,existing authorizations4 #b4 ,findings2 purposes 7a7 ,findings ,congress finds that-- 7#a7 the ,monticello ,dam-- 7,a7 was authorized by the ,reclamation ,project ,act of #aici 7#ec ,stat4 #aahg72 7,b7 resulted in the formation of ,lake ,berryessa2 and 7,c7 is operated by the ,bureau of ,reclamation2 7#b7 ,lake ,berryessa-- 7,a7 covers approximately #bh1iae acres of surface water and land2 7,b7 has #afe miles of shoreline2 7,c7 has a #b1jjj acre wildlife area on the east side2 7,d7 is located less than #ajj miles from both ,sacramento1 ,california and ,san ,francisco1 ,california2 and 7,e7 has become an important regional recreation destination2 and 7#c7 the recreational use at ,lake ,berryessa generates tourism that is important to local economies4 7b7 ,purposes ,the purposes of this ,act are-- 7#a7 to provide diverse1 high quality recreational facilities and services on the water and land surrounding ,lake ,berryessa2 7#b7 to conserve the natural1 scenic1 scientific1 historic1 economic1 recreational1 and other resource values contributing to the public use and enjoyment of that land and water2 7#c7 to promote cooperation between the ,federal ,government and private entities to manage that exceptional resource2 7#d7 to authorize the ,secretary to manage certain resources under the ,bureau of ,land ,management2 and 7#e7 to transfer administrative jurisdiction over certain ,federal land for management as a unit of the ,bureau of ,land ,management4 #c4 ,definitions ,in this ,act3 7#a7 ,dam ,the term ,dam means-- 7,a7 the ,monticello ,dam2 and 7,b7 any facility relating to the ,monticello ,dam4 7#b7 ,recreation area ,the term ,recreation ,area means the ,lake ,berryessa ,recreation ,area designated by section #d7;a74 7#c7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#d7 ,state ,the term ,state means the ,state of ,california4 #d4 ,transfer of administrative jurisdiction 7a7 ,establishment ,subject to valid existing rights1 there is established the ,lake ,berryessa ,recreational ,area1 the boundaries of which are described in subsection 7c74 ,in administering the ,recreation ,area1 the ,secretary shall not-- 7#a7 diminish the levels of day-use occupancy1 short-term occupancy and annual occupancy as set forth in the recreational use plan adopted by the ,bureau of ,reclamation on ,june #b1 #bjjf1 for the ,recreation ,area2 7#b7 diminish motorized boating or alter the ,water ,surface ,zoning and ,restrictions developed under ,action #ag of the #aiic ,recreation ,area ,management ,plan ,record of ,decision and continued in the recreational use plan adopted by the ,bureau of ,reclamation on ,june #b1 #bjjf1 for the ,recreation ,area2 7#c7 close trails or limit recreational hiking and equine access to trails on lands in the ,recreation ,area2 and 7#d7 negatively impact hunting1 fishing1 shooting sports1 or trapping on the lands and waters within the boundaries of the ,recreation ,area4 7b7 ,transfer of administrative jurisdiction ,administrative jurisdiction over the ,federal land described in subsection 7c71 including any improvements thereon1 is transferred from the ,bureau of ,reclamation to the ,bureau of ,land ,management for administration of the ,recreation ,area4 7c7 ,description of land ,the land referred to in subsection 7a7 is the approximately #cj1bba acres of land administered by the ,bureau of ,reclamation that is underlying or adjacent to ,lake ,berryessa and identified as ,lake ,berryessa ,reclamation ,lands ,solono ,project on the map dated ,september #ae1 #bjad4 #e4 ,management of ,recreation ,area 7a7 ,in general ,subject to the authority of the ,secretary under section #f1 the ,secretary shall manage the ,recreation ,area in accordance with sections #fja through #fjd of ,public ,law #ic-dic4 7b7 ,applicable law ,subject to valid existing rights1 the ,secretary shall administer the ,recreation ,area in accordance with laws 7including regulations7 applicable to units of the public lands of the ,bureau of ,land ,management4 7c7 ,waters ,nothing in this ,act-- 7#a7 affects the use or allocation1 in existence on the date of the enactment of this ,act1 of any water1 water right1 or interest in water2 7#b7 affects any vested absolute or decreed conditional water right in existence on the date of the enactment of this ,act1 including any water right held by the ,united ,states2 7#c7 affects any interstate water compact in existence on the date of the enactment of this ,act2 7#d7 authorizes or imposes any new reserved ,federal water rights2 7#e7 relinquishes or reduces any water rights reserved or appropriated by the ,united ,states in the ,state on or before the date of the enactment of this ,act2 7#f7 impairs the ability of the ,bureau of ,reclamation and its managing partners to operate1 maintain1 or manage ,monticello ,dam and other ,solano ,project facilities in accordance with the purposes of such project2 or 7#g7 modifies1 changes1 or supersedes any water contract or agreements approved or administered by the ,bureau of ,reclamation or ,solano ,county ,water ,agency or ,solano ,irrigation ,district4 7d7 ,existing agreements ,to benefit the interests of the public1 the ,secretary shall act in accordance with any agreement in existence on the date of the enactment of this ,act1 including those with any organization for the management of-- 7#a7 campgrounds located in the ,recreation ,area2 7#b7 marinas located in the ,recreation ,area2 7#c7 lodging facilities located in the ,recreation ,area2 7#d7 food and beverage services located in the ,recreation ,area2 and 7#e7 boating and boat rental facilities located in the ,recreation ,area4 7e7 ,adoption of recreational use plan ,to manage the ,recreation ,area1 the ,secretary shall adopt and use the recreational use plan adopted by the ,bureau of ,reclamation on ,june #b1 #bjjf1 for the ,recreational ,area4 ,the adoption of this plan shall not constitute a major federal action for the purposes of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 ,this action is not subject to judicial review4 #f4 ,continued authorities of ,commissioner of ,reclamation ,nothing in this ,act or any subsequent management plan shall impair the ability of the ,bureau of ,reclamation and its managing partners to operate1 maintain1 or manage ,monticello ,dam1 ,lake ,berryessa1 and other ,solano ,project facilities in accordance with that project's authorized purposes4 ,the ,commissioner of ,reclamation shall continue to administer and operate-- 7#a7 the ,dam2 and 7#b7 any power facility relating to the ,dam4 #g4 ,existing authorizations 7a7 ,in general ,except as provided in subsections 7b7 and 7c71 nothing in this ,act affects any authorization in effect as of the date of the enactment of this ,act made by any department or agency of the ,federal ,government for the use of land or water located within the ,recreation ,area 7referred to in this section as an existing authorization74 7b7 ,assumption of existing authorization ,not later than #a year after the date of the enactment of this ,act1 the ,secretary shall assume the administration of any existing authorization1 with such revisions as necessary to align the authorization with existing law and policies of the ,bureau of ,land ,management4 7c7 ,renewal of existing authorization ,the renewal of any existing authorization shall be made in accordance with such terms and conditions as the ,secretary may prescribe4 ,december
