repeal the exemption for hydraulic      
fracturing in the ,safe ,drinking ,water
 ,act1 and for other purposes4  #a4     
,short title ,this ,act may be cited as 
the ,fracturing ,responsibility and     
,awareness of ,chemicals ,act of #bjac4 
#b4 ,regulation of hydraulic fracturing 
7a7 ,hydraulic ,fracturing ,section     
#adba7;d77#a7 of the ,safe ,drinking    
,water ,act 7#db ,u4,s4,c4              
#cjj;h7d77#a77 is amended by striking   
subparagraph 7,b7 and inserting the     
following3  7,b7 includes the           
underground injection of fluids or      
propping agents pursuant to hydraulic   
fracturing operations related to oil1   
gas1 or geothermal production           
activities2 but  7,c7 excludes the      

underground injection of natural gas for
 purposes of storage4  4  7b7           
,disclosure of hydraulic fracturing     
chemicals2 medical emergencies2         
proprietary chemical formulas ,section  
#adba7;b7 of the ,safe ,drinking ,water 
,act 7#db ,u4,s4,c4 #cjj;,h7b77 is      
amended by adding at the end the        
following3  7#d7 7,a7 ,regulations      
included under paragraph 7#a77;,c7 shall
 include the following requirements3    
7i7 ,a person conducting hydraulic      
fracturing operations shall disclose to 
the ,state 7or the ,administrator if the
 ,administrator has primary enforcement 
responsibility in the ,state7--  7,i7   
prior to the commencement of any        
hydraulic fracturing operations at any  
lease area or portion thereof1 a list of
 chemicals intended for use in any      
underground injection during such       
operations1 including identification of 
the chemical constituents of mixtures1  
,chemical ,abstracts ,service numbers   
for each chemical and constituent1      

material safety data sheets when        
available1 and the anticipated volume of
 each chemical2 and  7,,ii7 not later   
than #cj days after the end of any      
hydraulic fracturing operations1 the    
list of chemicals used in each          
underground injection during such       
operations1 including identification of 
the chemical constituents of mixtures1  
,chemical ,abstracts ,service numbers   
for each chemical and constituent1      
material safety data sheets when        
available1 and the volume of each       
chemical used4  7ii7 ,the ,state or the 
,administrator1 as applicable1 shall    
make the disclosure of chemical         
constituents referred to in clause 7i7  
available to the public1 including by   
posting the information on an           
appropriate ,internet ,web site4  7iii7 
,whenever the ,state or the             
,administrator1 or a treating physician 
or nurse1 determines that a medical     
emergency exists and the proprietary    
chemical formula of a chemical used in  

hydraulic fracturing operations is      
necessary for medical treatment1 the    
person conducting the hydraulic         
fracturing operations shall1 upon       
request1 immediately disclose the       
proprietary chemical formulas or the    
specific chemical identity of a trade   
secret chemical to the ,state1 the      
,administrator1 or the treating         
physician or nurse1 regardless of       
whether a written statement of need or a
 confidentiality agreement has been     
provided4 ,the person conducting the    
hydraulic fracturing operations may     
require a written statement of need and 
a confidentiality agreement as soon     
thereafter as circumstances permit4     
7,b7 ,subparagraphs 7,a77i7 and 7,a77ii7
 do not authorize the ,state 7or the    
,administrator7 to require the public   
disclosure of proprietary chemical      
formulas4  4
