the local market of such station4 ,not later than #abj days after receiving such a petition1 the ,commission shall grant such petition by modifying the local market of such station by including such county in such market4 7b7 ,multiple markets ,the ,commission may determine under subsection 7a7 that a particular county is part of the local market of more than one television broadcast station affiliated with the same television network4 7c7 ,single petition ,a county may request the inclusion of such county in the local market of more than one television broadcast station in a single petition filed under subsection 7a74 7d7 ,point of contact with county ,a county that files a petition under subsection 7a7 shall designate an official or body to communicate with the ,commission about matters relating to such petition4 7e7 ,carriage during pendency of proceeding ,during the pendency of a proceeding on a petition under subsection 7a7 for the inclusion of a county in the local market of a television broadcast station1 a multichannel video programming distributor may not delete from carriage the signal of a television broadcast station-- 7#a7 that is affiliated with the same television network2 and 7#b7 the local market of which includes such county4 7f7 ,definitions ,in this section3 7#a7 ,adjacent market 7,a7 ,in general ,the term adjacent market means1 with respect to a television broadcast station1 any designated market area adjacent to1 and partially but not entirely in the same ,state as1 the designated market area in which the station's community of license is located4 7,b7 ,treatment of certain counties ,in the case of a county that is not within the local market or the adjacent market 7as defined in subparagraph 7,a77 of any network station licensed to a community in the ,state in which such county is located1 such county shall be considered to be within the adjacent market of any television broadcast station licensed to a community in the nearest designated market area-- 7i7 that is located in whole or in part within such ,state2 and 7ii7 with respect to which the community of license of at least one network station is located both in such designated market area and in such ,state4 7#b7 ,adjacent underserved county ,the term adjacent underserved county means1 with respect to a television broadcast station1 a county within the station's adjacent market that is both-- 7,a7 located in the same ,state as the station's community of license2 and 7,b7 not within the local market of any other station that is both affiliated with the same television network and located in the same ,state4 7#c7 ,cable operator ,the term cable operator has the meaning given such term in section #fjb4 7#d7 ,county ,the term county means a county1 parish1 or similar political subdivision of a ,state of the type generally used in determining the boundaries of designated market areas4 7#e7 ,designated market area ,the term designated market area has the meaning given such term in section #abb7;j77#b77;,c7 of title #ag1 ,united ,states ,code4 7#f7 ,local market ,the term local market means1 with respect to a television broadcast station-- 7,a7 for purposes of carriage of such station by satellite carriers1 the local market of such station as determined under section #abb7;j77#b7 of title #ag1 ,united ,states ,code2 and 7,b7 for purposes of carriage of such station by cable operators1 the television market of such station as determined under section #fad7;h77#a77;,c74 7#g7 ,multichannel video programming distributor ,the term multichannel video programming distributor has the meaning given such term in section #fjb4 7#h7 ,network station ,the term network station has the meaning given such term in section #aai7;d7 of title #ag1 ,united ,states ,code4 7#i7 ,satellite carrier ,the term satellite carrier has the meaning given such term in section #aai7;d7 of title #ag1 ,united ,states ,code4 7#aj7 ,television broadcast station ,the term television broadcast station has the meaning given such term in section #cbe7;b74 7#aa7 ,television network ,the term television network has the meaning given such term in section #cci7;d74 4 7b7 ,effect for purposes of cable carriage ,section #fad7;h77#a77;,c7 of the ,communications ,act of #aicd 7#dg ,u4,s4,c4 #ecd7;h77#a77;,c77 is amended-- 7#a7 by moving the margin of clause 7iv7 two ems to the left2 and 7#b7 by adding at the end the following3 7v7 ,if the ,commission modifies the local market of a television broadcast station under section #cdc by including a county in such market1 the ,commission shall include within the television market of such station for purposes of this section all of the communities within such county4 4 7c7 ,effect for purposes of satellite carriage ,section #abb7;j77#b7 of title #ag1 ,united ,states ,code1 is amended by adding at the end the following3 7,e7 ,modification by ,,fcc ,if the ,federal ,communications ,commission modifies the local market of a television broadcast station under section #cdc of the ,communications ,act of #aicd1 such modification shall modify the local market of such station as determined under this paragraph4 4
