agencies to make considerations relating
 to the promotion of efficiency1        
competition1 and capital formation      
before issuing or modifying certain     
regulations4  #a4 ,rulemaking           
considerations ,section #ac of the ,bank
 ,holding ,company ,act of #aief 7#ab   
,u4,s4,c4 #ahea7 is amended by adding at
 the end the following3  7i7            
,consideration of ,promotion of         
,efficiency1 ,competition1 and ,capital 
,formation ,in issuing or modifying any 
regulation under this section1 the      
appropriate ,federal banking agencies1  
the ,commodity ,futures ,trading        
,commission1 and the ,securities and    
,exchange ,commission-- 7#a7 shall      

consider whether the regulation is      
necessary or appropriate in the public  
interest2  7#b7 shall consider whether  
the regulation will promote efficiency1 
competition1 and capital formation2     
7#c7 shall consider1 among other        
matters1 the impact the regulation would
 have on competition2  7#d7 may not     
adopt the regulation if it would impose 
a burden on competition not necessary or
 appropriate in furtherance of the      
purposes of this section2 and  7#e7     
shall include in the statement of basis 
and purpose incorporated in the         
regulation adopted under this section1  
the reasons for the determination under 
paragraph 7#d7 that any burden on       
competition imposed by the regulation is
 necessary or appropriate in furtherance
 of the purposes of this section4  4
