,united ,states ,code 7commonly known as
 the ,hobbs ,act71 and for other        
purposes4  #a4 ,short title ,this ,act  
may be cited as the ,freedom ,from      
,union ,violence ,act of #bjac4  #b4    
,interference with commerce by threats  
or violence ,section #aiea of title #ah1
 ,united ,states ,code1 is amended to   
read as follows3  #aiea4 ,interference  
with commerce by threats or violence    
7a7 ,prohibition ,except as provided in 
subsection 7c71 whoever in any way or   
degree obstructs1 delays1 or affects    

commerce or the movement of any article 
or commodity in commerce1 by robbery or 
extortion1 or attempts or conspires so  
to do1 or commits or threatens physical 
violence to any person or property in   
furtherance of a plan or purpose to do  
anything in violation of this section1  
shall be fined not more than #ajj1jjj1  
imprisoned for a term of not more than  
#bj years1 or both4  7b7 ,definitions   
,for purposes of this section--  7#a7   
the term commerce means any--  7,a7     
commerce within the ,district of        
,columbia1 or any territory or          
possession of the ,united ,states2  7,b7
 commerce between any point in a ,state1
 territory1 possession1 or the ,district
 of ,columbia and any point outside     
thereof2  7,c7 commerce between points  
within the same ,state through any place
 outside that ,state2 and  7,d7 other   
commerce over which the ,united ,states 
has jurisdiction2  7#b7 the term        
extortion means the obtaining of        
property from any person1 with the      

consent of that person1 if that consent 
is induced--  7,a7 by actual or         
threatened use of force or violence1 or 
fear thereof2  7,b7 by wrongful use of  
fear not involving force or violence2 or
  7,c7 under color of official right2   
7#c7 the term labor dispute has the same
 meaning as in section #b7i7 of the     
,national ,labor ,relations ,act 7#bi   
,u4,s4,c4 #aeb7i772 and  7#d7 the term  
robbery means the unlawful taking or    
obtaining of personal property from the 
person or in the presence of another1   
against his or her will1 by means of    
actual or threatened force or violence1 
or fear of injury1 immediate or future--
  7,a7 to his or her person or property1
 or property in his or her custody or   
possession2 or  7,b7 to the person or   
property of a relative or member of his 
or her family1 or of anyone in his or   
her company at the time of the taking or
 obtaining4  7c7 ,exempted conduct  7#a7
 ,in general ,subsection 7a7 does not   
apply to any conduct that--  7,a7 is    

incidental to otherwise peaceful        
picketing during the course of a labor  
dispute2  7,b7 consists solely of minor 
bodily injury1 or minor damage to       
property1 or threat or fear of such     
minor injury or damage2 and  7,c7 is not
 part of a pattern of violent conduct or
 of coordinated violent activity4  7#b7 
,state and local jurisdiction ,any      
violation of this section that involves 
any conduct described in paragraph 7#a7 
shall be subject to prosecution only by 
the appropriate ,state and local        
authorities4  7d7 ,effect on other law  
,nothing in this section shall be       
construed--  7#a7 to repeal1 amend1 or  
otherwise affect--  7,a7 section #f of  
the ,clayton ,act 7#ae ,u4,s4,c4 #ag72  
7,b7 section #bj of the ,clayton ,act   
7#bi ,u4,s4,c4 #eb72  7,c7 any provision
 of the ,norris-,la,guardia ,act 7#bi   
,u4,s4,c4 #aja et seq472  7,d7 any      
provision of the ,national ,labor       
,relations ,act 7#bi ,u4,s4,c4 #aea et  
seq472 or  7,e7 any provision of the    

,railway ,labor ,act 7#de ,u4,s4,c4 #aea
 et seq472 or  7#b7 to preclude ,federal
 jurisdiction over any violation of this
 section1 on the basis that the conduct 
at issue--  7,a7 is also a violation of 
,state or local law2 or  7,b7 occurred  
during the course of a labor dispute or 
in pursuit of a legitimate business or  
labor objective4  4
