 of title ,v of the ,elementary and     
,secondary ,education ,act of #aife to  
provide grants to schools for the       
development of asthma management plans  
and the purchase of asthma medications  
and devices for emergency use1 as       
necessary4  #a4 ,short title ,this ,act 
may be cited as the ,asthma ,management 
,plans in ,school ,act4  #b4 ,asthma    
management plans  7a7 ,amendment ,part  
,d of title ,v of the ,elementary and   
,secondary ,education ,act of #aife 7#bj
 ,u4,s4,c4 #gbda et seq47 is amended by 
adding at the end the following3  #bb   
,asthma ,management ,plans  #efba4      
,asthma management plans  7a7 ,grants   
,authorized  7#a7 ,in general ,the      

,secretary is authorized to award a     
grant to a school that receives funding 
under part ,a of title ,i and is located
 in an area that the ,secretary         
determines has a high prevalence of     
asthma 7using such indicators as        
emergency department visits due to      
asthma1 asthma hospitalization rates1 or
 the ,behavioral ,risk ,factor          
,surveillance ,system71 to enable the   
school to--  7,a7 develop and implement 
an asthma management plan2 and  7,b7    
purchase asthma inhalers1 nebulizer     
machines1 valved holding chambers       
7,v,h,cs71 spacers1 and auto-injectable 
epinephrine and appropriate supplies    
determined necessary by the ,secretary1 
for students1 so that every student     
served by the school who suffers from   
asthma has access to the relief and     
treatment the student needs during the  
school day4  7#b7 ,alternative grantees 
,the ,secretary may award a grant under 
this section to a local health or       
education department to carry out the   

activities described in this section if 
the ,secretary determines that in such  
local area such department is the entity
 that would routinely carry out such    
activities4  7b7 ,application ,a school 
or department that desires to receive a 
grant under this section shall submit an
 application at such time1 in such      
manner1 and accompanied by such         
information as the ,secretary may       
require4  7c7 ,use of grant funds ,a    
school or department that receives a    
grant under this section shall develop  
and implement a comprehensive school    
asthma management plan1 and may purchase
 asthma inhalers1 nebulizer machines1   
valved holding chambers 7,v,h,cs71      
spacers1 and auto-injectable epinephrine
 for emergency use1 for students served 
by the school or department1 as needed1 
as well as devices that measure         
pulmonary function or asthma education  
tools1 or both4 ,such management plan   
shall include the following3  7#a7 ,a   
method to identify all students with a  

diagnosis of asthma4  7#b7 ,an asthma   
action plan for each student with a     
diagnosis of asthma1 developed in       
coordination with the family1 primary   
care provider1 and others as necessary4 
7#c7 ,asthma education for all school   
staff4  7#d7 ,access to medication and  
to methods to administer medication1 for
 all students served by the school or   
department who have asthma1 based on the
 student's prescription and individual  
needs4  7#e7 ,asthma medication and     
emergency policies that are specific to 
the school4  7#f7 ,protocols and        
training to support clinical management 
of acute symptoms of asthma and ongoing 
management of asthma4  7#g7 ,a system to
 support ongoing coordination of asthma 
care with the family1 the primary care  
provider1 and others as necessary4  7#h7
 ,a method to monitor the quality and   
outcomes of the care provided to each   
student served by the school or         
department who has asthma1 including how
 often treatment is needed and what     

treatment the students receives4  7d7   
,grant recipient actions ,a school or   
department that receives a grant under  
this section shall--  7#a7 utilize      
existing systems1 when possible1        
including the use of forms developed in 
accordance with section #ejd forms of   
the ,rehabilitation ,act of #aigc 7#bj  
,u4,s4,c4 #gid72  7#b7 find innovative  
ways--  7,a7 to encourage bidirectional 
communication between schools and       
students' physicians in a rapid manner2 
and  7,b7 to encourage students and     
their families to ensure continued      
adherence to asthma treatment by        
students2 and  7#c7 ensure that a nurse 
or another individual who is trained to 
administer emergency asthma care is on  
staff4  4  7b7 ,table of contents ,the  
table of contents in section #b of such 
,act is amended by inserting after the  
item relating to section #efah the      
following3  ,,subpart #bb--;,asthma     
,management ,plans ,sec4 #efba4 ,asthma
