payment of monthly annuities under the  
,survivor ,benefit ,plan to a           
supplemental or special needs trust     
established for the sole benefit of a   
disabled dependent child of a           
participant in the ,survivor ,benefit   
,plan4  #a4 ,short title ,this ,act may 
be cited as the ,disabled ,military     
,child ,protection ,act of #bjac4  #b4  
,survivor ,benefit ,plan annuities for  
special needs trusts established for the
 benefit of dependent children incapable
 of self-support  7a7 ,special needs    
trust as eligible beneficiary  7#a7 ,in 
general ,subsection 7a7 of section #adej

 of title #aj1 ,united ,states ,code1 is
 amended--  7,a7 by redesignating       
paragraph 7#d7 as paragraph 7#e72 and   
7,b7 by inserting after paragraph 7#c7  
the following new paragraph 7#d73  7#d7 
,special needs trusts for sole benefit  
of certain dependent children           
,notwithstanding subsection 7i71 a      
supplemental or special needs trust     
described in subparagraph 7,a7 or 7,c7  
of section #aiag7;d77#d7 of the ,social 
,security ,act 7#db ,u4,s4,c4           
#acifp7d77#d77 that is established for  
the sole benefit of a dependent child   
considered disabled under section       
#afad7;a77#c7 of that ,act 7#db         
,u4,s4,c4 #achb;c7a77#c77 who is        
incapable of self-support because of    
mental or physical incapacity4  4  7#b7 
,conforming amendment ,subsection 7i7 of
 such section is amended by inserting   
7a77#d7 or after subsection4  7b7       
,regulations ,section #adee7;d7 of such 
title is amended--  7#a7 in the         
subsection heading1 by striking and     

fiduciaries and inserting 1 fiduciaries1
 and special needs trusts2  7#b7 in     
paragraph 7#a7--  7,a7 in subparagraph  
7,a71 by striking and at the end2  7,b7 
in subparagraph 7,b71 by striking the   
period at the end and inserting 2 and2  
and  7,c7 by adding at the end the      
following new subparagraph3  7,c7 a     
dependent child incapable of            
self-support because of mental or       
physical incapacity for whom a          
supplemental or special needs trust1 as 
described in subparagraph 7,a7 or 7,c7  
of section #aiag7;d77#d7 of the ,social 
,security ,act 7#db ,u4,s4,c4

  7#c7 in paragraph 7#b7--  7,a7 by     
redesignating subparagraphs 7,c7 through
 7,h7 as subparagraphs 7,d7 through     
7,i71 respectively2  7,b7 by inserting  
after subparagraph 7,b7 the following   
new subparagraph 7,c73  7,c7 ,in the    
case of an annuitant referred to in     
paragraph 7#a77;,c71 payment of the     
annuity to the supplemental or special  

needs trust established for the         
annuitant4  2  7,c7 in subparagraph     
7,d71 as redesignated1 by striking      
subparagraphs 7,d7 and 7,e7 and         
inserting subparagraphs 7,e7 and 7,f72  
and  7,d7 in subparagraph 7,h71 as so   
redesignated--  7i7 by inserting or     
7#a77;,c7 after paragraph 7#a77;,b7 in  
the matter preceding clause 7i72  7ii7  
in clause 7i71 by striking and at the   
end2  7iii7 in clause 7ii71 by striking 
the period at the end and inserting 2   
and2 and  7iv7 by adding at the end the 
following new clause3  7iii7 procedures 
for determining when annuity payments to
 a supplemental or special needs trust  
shall end based on the death or marriage
 of the dependent child for which the
